State of Alaska, the attached order directs that the extended confidentiality decisions on the reports and information from these five wells be rescinded and the information be made available. Therefore, these extended confidentiality periods for the five aforementioned well reports and information are terminated, and the files may now be released to the public. Sincerely, John C. Said letter requested that the State release data pertinent to the following wells to Dan Donkel and Donkel Oil (collectively, “Donkel”) by December 17, 2021: Sourdough #3 Sourdough #2 Alaska State G-2 Staines River State #1 North Staines River #1 To date, no response to the undersigned’s December 3, 2021 request has been received. This letter requests that the State provide a copy of the above listed well data (hereinafter “the requested well data”) no later than April 15, 2022 or Donkel will take all appropriate action to compel the release of said information. A copy of that letter is attached hereto as Exhibit 1, and those arguments are fully incorporated by reference. To briefly address this issue, as you are aware, unleased land within a three-mile radius of the requested wells was made available in a January 2021 ANWR lease sale and the State held leases were previously offered for sale in earlier North Slope lease sales. All lease payments and bonuses related to the 2021 ANWR lease sale have been paid, and the leases have since been issued to the successful bidders. Since the unleased land within three miles of the requested wells has been made available for sale, there is no basis under AS 31.05.035 or 11 AAC 83.153(a) for the Department to fail to release the well log data within 90 days. Despite the fact that the lease sales occurred in January 2021, the Department has failed to release the requested well file data to date, despite the fact that more than 10 months have elapsed since the date of the January 2021 ANWR sale. It is Donkel’s position that the Department has no legal basis or factual basis to refuse to release the requested well file data in light of the foregoing. Accordingly, since DNR does not have any legal basis to refuse to release the requested well file data, Donkel reiterates that such information should be provided to him no later than April 15, 2022. To summarize this issue: 1. The Department is required to release confidential well file data within 90 days of the disposition of a lease; 2. The leases at issue were disposed of in the January 2021 ANWR sale; 3. The State collected payment for these lease sales from the successful bidders; 4. Despite such, the State has refused to release the requested well file data for over 10 months, despite having any legal basis to do so. Such decision is detrimental to Donkel, who is interested in potentially drilling a well in Tract 79, which is formally a part of the Alaska National Wildlife Refuge. The requested well file data is needed for Donkel to determine whether or not to move forward with drilling a well in Tract 79. Similarly, while pursuing these efforts, Donkel is also paying rental payments to the State of Alaska for 3,000 acres in the Alaska National Wildlife Refuge. As a result of the decision in 196 IBLA 155, an administrative law judge has ruled that only 1,500 acres are actually under the State’s jurisdiction. There is no question that Donkel has a vested interest in maximizing his investment in the 1,500 acres which remain in the State’s jurisdiction. There is no question that Donkel has an interest in the requested information in terms of his future developmental interests, which serve the best interests of both the State of Alaska and its residents. In light of the foregoing, Donkel respectfully requests that DNR provide a copy of the requested well file data no later than April 15, 2022. If the State fails to do so, Donkel will take all necessary and appropriate action to protect his interest. Donkel looks forward to the Department’s response. Please direct all further correspondence regarding the undersigned directly to me. I am writing to you in your capacity as the Commissioner of the Department of Natural Resources to request a copy of well log data relating to Point Thompson, which the Department of Natural Resources has not yet made publicly available. Specifically, Donkel seeks the release of the data pertaining to the following wells: Sourdough #3 Sourdough #2 Alaska State G-2 Staines River State #1 North Staines River #1 You are aware that DNR treated the well data pertaining to the above listed wells (hereinafter “the requested wells”) as confidential since there had not been a sale of the leases pertaining to the requested well file data, which are located within Point Thompson and the western Alaska National Wildlife Refuge border. Such data has remained confidential for a period of over 24 months because unleased lands existed within the three-mile radius which surrounds each of the wells. EXHIBIT 1 Page 1 of 4 Alaska Department of Natural Resources Alaska Oil and Gas Conservation Commission December 3, 2021 Page 2 1127 West 7th Avenue, Suite 200 Anchorage, Alaska 99501 T 907.276.1711 F 907.279.5358 www.bgbalaska.com The confidentiality of this information is governed by AS 31.05.035(c) and 11 AAC 83.153(a), which provide, in relevant part: The reports and information required in [AS 31.05.035](a) of this section that relate to an exploratory or stratigraphic test well and those portions of an application for a permit to drill an exploratory or stratigraphic test well that the commission determines contain proprietary engineering or geotechnical information shall be kept confidential for 24 months following the 30-day filing period unless the owner of the well gives written permission to release the application and reports and information at an earlier date. If the commissioner of natural resources finds that the required reports and information contain significant information relating to the valuation of unleased land in the same vicinity, the commissioner shall keep the reports and information confidential for a reasonable time after the disposition of all affected