By letter dated November 14, 2023, Hilcorp Alaska, LLC (Hilcorp) requested the Alaska Oil and Gas Conservation Commission (AOGCC) issue an order approving an exception to the spacing requirements of Rule 3 of Conservation Order No. 449 (CO 449) to drill, complete, test, and produce the Main Production Island No. 2-74 (MPI 2-74) development oil well within 500 feet of the external boundary of the Eider Oil Pool, Duck Island Unit, North Slope Borough, Alaska. 2. Pursuant to 20 AAC 25.540, AOGCC tentatively scheduled a public hearing for January 25, 2024. On November 16, 2023, AOGCC published notice of the opportunity for that hearing on the State of Alaska’s Online Public Notice website and on AOGCC’s website, electronically transmitted the notice to all persons on AOGCC’s email distribution list. On November 19, 2023, AOGCC published the notice in the Anchorage Daily News. 3. Hilcorp sent, by certified mail, notice of the application to all owners, landowners, and operators of all properties within 1,000 feet of the MPI 2-74 well trajectory and provided the notice, addresses to which the notices were delivered, and certified mail receipts to AOGCC. 4. No comments or request for public hearing were received. 5. Hilcorp’s application, AOGCC’s records, and public information provide sufficient information upon which to make an informed decision. PURPOSE AND NEED FOR THIS ORDER: Well spacing regulations protect the oil and oil rights of adjacent landowners and maximize resource recovery by establishing default limits on how close, under the land's surface, oil and gas wells can be to each other and to property lines where ownership changes hands. These limits are set forth in a regulation, 20 AAC 25.055. Operators must abide by the default well spacing limits (referred to as statewide spacing requirements) unless they apply for, and obtain, an exception to those limits. Although exceptions to the default well spacing requirements are not unusual, AOGCC carefully evaluates each application, and typically grants them only when actual geologic conditions demonstrate that the proposed subsurface location of a well is necessary to reach otherwise unreachable oil or oil and that both the rights of adjacent landowners and underground CO 813 February 8, 2024 Page 2 of 3 drinking water can be protected. As a general matter, AOGCC does not have extensive authority over surface impacts such as noise, emissions, or construction. FINDINGS: 1. Hilcorp is operator for the MPI 2-74 offshore well located within the Eider Oil Pool, Duck Island Unit. This well is planned to be drilled in early 2024. Surface Location: 2,161’ FNL, 2,382’ FEL, Sec. 36, T12N, R16E, Umiat Meridian (U.M.) Top Productive Horizon: 1,006’ FSL, 2,465’ FEL, Section 27, T12N, R16E, U.M. Bottom Hole Location: 1,703’ FSL, 1,076’ FEL, Section 28, T12N, R16E, U.M. 2. MPI 2-74 will be located on State of Alaska leases ADL 34633 and ADL 34634 Segment 2, which are owned and operated by Hilcorp. 3. CO 449 governs the Eider Oil Pool. 4. This well will be directionally drilled to the west from a surface location on the Duck Island Unit Main Production Island to an offshore bottom-hole location near the boundary that separates the Eider Oil Pool from the Niakuk Field. The adjacent lease within 500’ of the productive interval in MPI 2-74 is Segment 1 of ADL 34634, which is owned by the Prudhoe Bay Unit Working Interest Owners (ExxonMobil Alaska Production, Inc., ConocoPhillips Alaska, Inc., Chevron U.S.A., Inc., and Hilcorp) and operated by Hilcorp. 5. MPI 2-74 targets reserves within the Eider Oil Pool that cannot be reached by a well that conforms to the spacing requirements of Rule 3 of CO 449 because of their most prospective location on the subsurface structure. CONCLUSIONS: 1. An exception to the well spacing provisions of Rule 3 of CO 449 is necessary to allow drilling, completion, testing, and regular production of the Eider Oil Pool in the MPI 2-74 development oil well to maximize ultimate resource recovery. 2. It is not possible to recover the targeted reserves from a well location that conforms to the spacing requirements of Rule 3 of CO 449. 3. If constructed and operated as required, drilling, testing, completion, and regular production of MPI 2-74 will not cause waste or result in an increased risk of fluid movement into freshwater. 