On October 31, 2007, pursuant to 20 AAC 25.615 the Commission gave written notice of proposed fiscal year 2008 regulatory cost charges under AS 31.05.093 to operators subject to those charges. 2. Notice of public hearing on the proposed fiscal year 2008 regulatory cost charges -was published in the Anchorage Daily News on November 1, 2007. 3. A public hearing was held at the Commission's offices on November 30, 2007. FINDINGS: 1. The appropriation, other than of federal receipts, made for the operating costs of the Commission for this fiscal year is $4,796,983. 2. The lapsed amount of the fiscal year 2007 appropriation that is included to reduce the regulatory cost charges in this fiscal year's appropriation under AS 31.05.093(d) is $563,629. 3. The amounts constituting VOp under 20 AAC 25.605(a) for the operators subject to a fiscal year 2008 regulatory cost charge are as follows: Aurora Gas LLC 672,134 Bbl BP Exploration (Alaska) Inc. 1,802,744,057 Bbl ConocoPhiAips tnc. 486,383,694 Bb! The Commission chooses not to include in its calculation of fiscal year 2008 regulatory cost charges an allowance to cover charges that the Commission may be unable to collect. 2. Using the formula set out in 20 AAC 25.605, the fiscal year 2008 regulatory cost charges for the operators subject to those charges are as follows: Aurora Gas LLC $1,209.87 BP Exploration (Alaska) lnc. $3,244,989.64 ConocoPhi!lips Inc. $875,504.23 Forest Oil Corporation $4,434.32 Marathon Oil Company $20,193.47 North Slope Borough $409.00 UNOCAL $79,438.59 XTO Energy, Inc. $7,174.89 Tota! $4,233,354.00 3. Appropriate payment dates under 20 AAC 25.620 are December 31, 2007, February 15, 2008, April 15, 2008 and June 15, 2008.. NOW THEREFORE IT IS ORDERED that the operators listed in Conclusion 2 of this Order shall pay their respective regulatory cost charges as required by Conclusion 3 of this Order. Oil and Gas Conservation Commission AS 31.05.080 provides that within 20 days a#ler receipt of written notice of the entry of an order, a person affected by it may file with the Commission an application for rehearing. A request for rehearing must be received by 4:30 PM on the 23'd day following the date of the order, or next working day if a holiday or weekend, to be timely filed. The Commission shall grant or refuse the application in whole or in part within 10 days. The Commission can refuse an application by not acting on it within ibe 10.day period An affected person has 30 days from the date the Commission refuses the application or mails (or otherwise distributes) an order upon rehearing, bath being the final order of the Commission, to appeal the decision to Superior Court. The proceedings are being held in accordance with 20 AAC 25 Section 540 and this is the provision of the Alaska oil and gas conservation regulations governing public hearings. Any persons who would like to testify today will be allowed to do so. Also there has been an opportunity to allow interested parties, and specifically those with responsibility to pay their portion of the Regulatory Cost Charge to file comments. The file that is before me does not reflect that we have received any written comments. If there are persons with written comments, they should provide them now. I will review briefly the purpose of the Regulatory Cost Charge. That charge is a cost that was established by the Alaska Legislature and is to be assessed against the regulated industry, the oil and gas industry operating in Alaska, to cover the costs of regulation by the Alaska Oil & Gas Conservation Commission. That is not unique to this Commission, similar structure exists for payment of costs by other regulated utilities for regulatory commissions. The idea is that the industry would bear the burden of regulating rather than to have that money paid out of the general fund. We at our last meeting went through the general mechanism for determining the Regulatory Cost Charge which basically is to determine the Commission's budget. A snapshot is taken, if you will, of all persons who have any wells that have not been plugged and abandoned and those persons then populate the field of operators that have responsibility to pay a portion of the cost. That cost is then assessed by developing a fraction which takes into consideration a total volume of fluids by each operator over the total of all fluids for the state. Fluids in the formula is referred to as oil and gas produced from the ground and I specifically in that comment omit water, produced oil and gas, and then it is any fluids reinjected which would include any produced water or other substances or gas that might be reinjected into a reservoir. That amount is applied as I mentioned to the -- creates -- yields a fraction for each operator and that determines that operator's -- that determines that operator's responsibility for payment of the proportioned amount of the Regulatory Cost Charge. I will now review the allocations of funds and the operators and their responsibility for payment of same. Aurora Gas, LLC, the assessment of -- and this is an annual assessment which will then be billed quarterly. The notice states that public notice has been given, references the total cost of the Commission, it notes the amounts that have lapsed for Fiscal Year 2007 and these are amounts by which the Commission has operated under budget and this carries forward as a credit and will reduce the cost burden on industry. That carry forward credit is $563,629. Finally the order provides that designated operators will be required to pay their respective share of the Regulatory Cost Charge. The hearing is being held on the morning of Friday November 30, 2007, beginning at 9:00 am. We are located at the Commission's Offices at 333 West 7~' Avenue, Suite 100. I will begin by introducing myself. I'm John Norman, Chairman of the Alaska Oil and Gas Conservation Commission and to my left is Commissioner Cathy Foerster and to my right is Commissioner Dan Seamount, of the Commission. With us today is R&R Court Reporting who will be recording and preparing a transcript of these proceedings. The purpose of this hearing today is to review and take comments, if there are any, concerning the Alaska Oil and Gas Conservation Commission's 2048 regulatory cost charges and this is for the fiscal year 2008, which began on July 1 of 2007 and will run through June 30 of 2008. The file reflects that notice of this hearing was duly published and notice was sent to all of the parties who will have responsibility for paying a portion of the regulatory cost charge during the year in question.
