March 22, 2024 Civil penalty payment (confidential exhibits held in secure storage) STATE OF ALASKA ALASKA OIL AND GAS CONSERVATION COMMISSION 333 West Seventh Avenue Anchorage Alaska 99501 Re: Missing Meter Performance Reports ) Other Order 210 Custody Transfer Meters ) Docket Number: OTH-24-004 Duck Island Unit ) March 5, 2024 DECISION AND ORDER On June 10, 2022, the Alaska Oil and Gas Conservation Commission (AOGCC) issued a conditional approval letter for new custody transfer oil measurement equipment at Duck Island Unit Endicott Main Production Island (Endicott). On February 6, 2024, AOGCC issued a Notice of Proposed Enforcement Action (Notice) to Hilcorp Alaska, LLC (Hilcorp) regarding Endicott oil custody transfer meters. The Notice proposed a $55,000 civil penalty under AS 31.05.150(a). Hilcorp acknowledged receipt of the Notice and requested an informal review of the matter. The informal review was held February 14, 2024, during which time Hilcorp provided verbal assurance that corrective actions have been implemented. Hilcorp also responded by letter dated February 8, 2024. In its response, Hilcorp states it “has elected not to appeal docket number OTH-24-004”. The letter and payment were received by AOGCC on February 19, 2024. Hilcorp provided copies of the missing reports by emails dated February 19 and February 21, 2024. Summary of Proposed Enforcement Action: The Notice identified violations by Hilcorp of the June 10, 2022, conditional approval letter for new custody transfer oil measurement equipment at Endicott. The Notice proposed a civil penalty of $55,000 for failure to provide meter performance reports and failing to notify for opportunity to witness meter proves as specified in the meter approval letter.1 The Notice also proposed that Hilcorp submit the required information and provide a detailed written explanation that describes how it intends to prevent recurrence of this violation. Violation - Failure to Submit Required Custody Transfer Meter Performance Reports: Replacement of two existing turbine custody transfer meters with Coriolis meters was conditionally approved by AOGCC on June 10, 2022. Requirements imposed included the meter prove frequency, notification to AOGCC for opportunity to witness meter proves, required actions before making changes to the custody transfer measurement equipment, and reporting obligations following proves. Condition 5 of the Endicott meter approval letter requires that Hilcorp “provide 24-hour notice to the AOGCC for opportunity to witness meter proves.” Condition 6 of the Endicott meter approval letter requires that Hilcorp “provide results of the monthly meter proves within 7 days, including i. Prove reports; ii. Batch summaries; iii. Current meter curve or meter factor control chart with the following fixed control limits that are used to determine when to initiate recalibration of instruments, inspections, adjustments, cleaning, or repairing of mechanical equipment, or audits of the measurement system: 1 The $55,000 civil penalty is comprised of a $10,000 penalty for failure to notify for opportunity to witness meter proves (2 months; $5,000 each) and a $45,000 penalty for failure to submit meter performance reports (3 months; $15,000 each). Other Order 210 March 5, 2024 Page 2 of 4 1. +/-0.15% meter factor deviation between consecutive proves 2. +/-0.25% meter factor deviation between current and baseline proves.” AOGCC Inspectors witnessed 3 meter proves at Endicott during a trial period demonstration prior to the Coriolis custody transfer oil meter being placed in routine service.2 The successful demonstration was completed on October 6, 2023, and associated reports were provided documenting meter performance. Hilcorp performed the required monthly meter proves at Endicott in November and December 2023 and January 2024. AOGCC witnessed routine meter proves in conjunction with a separate visit to Endicott on November 4 and November 14, 2023. Hilcorp gave notice to AOGCC on November 25, 2023, for opportunity to witness meter proving at Endicott – AOGCC waived witness that same day. No notice was given for meter proves occurring in December 2023 and January 2024. For the months November and December 2023 and January 2024, Hilcorp has only provided meter prove reports to AOGCC Inspectors at the conclusion of the witnessed meter tests in November. There were no batch summaries or meter factor control charts provided for the November witnessed proves. Hilcorp did not provide any of the required reports for the meter proves done in December 2023 and January 2024. Mitigating Circumstances: The factors in AS 31.05.150(g) were considered in determining the appropriate penalty.3 Hilcorp’s lack of good faith in its attempts to comply with the imposed conditions, its history of regulatory noncompliance and need to deter similar behavior are the factors which most heavily influence AOGCC’s decision, and the penalty being assessed in this matter: - The failure to submit information related to meter performance – specifically the meter factor control charts – cannot be characterized as a good faith attempt to comply with the AOGCC’s conditional approval letters. - There is nothing ambiguous about the approval conditions requiring submittal of meter prove results, and the requirements are consistent with the industry recognized 2 Witnessed meter proves during the trial period demonstration occurred on September 8, 12, and 17, 2023. 