unleased land, unless the owner of the well gives written permission to release the reports and information at an earlier date. Well surface and bottom hole locations, well depth, well status, production data, and production reports required by the commission to be filed subsequent to the 30-day filing period shall be considered public information and may not be classified confidential. Production data, as used in this subsection, means volume, gravity and gas-oil ratio of all production of oil or gas after the well begins regular production.1 . . . If the commissioner finds that reports or information required under AS 31.05.035 (a) contain significant information relating to the valuation of unleased land within a three-mile radius of the well from which these reports or information were obtained, the commissioner will, upon the written request of the owner of the well, keep the reports or information confidential for a reasonable time not to exceed 90 days after disposal of the unleased land, unless the owner of the well gives written permission to release the reports and information at an earlier date. The commissioner will, in his or her discretion, extend confidentiality to reports or information required under AS 31.05.035 from a well located more than three miles from any unleased land if the owner of the well from which these reports or information are derived makes a sufficient showing that the reports or information contain significant information relating to the valuation of unleased land beyond the three-mile radius.2 As you are aware, unleased land within a three-mile radius of the requested wells was made available in a January 2021 ANWR lease sale and the State held leases were previously offered for sale in earlier North Slope lease sales. Despite the fact that the lease sales occurred in January 2021, the Department has failed to release the requested well file data to date, despite the fact that more than 10 months have elapsed since the date of the January 2021 ANWR sale. It is Donkel’s position that the Department has no legal basis or factual basis to refuse to release the requested well file data in light of the foregoing. This letter constitutes a formal demand that the Department provide data regarding the following wells to Donkel by December 17, 2021: Sourdough #3 Sourdough #2 Alaska State G-2 Staines River State #1 North Staines River #1 Since the Department does not have a legal basis to refuse to produce the requested well file data to Donkel, Donkel does not believe that he has any requirement to demonstrate why such information is of interest to him. However, to the extent that such information is reasonably necessary to demonstrate standing to address this issue, Donkel maintains an interest in leases which abut the Point Thompson Unit. The Department is well aware that well file information pertaining to the requested leases is relevant to Donkel’s exploration of his leasehold interests. Donkel has previously requested this information, individually, from Tom Stokes, Director of the Division of Oil and Gas. Mr. Stokes refused to produce the requested well file data to Donkel because, “While it is correct that a lease sale occurred, it is unclear if the bids will be honored and the leases are determined to be valid. Until that issue is resolved, the well data will be treated as confidential information.” The leases have been sold. The payments to the State have been made. There is no provision of Alaska law which permits the Department to forego its legal obligations to produce the well file data no later than 90 days after the sale of the leases. 11 AAC 83.153(a) requires the Department to release the confidential data with “90 days after the disposal of the unleased land.” The administrative provision does not provide any caveat that such “disposal,” must be affirmed by the Courts. The subject wells, and the leases pertaining thereto, were clearly disposed of, via lease sale, as set forth in 11 AAC 03. 100. There is no suggestion that the Department would engage in a lease sale which is violative of federal law or otherwise illegal. Clearly, the Department must view the lease sale as valid, since it collected lease payments for the leases, and upon information and belief, has not refunded these amounts to the successful bidders. Since the lease sales have been concluded for over 90 days, the Department must release the confidential well data information to Donkel in accordance with its obligations under the respective provisions of the Alaska Statutes and the Alaska Administrative Code. I explained that oversized materials in these files have not yet been scanned, and are not currently available through the website. However, each well file contains a listing of oversized documents not yet scanned. The last two wells, Staines River State 1 and Sourdough 2, have been granted extended confidential status by the Commissioner of DNR. The files for these two wells were the focus of today's review and discussion. Upon review, the team members decided to make the court aware of the existence of these seven well files, but because of their technical nature, opinion is that the files are not directly relevant to the current litigation. No files were numbered, nor were any copies made. I personally retrieved (with Howard Okland) all confidential materials from AOGCC's confidential well records room, supervised their handling at all times during the review, and then returned and secured (with Howard Okland) all records within the confidential room. Thomson. Once operations are completed on this well the rig and associated equipment will be transported by trucks along an ice constructed to the Sourdough #2 location. The rig will be reassembled over the well cellar and placed on the insulated panels that were used during the successful summer -over of the insulated ice pad at Yukon Gold. The intention is to keep the rig on location during the summer period if it is desired to keep the rig in the Pt. Thomson area for another winter exploration season. Drilling Operations: The ice pad will be constructed and a well cellar