On October 26, 2023, pursuant to 20 AAC 25.615 the Alaska Oil and Gas Conservation Commission (AOGCC) gave written notice of proposed fiscal year 2024 regulatory cost charges under AS 31.05.093 to operators subject to those charges. 2. Notice of public hearing on the proposed fiscal year 2024 regulatory cost charges was published and notice was sent to all the parties who will be responsible for paying a portion of the regulatory cost charge on October 26, 2023. 3. By email, persons subject to the regulatory cost charge were sent notice of the proposed regulatory cost charges for fiscal year 2023. No comments were submitted and no revisions to the proposed charges were requested. 4. A public hearing was held on November 30, 2023. FINDINGS: 1. The appropriation made for the operating costs of the AOGCC for this fiscal year is $8,393,300.00. 2. Federal receipts of $170,000.00 are allotted for the oversight of Class II wells under the Safe Drinking Water Act Underground Injection Control Program and reduce the regulatory cost charges for this fiscal year. 3. The lapsed amount of the fiscal year 2023 appropriation that is included to reduce the regulatory cost charges in this fiscal year's appropriation under AS 31.05.093(d) is $781,937.30. 4. The amounts constituting VOP under 20 AAC 25.605(a) for the operators subject to a fiscal year 2024 regulatory cost charge are as follows: OPERATOR VOP In Bbl AIX Energy, LLC 206,856 Amaroq Resources, LLC 18,571 Bluecrest Alaska Operating, LLC 379,067 ConocoPhillips Alaska, Inc. 368,695,791 Cook Inlet Energy, LLC 2,254,172 Cook Inlet Natural Gas Storage Alaska, LLC 1,824,777 Eni US Operating Co. Appropriate payment dates under 20 AAC 25.620 are December 30, 2023, February 10, 2024, and April 14, 2024. No later than each payment date, a person subject to a regulatory cost charge shall pay one-third of the difference between the person’s regulatory cost charge and any estimated regulatory cost charge previously paid for the fiscal year, except that a regulatory cost charge may be prepaid, in part or in whole, at any time. NOW THEREFORE IT IS ORDERED that the operators listed in the Conclusion of this Order shall pay their respective regulatory cost charges as required by this Order. Wilson Commissioner Commissioner RECONSIDERATION AND APPEAL NOTICE As provided in AS 31.05.080(a), within 20 days after written notice of the entry of this order or decision, or such further time as the AOGCC grants for good cause shown, a person affected by it may file with the AOGCC an application for reconsideration of the matter determined by it. If the notice was mailed, then the period of time shall be 23 days. An application for reconsideration must set out the respect in which the order or decision is believed to be erroneous. The AOGCC shall grant or refuse the application for reconsideration in whole or in part within 10 days after it is filed. Failure to act on it within 10-days is a denial of reconsideration. If the AOGCC denies reconsideration, upon denial, this order or decision and the denial of reconsideration are FINAL and may be appealed to superior court. The appeal MUST be filed within 33 days after the date on which the AOGCC mails, OR 30 days if the AOGCC otherwise distributes, the order or decision denying reconsideration, UNLESS the denial is by inaction, in which case the appeal MUST be filed within 40 days after the date on which the application for reconsideration was filed. If the AOGCC grants an application for reconsideration, this order or decision does not become final. Rather, the order or decision on reconsideration will be the FINAL order or decision of the AOGCC, and it may be appealed to superior court. That appeal MUST be filed within 33 days after the date on which the AOGCC mails, OR 30 days if the AOGCC otherwise distributes, the order or decision on reconsideration. In computing a period of time above, the date of the event or default after which the designated period begins to run is not included in the period; the last day of the period is included, unless it falls on a weekend or state holiday, in which event the period runs until 5:00 p.m. on the next day that does not fall on a weekend or state holiday.