3 AS 31.05.150 includes the following factors for consideration in determination of a penalty assessed under this section. (1) the extent to which the person committing the violation was acting in good faith in attempting to comply; (2) the extent to which the person committing the violation acted in a willful or knowing manner; (3) the extent and seriousness of the violation and the actual or potential threat to public health or the environment; (4) the injury to the public resulting from the violation; (5) the benefits derived by the person committing the violation from the violation; (6) the history of compliance or noncompliance by the person committing the violation with the provisions of this chapter, the regulations adopted under this chapter, and the orders, stipulations, or terms of permits issued by the commission; (7) the need to deter similar behavior by the person committing the violation and others similarly situated at the time of the violation or in the future; (8) the effort made by the person committing the violation to correct the violation and prevent future violations; and (9) other factors considered relevant to the assessment that are adopted by the commission in regulation. Other Order 210 March 5, 2024 Page 3 of 4 standardized practices found in API Manual of Petroleum Measurement Standards for documenting meter performance.4 - The absence of equipment performance tracking information such as the required meter factor control charts compromises the ability of AOGCC to make informed, fact-based decisions about how frequently meters should be proved and how frequent those proves should be witnessed. This information is additionally important for Coriolis meters which have been approved just once in the past for custody transfer measurement under AOGCC jurisdiction. - Hilcorp’s recurring failure to account for approval conditions imposed by AOGCC calls into question the effectiveness of corrective actions implemented in responses to past enforcement actions. Specific to the current enforcement, the Endicott noncompliance is the fifth occurrence of Hilcorp failing to provide required meter performance reports.5 Mitigating circumstances considered in the assessment of the proposed civil penalty include Hilcorp’s partial submittal of information to the AOGCC Inspector who witnessed meter proves in November 2023, the good performance of the meter demonstrated during the trial period, and no injury to the public beyond failure to comply. Further, AOGCC has not imposed per-day assessments for the violations, which has significantly reduced the penalty. Findings and Conclusions: The AOGCC finds that Hilcorp violated the June 10, 2022, conditional approval letter for the custody transfer oil meter at Endicott. Mitigating circumstances outlined above were considered in the Notice and the AOGCC assessment as to the appropriate civil penalty. Hilcorp has neither disputed the findings in the Notice, nor the penalty proposed by AOGCC. Since receiving the Notice, Hilcorp has provided the missing performance reports for the meter proves as required in the conditional approval letter. Now Therefore It Is Ordered That: Hilcorp is assessed a civil penalty in the amount of $55,000 for violating the June 10, 2022, conditional approval letter for the Endicott custody transfer oil measurement equipment. Hilcorp’s response to the Notice included specific corrective actions to prevent recurrence of this violation. As an Operator involved in an enforcement action, Hilcorp is required to preserve documents concerning the above action until after resolution of the proceeding. If the notice was mailed, then the period of time shall be 23 days. An application for reconsideration must set out the respect in which the order or decision is believed to be erroneous. The AOGCC shall grant or refuse the application for reconsideration in whole or in part within 10 days after it is filed. Failure to act on it within 10-days is a denial of reconsideration. If the AOGCC denies reconsideration, upon denial, this order or decision and the denial of reconsideration are FINAL and may be appealed to superior court. The appeal MUST be filed within 33 days after the date on which the AOGCC mails, OR 30 days if the AOGCC otherwise distributes, the order or decision denying reconsideration, UNLESS the denial is by inaction, in which case the appeal MUST be filed within 40 days after the date on which the application for reconsideration was filed. If the AOGCC grants an application for reconsideration, this order or decision does not become final. Rather, the order or decision on reconsideration will be the FINAL order or decision of the AOGCC, and it may be appealed to superior court. That appeal MUST be filed within 33 days after the date on which the AOGCC mails, OR 30 days if the AOGCC otherwise distributes, the order or decision on reconsideration. In computing a period of time above, the date of the event or default after which the designated period begins to run is not included in the period; the last day of the period is included, unless it falls on a weekend or state holiday, in which event the period runs until 5:00 p.m. on the next day that does not fall on a weekend or state holiday. We are really pleased with the performance of the Coriolis meter and the flatness of the curve. We have submitted the prover reports per the normal channel. We will continue to carry out 1 proof per day for the next 12 days (today included). We may not be able to prove above 400 BBL/Hr due to restrictions in the plant. At the end of the trial period, we will send you