Dear Mr. Skillern: We have reviewed the well files which contain recommendations for final location clearance for the following wells: Milne Point Unit N-01 (PTD 170-045) Plugged & Abandoned January 5, 1984 ~Milne Point Unit N-01A (PTD 184-006) Plugged & Abandoned January 18, 1984 Milne Point Unit N-01 B (PTD 184-013) Plugged & Abandoned March 29, 2002 We found field inspection reports in all of the above files recommending final location clearance. The reports show the locations to be in compliance with (20 MC 25.170 Onshore Location Clearance) and, therefore, the Commission requires no further work on the subject wells. However, BP Exploration Alaska Inc remains liable if any problems occur in the future with any of the wells. Final location clearance is hereby approved for the above listed wells. Since the actual pad was removed per the requirement of other agencies, any future actions not directly associated with the well will be under the direction of those agencies. The closure applications and corrective action plans provided the required information describing the history and conditions of the reserve pits( s), results of required water sampling, an assessment of the potential risks posed by the drilling waste to human health and the environment as well as proposed corrective actions. Corrective actions are completed at these sites. ADEC coordinated field inspections and review of the closure plans with the appropriate land and resource managers. At these three sites, the drilling waste was excavated from the reserve pit(s) and transported to a grind and injection facility for disposal. The excavated pits were backfilled with clean gravel. ADEC has determined that these sites present no material or probable risk to the public health or the environment. Public notice requesting comments on the closure requests was published March 7 and 8, 2003 in the Anchorage Daily News and posted on the state web site March 7, 2003. No public comments objecting to closure approval were received in response to this public notice. ADEC has determined that the reserve pits at these sites meet the closure requirements of 18 AAC 60.440. Closure for the pad as a whole (if required) must be coordinated between the owner/operator and the appropriate land owner/manager. Any person who disagrees with this decision may request an adjudicatory hearing in accordance with 18 AAC 15.195- 18 AAC 15.340 or an informal review by the Division Director in accordance with 18 AAC 15.185. Informal review requests must be delivered to the Division Director, 555 Cordova, Anchorage, Alaska, 99501 within 15 days of the permit decision. Adjudicatory hearing requests must be delivered to the Commissioner of the Department of Environmental Conservation, 410 Willoughby Avenue, Suite 303, Juneau, Alaska 99801, within 30 days of the permit decision. If a hearing is not requested within 30 days, the right to appeal is waived.
