Generally speaking the Alaska Water Use Act (which is the basis of the authority for the Water Management Unit in the Water Resources Section) does not have its own water quality standards (i.e. water quality parameters). However the Water Management Unit coordinates with the Alaska Department of Environmental Conservation (ADEC) in that we notify them of (whenever required by the Alaska Water Use Act) and give them an opportunity to comment on the applications for water rights and the applications for temporary water use that we receive. Our issued permits to appropriate water, certificates of appropriation, and temporary water use authorizations generally require the holder thereof to also obtain all other necessary state, federal or local permits for their project (which would include necessary permits from ADEC) and/or otherwise comply with all other applicable laws and regulations. ADEC's regulatory oversite over the water well use that you are describing would depend on whether the proposed water use would be considered to be a private water well or a public water system. The ADEC, Division of Environmental Health, Drinking Water Program website (dec.alaska.gov/eh/dw/index.htm) has information on both private and public water wells/systems, but ADEC should be consulted for more details on this aspect of your inquiry, including as regards what permits or certificates they may require to be issued by them for a particular proposed water well use. What permits or certifications are required? The point in time at which a hole or shaft drilled for exploration or production of oil or gas becomes subject to the Alaska Water Use Act would be when it is used for production of water or when ground water flows from the hole under natural pressure. See definition of the term "well" in 11 AAC 93.970(17). Prior to withdrawing a significant amount of water (as defined in 11 AAC 93.035) from the well, an application for either a water right or an application for temporary water use would need to be submitted to the Water Resources Section and the applicable permit to appropriate water (a permit to appropriate water is the first step in obtaining a water right which is called a certificate of appropriation) or temporary water use authorization would need to be obtained before commencing the withdrawal of a significant amount of water. What is the process for registering a water well with MLW? Whenever a water well is the requested source of water under an application for water right or an application for temporary water use, the filing instructions for those applications instruct that a copy of any applicable water well log be submitted with the application. The authority for instructing that the well log be submitted is also found in 11 AAC 93.140. The Alaska Hydrologic Survey (AHS) unit of the Water Resources Section maintains a registry of submitted water well logs on its Well Log Tracking System (known by the acronym as the WELTS database). Does MLW have any well -depth restrictions or maximum -depth recommendations for water wells on the Kenai Peninsula? None to my knowledge, but I have copied the acting head of AHS (Jim Vohden) on this email so that he can provide any further guidance to you on this question. Does MLW have any maps of the depth to the base of freshwater aquifers for the Kenai Peninsula? Not to my knowledge, but Jim Vohden may be able to refer you to maps or other information that is responsive to your question. For any given area, a search can be done on the WELTS system to bring up well logs for corresponding water wells within the search parameter area. From a review of the identified well logs, it can be seen where the water bearing layers were graphed relative to ground surface at the well bore location(s) being reviewed. Does MLW have any suggestions or recommendations for the AOGCC as we work through this? Because of the water - quality aspect in your above set of questions, I think it will be necessary to also coordinate with the applicable staff at ADEC. As regards the confidential aspect of the detailed information you described, it is possible to request (pursuant to AS 38.05.035(a)(8)(C)) confidentiality for geological, geophysical and/or engineering data being submitted to the DNR Division of Mining, Land and Water. This summer, an oil and gas company drilled a series of shallow (<=600') stratigraphic test wells on the Kenai Peninsula. Two of these wells were drilled on private land. The company proposes to transfer all responsibility for those wells to the private landowners for use as water wells. This is allowed under AOGCC's regulation 20 AAC 25.140 (appended below). However, this is the first time --to my knowledge --that this type of transfer is being requested, and we have a lot of questions and concerns. Since MLW typically tracks and manages these types of wells, we'd like to involve you all in the process as much as we can, but under 20 AAC 25.537, the detailed information about these stratigraphic test wells will be held confidential until the summer of 2019. Regulation 20 AAC 25.140, below, specifies several criteria, including that each well is: 1. onshore, 2. safe for use as a freshwater well, 3. the proposed use as a fresh water well is bona fide, 4. plugged back to a depth for use as a water well, and 5. the wellsite passes an AOGCC clearance inspection. With respect to items 2, 3, and 4, what water -quality standards or requirements does the Division of Mining, Land and Water employ or recommend for freshwater wells? What permits or certifications are required? What is the process for registering a water well with MLW? Does MLW have any well -depth restrictions or maximum -depth recommendations for water wells on the Kenai Peninsula? Water wells If a well drilled onshore for oil or gas is to be abandoned, but is safe for use as a freshwater well, a person who wishes to use the well as a freshwater well must obtain written authorization to do so from the landowner and the owner of the surface rights. The authorization must provide for the authorized person's assumption of full responsibility for the final plugging of the water well. This authorization must be filed with the commission and is subject to commission approval, based upon the commission's determination that the proposed use as a freshwater well is bona fide. Pearl 6 is one of 16 - 20 shallow vertical stratigraphic test wells to be drilled and evaluated in the area between Ninilchik and Anchor Point on the southern Kenai Peninsula. The plan is to begin drilling operations during the week of June 13, 2017. The goal of the shallow stratigraphic test well program is to penetrate 1-3 shallow coal seams and evaluate this shallow wellbore with gamma ray and resistivity logs. A dipmeter log could also be run if requested by Geology to aid in the evaluation of the stratigraphic test well. Hilcorp will utilize a very experienced water well contractor on the Kenai Peninsula that will utilize best practices for the drilling of the shallow stratigraphic test wells. Hilcorp Alaska, LLC requests a variance from 20 AAC 25.035 (d) for utilizing diverter while drilling the shallow wells required for the stratigraphic test well program. The basis for this variance is information gathered by Hilcorp Sr. Geologist, David Buthman containing the shallowest gas shows and well test information from offset wells in the three areas to be targeted by the stratigraphic well test program. Hilcorp Alaska, LLC also requests a variance from 20 AAC 25.050 for obtaining wellbore surveys due to the very shallow wells being drilled for the stratigraphic test program. A sign will be posted//.at each drilling location with the well information required by AOGCC., �•/Z,17 The shallow stratigraphic test wells will be drilled with air and the cuttings will be captured in a tank as per AAC 20 25.047. Hilcorp anticipates drilling 16-20 stratigraphic test wells, each up to 600' deep that will be drilled and evaluated on the southern end of the Kenai Peninsula between Ninilchik and Anchor Point. The areas have been named Seaview (near Anchor Point), Pearl (near Ninilchik) and Deep Creek (for the inland locations about 5 miles south of the Happy Valley gas field). These stratigraphic test wells intend to penetrate 1-3 shallow coal seams within 500'-600' from surface. Although section UNO 01-10 doesn't display strong amplitudes above about 1.0 seconds, located near the center of the section is a zone where the seismic signal clearly loses coherence. Several weakly continuous reflectors visible within this zone below about 1.0 second appear to sag downward. This area is reminiscent of gas chimneys that I have seen on other seismic surveys (an example from Google is shown below). Is this a gas chimney? If so, how far is it from the planned Pearl 1A, 3 and 6 strat test wells? If Pearl 1A, 3 and 6 are near this feature, what risk does it pose as a shallow drilling hazard.