an updated curve with all the comparisons. I would like to request approval to stay on FT1361D, instead of changing back to FT1361C (the turbine meter) if the meter comparison stays within the specified +/-0.25% per our expectations. Meter Curve D run 2” Coriolis (S/N: 14024007). Flowrate BBL/hour Configuration file We looked at the Point Tomson LACT meter (also Micro Motion) config file and updated the damping factors per their settings. While we did pass the prover test with both new and old settings, with the new settings it takes fewer attempts at high flowrates (400 BBL/Hr). I have attached the latest configuration file. We are not planning to make any additional changes. The meters are located within Module 303 on the Endicott Field Main Production Island (Endicott). Hilcorp’s request includes replacing two existing out-of-service 4-inch turbine meters with two Emerson Micro Motion Elite Coriolis meters – one 2-inch and one 3-inch. The Coriolis meters will be the primary oil custody transfer measurement points for Duck Island Unit production. The two remaining 3-inch turbine meters within the oil measurement skid will be retained as spares. Except for some piping and electrical wiring necessary to optimize the Coriolis position within the skid for measurement, there are no other changes proposed. Use of Coriolis meters for custody transfer measurement requires a variance.1 Hilcorp references performance data from the Point Thomson Unit meter system as support for use of the Coriolis meters at Endicott. Hilcorp references no other experience or data for Coriolis meters in custody transfer measurement service. To gain acceptance of the Coriolis meter for use at Endicott, Hilcorp has proposed a one-month demonstration where the Coriolis meters’ performance will be compared to the existing 3-inch turbine meters’ performance. Installation of the Coriolis meters at Endicott is scheduled to occur beginning the last week of June 2022. The following equipment comprises the proposed Endicott custody transfer meter system: 1 AOGCC regulation 20 AAC 25.228 incorporates by reference API Manual of Petroleum Measurement Standards, as revised November 30, 1998; this version does not address Coriolis meters. The 2002 version of API Manual of Petroleum Measurement Standards, Section 5.6, recognizes Coriolis meters for custody transfer. The standard for granting a variance is found in 20 AAC 25.228(j). Pulses per barrel will be used by the Coriolis meters to communicate to the flow computer. AOGCC approves Hilcorp’s request to downsize the Duck Island Unit oil custody transfer meters and replace 2 of the 4 existing turbine meters with Micro Motion Elite Coriolis meters subject to the following conditions: 1. Hilcorp must demonstrate a performance level acceptable to AOGCC before the Coriolis meters are used as the primary custody transfer meters. 2. The Duck Island Unit custody transfer measurement system must include the equipment as described in Hilcorp’s application dated February 2, 2022. Before changes are made to the custody transfer measurement equipment or measurement methodology Hilcorp must demonstrate conformance of the proposed changes and obtain AOGCC approval. 3. Hilcorp must provide AOGCC the opportunity to witness a. custody transfer meter system inspections scheduled to occur prior to initial start- up and prior to restart after repairs; b. routine meter proves; c. building new curves for the custody transfer meters; and d. calibrations of the transmitters that are part of the custody flow measurement system. 4. If the AOGCC opts not to witness a prove Hilcorp must still conduct the prove. 5. After demonstrating an acceptable level of performance from the demonstration period, Hilcorp must prove the custody transfer meter(s) at least monthly. Flow conditions must be stable at the time of the prove. If production is not stable at the time the monthly prove is scheduled to occur a prove must be conducted as soon thereafter as the flow is stabilized. Hilcorp must provide 24-hour notice to the AOGCC for opportunity to witness meter proves. AOGCC Industry Guidance Bulletin 10-01A delineates notification procedures and contacts (copy attached). The following information shall be available for AOGCC inspection at the time of a meter prove: a. Data download from the flow computer that includes flow parameter configuration, measured flow volumes, and alarm history (meter system alarms only); Docket Number: OTH-22-006 June 10, 2022 Page 3 of 4 b. Calibration records for all metering instrumentation; c. Up-to-date historic trend of meter factors; d. Density verifications; e. Record of zero verifications and zero calibrations of the Coriolis meters conducted during pipeline shutdowns or line pauses at or near process conditions. 6. Hilcorp must provide results of the monthly meter proves within 7 days, including a. Prove reports; b. Batch summaries; c. Current meter curve or meter factor control chart 2 with the following fixed control limits that are used to determine when to initiate recalibration of instruments, inspections, adjustments, cleaning, or repairing of mechanical equipment, or audits of the measurement system: i. +/-0.15% meter factor deviation between consecutive proves ii. +/-0.25% meter factor deviation between current and baseline proves 7. Hilcorp must perform quarterly density verifications of crude oil samples by one of the following methods: online densitometer; laboratory determination; pycnometer; or hydrometer. 