This letter responds to your telephone call to me of
April 3 regarding the refund by the Alaska Department of Natural
Resources of the lease rentals you previously paid on the
referenced leases. During our conversation you expressed your
opinion that that refund was made in error because the leases may
be reinstated if you prevail in judicial proceedings you believe
are still pending before the superior court.
I have reviewed the court's and my files in this
matter. They confirm that the matter is not before the superior
court, and that the time for filing a judicial appeal has passed.
Under the now final commission order, there is no longer any
basis for supposing that further judicial action will revive the
leases.
The last judicial proceeding was Burglin v. Alaska 0il
and Gas Conservation Commission and Chevron U.S.A. Inc., case no.
3AN-82-9250 CI. The court's files sho¥,.that case was closed
after the matter was remanded to the oil and Gas Conservation
Commission ("commission") for an administrative hearing. Thus,
further judicial proceedings could only be initiated by filin~,a
formal Notice of Appeal with the clerk of superior court. AS"
31.05.080(b) and Appellate Rule 602. ~, ~..'
The December 16, 1985, decisions of the commission
following the administrative hearing on remand denied your
petitions for involuntary unitization and protection of
correlative rights for the l~ases at issue. In response to the
commission's decision, on January 6, 1986, you wrote a letter to
Superior Court Judge Shortell, addressed to the offices of the
commission. The commission responded to your letter on January
15, 1986. The response indicated that if your letter were
intended as an application for rehearing of the commission's

decision, the commission would deny it as it was neither timely
nor in compliance with the procedural requirements of AS
31.05.080. The commission provided Judge Shortell with a copy of
that correspo'~dence.
By ~etter dated February 13, 1986, and addressed
jointly to you and the commission, Judge Shortell advised the
parties that he believed neither your letter of January 6 nor the
commission's letter of January 15 presented issues to be
addressed by the superior court on review, and that either party
could initiate judicial review proceedings by applying under the
court's rules~·
In answer to Judge Shortell's correspondence, you wrote
him a second letter on February 17, 1986, advising him and, by
means of copies, Chevron and the State of Alaska, of your intent
to represent "the Burglin interests in civil proceedings Nos. 149
and 150." Numbers 149 and 150 are the case file numbers the
~commission assigned to your ~petitions in this matter.
Neither your January 6 nor your February 17, 1986,
correspondence initiated judicial review of the commission's
December 16, 1985, decisions. I advised the Department of
Natural Resources to refund the money previously paid the state
as rental for the leases after the time for filing an appeal had
passed, taking into account the possibility of your attempting to
file a late appeal. That time has also passed. Accordingly,
refund to you of past tendered rental payments on the terminated
leases was proper.

Gentlemen:
In regard to the above referenced regulations, your attention
is called to an attached list of wells which, according to our
records, have not received a final location inspection and
approval of clean up. In compliance with 20 AAC 25.170 Section
(a), "Within one year of suspension or abandonment of an on-
shore well", all clean up work is to be finished. Section (b)
provides the means for an extension of time if a valid reason
exists. Section (c) provides for on site inspection.
Consequently, we are presenting the following list of your
abandoned and/or suspended wells. Many of these are now more
than one year old and are not in compliance with regulations.
Others should have the final inspection completed this summer
while weather permits. This list covers the years 1975 to
date. There may be some earlier wells that also need inspec-
tion. If you have any earlier wells to be inspected this
summer please inform us.
Therefore, we are requesting a schedule from you for this
summer when our field inspectors can accompany your representa-
tives to these sites for the final clean up inspection.

As per your request, Ai and I met with Lonnic; Smith of t'he Divisi~)r,
of Oil and Gas to discuss cleanup requirements for your at)andor'~ed well
site in the Beluga field. Due to the lateness of the year, Hr. Smith
doubted that final site approval would be given until the snow cover
was gone in the spring. He also stated that the Division of Lands must
give their separate approval and suggested that we coordinate with Hr.
Ed Barber of that agency.
Recommendations are' 1) that we meet with the Division of I_ands
before starting the work to insure that we are aware of any special
requirements of that agency; 2) that the necessary site cleanup be
accomplished in the spring as soon as the snow cover is off, but before
the ground 's completely thawed; 3) that we coordinate with both the
Division of Oil and gas and the Division of Lands so that both agencies
inspect at the same time if possible.

January 22, 1977, the well is being plugged and abandoned as follows:
1. Cement plug set from ~360' - ~10'.
2. Cement plug set from 2672' $ 2772' with 50' inside of 9 - 5/8" casing and 50'
be~w:~9 - ~/8" casing.
3. Cement plug set from surface to 50'.
4. Top of casing to be welded shut.
5. Abandonment marker to be installed as per State regulations.
6. Location to be conditioned, for inspection. Operator will notify the State
when the final inspection can be made.

Cemented with 900 sacks of class G cement. Cut 9 5/8" casing and installed 900
series 3000 PSI double gate and hydril preventers on 9 5/8" casing. Tested BOPE to
3000 PSI. Wait on orders per Brinkerhoff Drilling Co. from December 13 to December 16
(labor problems). Shut down :rig and left caretaker on Vig from December 16 to 31.