excavated before the rig arrives on location. If timing permits, the conductor hole will be pre -drilled and the 20" conductor set and cemented before the rig's arrival. Move in, rig up. Accept rig for operations. Nipple up diverter and function test same. Drill 16" hole to casing point. Full mudlogging facilities will be on location from spud to TD. Run and cement 13-3/8", 68# casing to surface. Perform cement top - job if no cement seen at surface on primary cementation Install blowout prevention/equipment consisting of 10,000 psi W.P. pipe rams, blind rams, and 5,OOOpsi annular preventer. The initial BOPE test of 10M equipment will be conducted to 10,OOOpsi; subsequent tests will be conducted to maximum surface pressure anticipated in the current hole section. - Maximum anticipated possible bottomhole pressure is 10,300 psi (15.5ppg EMW) at 12,820' TVDBRT. This information is based on offset well data and seismic -data interpretation. Maximum possible surface pressure is 9,050 psi based on a gas column to surface from 12820' TVDBRT. The transition from normal to abnormal pressure gradient is prognosed at approximately 9000'TVDBRT. Formation leak -off tests will be performed 10' below the 13-3/8" and 9-5/8" casing shoes. Directionally drill 12-1/4" hole to approx. 10,090'MD. Hole section TD is reached when the pressure transition zone is encountered and pore pressure is estimated at 10ppgEMW. Run logs. Run 9-5/8", 47 # NSCC casing string to within 10' of 12- 1/4" TD and cement with Class G cement. The annulus will be used for injection of waste fluids and freeze protected. Drill and core 8-1/2" hole to TD. Run logs. A decision to run 7" casing will be based on log information. If casing is run it will be cemented using Class G to above the 9-5/8" shoe. Log and core data will be used to determine whether any drill stem tests are performed. DSTs will be conducted with the rig on location and any fluids produced from the well will be re -injected back into the formation or down the 9- 5/8" x 13-3/8" annulus at the conclusion of well testing operations. Fluids and cuttings incidental to the drilling of a well will be transported for injection into the Prudhoe Bay CC-2A disposal well or injected on -site down the 13-3/8" x 9- 5/8" annulus once available. The well will be suspended or abandoned with the appropriate plugs and markers according to AOGCC regulations. The pad will be cleaned up of any surface debris. The nearest offest well is some three miles away, hence no close approach data is included in this package. Sourdough #2 Pore Pressure / Fracture Gradients Pore Pressure Seismic data in the vicinity of Sourdough #2 has been reviewed in conjunction with offset well records (mud logs, DST data, sonic logs and offset seismic). This analysis has provided a best estimate of the depth of the transition zone to overpressure and overpressures to be encountered. Normal pressure is expected down to around 9,500'TVDBRT. When the transition zone is drilled into and overpressure of +/- 10ppg EMW is encountered, 9-5/8" casing will be set due to limited kick tolerance considerations (dependent upon the fracture gradient encountered at the 13-3/8" casing shoe). Upon drill -out of the 9-5/8" casing, overpressure is expected to increase, until at TD of 12,820'TVDBRT a pore pressure of +/- 15.5ppg EMW is present. Fracture Gradient Information available from the Yukon Gold #1, E de K. Leff ingwell #1, Alaska State C-1 and other offset wells has been reviewed to provide a best estimate of fracture gradients to be expected. 13-3/8" casing point (4,500'TVDBRT) should provide a fracture gradient of 11.8 - 12.5 ppg EMW. This will be sufficient to drill to the planned TD of the 12-1/4" hole section at 10,000'TVDBRT. Fracture Gradient at the 9-5/8" shoe will be approximately 16-17ppg EMW, sufficient to drill to the planned TD of 12,820'TVDBRT. Kick tolerance monitoring and pore pressure determination techniques Kick tolerance volume will be continually updated as the well is in progress, incorporating the most up-to-date data available from the well. In accordance with Alaska State permitting requirements, the potential for shallow gas hazards, in the vicinity of the proposed well location and down to a vertical depth of 2000' below the surface, was reviewed. Analysis consisted of examination of seismic data near the well site (see Attachment 11) and looking for the the following effects: - anomalous high or low amplitude seismic reflectors - velocity pull downs or time delays along individual seismic reflectors - phase changes along otherwise continuous reflectors None of these effects were observed near the proposed location. Existing wells within the area do not show any shallow gas near the surface (< 2000 feet). The nearest offset wells are located 2 1/2 miles to the northwest (Staines River#1) and 6 1/2 miles southwest (Yukon Gold #1). No shallow gas shows have been observed at these locations. Sauve Subj: Geophysical Analysis for Overpressure in the Sourdough #2 area The Sourdough #2 well is currently planned to be drilled from a surface location, T09N, R24E, SEC 31, 3668 FNL, and 686 FEL. Velocity analyses of CDP seismic data in the vicinity of the Sourdough #2 well location were reviewed in an effort to determine formation pressure profile in the vicinity of the site of operations. This review was in accordance to State of Alaska permitting regulation 25.033, section E1. Attachment I plots seismic traveltime vs. depth based on DIX inversion of seismic CDP stacking velocities. Transit time (inverse velocity) vs. depth for the Sourdough#2 wellsite are displayed in Attachment II. Comparison of these displays with normally pressured shales for the Sourdough area, indicate a nominal depth of 9000' below seismic datum as the top of geopressure in the vicinity of the wellbore (equivalent to CDP 690 on seismic line BP93-33). Results are in agreement with observations of wells within the area and demonstrate moderate overpressure (negative gradient) within the target section, 9000' - 12,900' TVDss. Casing design and mud program allow for expected formation pressures. JAS