8. Prover volume certifications shall be performed at the earlier occurrence of maintenance which may affect the prover’s base volume, every 3 years, and when the certified prover volume changes more than 0.02%. Hilcorp must provide 48-hour notice to the AOGCC for opportunity to witness prover calibrations. 9. Surface commingling of production from outside the Duck Island Unit upstream of the metering system approved in this letter is prohibited without written authorization from AOGCC. 10. There shall be no allocation of water to custody transfer metered volumes from Duck Island Unit. Nature of the Apparent Violation or Noncompliance (20 AAC 25.535(b)(1)). Hilcorp has violated the provisions of the conditional approval letter for the Duck Island Unit custody transfer oil measurement equipment. Basis for Finding the Violation or Noncompliance (20 AAC 25.535(b)(2)). Custody transfer measurement equipment for Duck Island Unit oil was conditionally approved by the AOGCC on June 10, 2022. Requirements imposed include the meter prove frequency, notification to the AOGCC for opportunity to witness meter proves, required actions before making changes to the custody transfer measurement equipment, reporting obligations following meter proves, and a trial period demonstration where the new Coriolis meter performance would be compared to the existing turbine meters. The successful demonstration period was initiated in September 2023 and completed on October 6, 2023. Two approval conditions have been repeatedly violated since the trial demonstration period was concluded: - Condition 5 of the approval letter requires Hilcorp provide at least 24-hour advance notice to the AOGCC for the opportunity to witness the monthly meter prove. Hilcorp has failed to notify the AOGCC of monthly meter proves in December 2023 and January 2024. Docket Number: OTH-24-004 February 6, 2024 Page 2 of 3 - Condition 6 of the approval letter requires submittal of the monthly meter prove results be submitted within 7 days, including prove reports, batch summaries, and the current meter curve or meter factor control charts with the specified control limits used to determine when to initiate maintenance or corrective actions. Hilcorp has failed to submit meter performance reports for November 2023 through January 2024. Proposed Action (20 AAC 25.535(b)(3)). For violating provisions of the June 10, 2022, conditional approval letter for Duck Island Unit oil custody transfer measurement equipment, the AOGCC intends to impose civil penalties on Hilcorp under AS 31.05.150(a) in the amount of $55,000:1 - $10,000 - failure to notify for opportunity to witness meter proves (2 months; $5,000 each); - $45,000 - failure to submit meter performance reports (3 months; $15,000 each). In determining the amount of the penalty, the AOGCC has considered the criteria in AS 31.05.150(g), with emphasis on the need to deter similar behavior by Hilcorp and others similarly situated at the time of the violation or in the future, and Hilcorp’s four previous instances of noncompliance similar to the Duck Island Unit oil meter violation.2 In addition to the imposed civil penalty, the AOGCC intends to require Hilcorp to provide the following within 10 days of the final decision date: - a detailed written explanation that describes how it intends to prevent recurrence of this violation; and - the missing meter performance information. As an operator involved in an enforcement action you are required to preserve documents concerning the above actions until after resolution of the proceeding. Rights and Liabilities (20 AAC 25.535(b)(4)). Within 15 days after receipt of this notification – unless the AOGCC, in its discretion, grants an extension for good cause shown – Hilcorp may file with the AOGCC a written response that concurs in whole or in part with the proposed action described herein, requests informal review, or requests a hearing under 20 AAC 25.540. If a timely response is not filed, the proposed action will be deemed accepted by default. If informal review is requested, the AOGCC will provide Hilcorp an opportunity to submit documentary material and make a written or oral statement. If Hilcorp disagrees with the AOGCC’s proposed decision or order after that review, it may file a written request for a hearing within 10 days after the proposed decision or order is issued. If such a request is not filed within that 10-day period, the proposed decision or order will become final on the 11th day after it was issued. If such a request is timely filed, the AOGCC will hold its decision in abeyance and schedule a hearing. 1 AS 31.05.150(a) provides for not more than $100,000 for the initial violation and not more than $10,000 for each day thereafter on which the violation continues. 2 Refer to Other Orders 113, 153, and 170. Docket Number: OTH-24-004 February 6, 2024 Page 3 of 3 If Hilcorp does not concur in the proposed action described herein, and the AOGCC finds that Hilcorp violated a provision of AS 31.05, 20 AAC 25, or an AOGCC order, permit or other approval, then the AOGCC may take any action authorized by the applicable law including ordering one or more of the following: (i) corrective action; (ii) suspension or revocation of a permit or other approval; and (iii) imposition of penalties under AS 31.05.150. In taking action after an informal review or hearing, the AOGCC is not limited to ordering the proposed action described herein, as long as Hilcorp received reasonable notice and opportunity to be heard with respect to the AOGCC’s action.