4. Granting an exception to the well spacing provisions of Rule 3 of CO 449 for MPI 2-74 will not result in waste or jeopardize correlative rights of adjoining or nearby owners, is based on sound engineering and geoscience principles, and will not result in an increased risk of fluid movement into freshwater. NOW THEREFORE IT IS ORDERED: The AOGCC grants Hilcorp’s November 14, 2023, application for an exception to the well spacing provisions of Rule 3 of CO 449 to allow drilling, completion, testing, and regular production of the MPI 2-74 development oil well within the Eider Oil Pool. If the notice was mailed, then the period of time shall be 23 days. An application for reconsideration must set out the respect in which the order or decision is believed to be erroneous. The AOGCC shall grant or refuse the application for reconsideration in whole or in part within 10 days after it is filed. Failure to act on it within 10 days is a denial of reconsideration. If the AOGCC denies reconsideration, upon denial, this order or decision and the denial of reconsideration are FINAL and may be appealed to superior court. The appeal MUST be filed within 33 days after the date on which the AOGCC mails, OR 30 days if the AOGCC otherwise distributes, the order or decision denying reconsideration, UNLESS the denial is by inaction, in which case the appeal MUST be filed within 40 days after the date on which the application for reconsideration was filed. If the AOGCC grants an application for reconsideration, this order or decision does not become final. Rather, the order or decision on reconsideration will be the FINAL order or decision of the AOGCC, and it may be appealed to superior court. That appeal MUST be filed within 33 days after the date on which the AOGCC mails, OR 30 days if the AOGCC otherwise distributes, the order or decision on reconsideration. In computing a period of time above, the date of the event or default after which the designated period begins to run is not included in the period; the last day of the period is included, unless it falls on a weekend or state holiday, in which event the period runs until 5:00 p.m. on the next day that does not fall on a weekend or state holiday. In accordance with 20 AAC 25.005, Hilcorp will submit to AOGCC an application for a Permit to Drill prior to the commencement of drilling. Hilcorp plans to spud the well on or around March 1, 2024. The well path for MPI 2-74 is located on two (2) State of Alaska oil and gas leases, ADL 34634 and ADL 34633. The surface hole location is on the DIU Main Production Island Pad (“MPI”) operated by Hilcorp. Thedrilling of the MPI 2-74 well will be governed by the Endicott Field Eider Pool Rules specified in CO 449. Therefore, Rule 3 of CO 449 is controlling, and in relevant part, Rule 3 provides: x Spacing units within the pool will be 160 acres. The pool shall not be opened in any well closer than 500 feet to an external boundary of the affected area. The MPI 2-74 is a development well targeting proven reserves in the Ivishak Formation within the EOP defined in CO 449. This spacing exception is necessary because this well will be open to test and/or produce oil from the EOP within 500 feet of an external boundary of the Affected Area of CO 449. The MPI 2-74 well will target these proven oil reserves within the EOP that cannot be reached by conforming to applicable spacing restrictions specified in Rule 3 of CO 449. In accordance with 20 AAC 25.055(d)(2), a map of the well location and their relationship to adjoining properties is attached to this application (see Exhibit A). Discussion MPI 2-74 is a proposed grassroots well targeting the Ivishak Formation within the EOP located on MPI in the DIU near Prudhoe Bay, Alaska. The target structure is located next to the Niakuk Field. There have been two (2) wells which produced from the Ivishak in the EOP, the 2-56A and the 2- 30A wells. The 2-56A was initially a producer in the Ivishak and was later converted to a water injector to support the 2-30A. The 2-30A was later used for a sidetrack into another formation within DIU and was still producing ~500 bopd at 88% water cut from the EOP prior to the sidetrack operations. The objective for the 2-74 well is to replace the production from the 2-30A well in the EOP. There has been no production or injection into the Ivishak since the 2-30A well was last sidetracked. Hilcorp anticipates that the Ivishak Formation will be productive in the 2-74 well based off of the historical production data from 2-30A. Hilcorp owns 100% Working Interest in ADL 034633 and ADL 034634, Segment 2 and is the Operator of the DIU. The adjacent lease within 500’ of the productive interval in the well is ADL 034634, Segment 1 and owned by the Prudhoe Bay Unit Working Interest Owners as described below: x Hilcorp North Slope, LLC (Operator): 26.36% x ExxonMobil Alaska Production, Inc.: 36.40% x ConocoPhillips Alaska, Inc.: 36.08% x Chevron U.S.A., Inc.: 1.16% The State of Alaska owns 100% of the mineral interest in the affected lands. Hilcorp has discussed the plans to drill this well with the Prudhoe Bay Unit Operator prior to submitting this application and received no objections. Following successful completion of the MPI 2-74 well, production will be allocated to the Eider Oil Participating Area as already approved by the State of Alaska, Department of Natural Resources.
