The closure applications provided the required information describing the history of the reserve pit(s), the present condition of the reserve pits(s), results of any required water sampling and an assessment of the potential risks posed by the drilling waste to human health and the environment. ADEC coordinated field inspections and review of the closure plans with the appropriate land managers. ADEC has determined that the backfilled reserve pits at these sites do not present a material or probable risk to the public health or the environment. Public notice requesting comments on the closure requests was published February 21 and 22, 2002 in the Anchorage Daily News and posted on the state web site Febmary 21, 2002. No public comments objecting to closure approval were received in response to this public notice. ADEC has determined that the reserve pits at these sites meet the closure requirements of 18 AAC 60.440. Closure for the pad as a whole (if required) must be coordinated between the owner/operator and the appropriate land owner/manager. Any person who disagrees with any portion of this deCision may request an adjudicatory hearing in accordance with 18 AAC 15.200-310. The request should be mailed ito the Commissioner of the Department of Environmental Conservation, 555 Cordova Ave. Anchorage, AK 99501. If a hearing is not requested within thirty (30) days of the date of this letter, the right of appeal is waived. If an adjudicatory hearing is requested and granted, this decision remains in full effect during the adjudicatory process. The Pt. Mclntyre # 3 well lies approximately 2.9 miles from unleased land which is currently included as part of the State Lease Sale 65. Lease Sale 65 is currently scheduled for June 1991. Following your request for extended confidentiality, a review of the data was made by Division of Oil and Gas technical staff. Based upon the recommendation of division technical staff and under the depm'tmenta! delegation of authority, I agree to extend the confidentiality of the Pt. McIntyre Nos. 3DPN and 4, is confidential under AS 31.05.035 and accordingly cannot be turned over to us pursuant to AS 09.25.120(4). Apparently there has been some confusion. Although this information may be confidential to the public, it is not confidential to my clients, CFM Corporation, Cliff Burglin and Charles Hamel. That company and those individuals were limited partners in Exxon MBH-Alaska, Ltd. while geological testing, geological analysis and well drilling was being undertaken on the above-referenced wells. My clients have a legal and equitable interest in leases ADL 34622 and 34623 and oil production of the wells located thereon. Accordingly, I request, on behalf of my clients, all information which the Commission has received concerning those wells pursuant to the Commission's reporting requirements under AS 31.05.035(1) thru (3). Further, I request any and all other materials regarding development of the McIntyre oil field and the Gwyder Bay Unit, including without limitation all tests performed such as geophysical, chemical and paleontological tests, all maps, memoranda from all sources, information or knowledge concerning untapped formations such as, but not limited to, the Sadlerochit and Lisburne formations. My clients seek all information accumulated from the inception of exploration on the North Slope to and including all information from the 1990 drilling season whether complete or not, whether formal or informal. This reduction in size will increase the annular cementing space and should increase the chances of obtaining good cement bonding. Due to the close proximity of expected Kuparuk perforations the liner top can not be set at 9200' as originally planned, and approval is requested to move the top to 9295'. This results in a lap of only 112'. If we do not get a good test on the lap a production packer will be set at the top of the liner for isolaton. The well will be completed with a single selective completion with perforations open in both the K-5/K-10 and the Kuparuk zones. Mclntyre #3 Deepen Refraction Analysis Arco Alaska, Inc., requests an exception to the requirements of 20 AAC25.033(e)(1). The reason for this request is based on the drilling history of the immediate area. The two nearest offset wells are the Pt. Mclntyre State #1 and #2. At their bottomhole locations, the wells are 1.1 miles and 1.8 miles respectively, away from Pt. Mclntyre #3. Although there is slight abnormal pressure below the top of the Cretaceous, these two wells along with the Pt. Storkensen #1 and Gull Island #1, required a maximum mud weight of only 10.7 ppg to drill to the top of the Jurassic. Pt.