Hond?y., December 13, 1976 - I. departed the office at 8:05 AM and
W-lnshlP Airlines' ak 9:45' AM~via Alaska Energy chartered Cessna 206 for
Beluga airstrip, arriving there at 10:05 AM. I was met at the airstrip
by Ray Wadley, drilling forem_ an, and we proceeded to Brinkerhoff
Rig #60 where I met Dick Hunt, tool pusher , who advised testing would ~
begin immediately. Testing would be done with Halliburton triplex rig
pumps using mud.
Testing began at 10:45 At4 with the hydril testing to 1500 psig. Pipe
rams and check valve on the kill line then tested to 3000 psig. Drillpipe
was then backed out of the test plug and blind rams tested to 3000 psig.
Nine valves and forty flanges in the choke manifold tested to 3000 psig.
However, one 3" W-K-M gate .valve downstream of the choke manifold in the
return line to the mud tanks galled and tests were suspended pending
replacement of this valve, r
While replacement was made,-I toured the location which was well organized,
rig in good repair, reserve Pit well built, well sign in place, and steel
w~lded fuel tanks not bermed. Accumulator pressure was 1600 and N2 backup
bottles tested 2300, 2200 and 2300 psig. Both primary and remote BOP
controls vmre actuated. Both manual adjustable chokes and the Swaco
superchoke were actuated to. fully opened and fully closed positions..
Testing resumed at 2:30 PM, but the replacement valve also galled and no
other valves were available.. Ray Wadley agreed this valve should be
replaced with a new one and. advised this would be done within 48 hours.
Also, the outside gate valve on the kill line was so positioned that the
handwheel could not be installed. I recommended the valve be reposttioned
vertically so the handwheel could~, be .utilized and Ray Wadley agreed that
this, too, would be accomplished within 48 hours. Both these stipulations
are noted on the field inspection., report with a request this office be
contacted by phone with the results.
Both wing valve on the kil1 lin~ and both wing valves on the choke line
then~sted to 3000 psig. A dart type floor valve was on. the floor.
Tests were concluded at 5:50 PM and a field inspection report prepared with
the original given to Ray Wadley, a copy mailed to Yank Sumptner, and a
copy attached to this report.

Please be advised of ottr intention to m~intain a straight hole while
drilling the subject test by using the necessary bottom-hole assembly.
Non-magnetic collars will be used in order to conduct single-shot
surveys giving both inclination and azimuth.
This will prevent the bottom-hole location as well as the well bore
throughout any potential pay zone from being closer than 1,500 feet
from an adjacent property line. Such deviation is permitted by

Dear Mr. Vailee:
Enclosed please find one copy of Sundry Notice Form IO-403 relating to
the BW X33-12 well approving your proposed casing cementing and BOP
program which represents a change from the original permit to drill ap-
proved by this office on December 9, 1975. We will need a Designation
of Operator Form which will clarify the situation that Alaska Energy
is drilling a well but Clifford Burglin is the apparent lessee of ADL
58822 as indicated on your. Sundry Notice Form. Please note that the
following stipulations apply to your drilling operation:
i. Inside surface of the diked fuel storage area at the drill
site must be impermeable.
2. The surface location of this well is located 15OO feet from the
south property line which is also the minimum distance that the
bottom hole-location or pay open to the well bore may be to
the property line for a gas well. As a result of this mini-
.mum distance location, surveys will be required to establish
the location of the well bore. Directional surveys giving both
inclination and azimuth shall be obtained at intervals not
exceeding 500 feet. A composite directional survey from sur-
face to total depth shall be fi led wi th the Director of the
Division of Oil and Gas Conservation.
We would also appreciate clarification of whom Mr. Burglin's local rep-
resentative is. You have signed the Sundry Notice as his agent but the
operator's address was given as Box 131, Fairbanks, Alaska 99707. We
also notice some confusion on the Sundry Notice Form as to whether or
not Alaska Energy is the operator. Please clarify this matter by letter

Gentlemen:
Mr. Clifford Burglin on behalf of.himself and others, plans
to conduct drilling operations north of the Beluga River Unit
area this year. In order to carry out and provide logistical
support for the proposed operations, it is necessary for us
to obtain your approval of our Plan of Operation. Our original
Plan of Operation for Drilling was submitted in October 22, 1975
and approved by your office on December 3, 1975.
We are, therefore, enclosing a Modified Plan of Operations for
this project, modifications being with the particular Drilling
Rig to be used, the size fuel dump to be established, sanitation
facilities and water wells. Your early approval of these
modivieations will be appreciated.
If you have need for further clarification, please detail these,
and we will attempt to provide answers to you.

PLAN OF OPERATIONS

1. Well Site and Setting
The proposed location for well B.W. X33-12 is approximately
1500' North and 2050' West of the SE corner of Section 12,
T13N.,R10W.,S.M. A new permanent gravel pad will have to
be constructed at the proposed site. About 2' to 3' of
tundra covers the underlying gravel, and this will be
cleared in the area of the site including the mud.waste pit.
Excavation material from the pit will be used for a portion
of the location gravel. Additional gravel will be needed
for the pad and will be needed to build approximately 500' of
new road and upgrading of an old road from an existing road.
This gravel will be removed from a borrow pit presently de-
veloped on the lease with'the approval of the State of Alaska,
Division of Lands. It is estimated that a total of 8,000 cubic
yards of new gravel will be required for pad and road const-
ruction. Application for gravel permits have been submitted.
The propoSed access road will be constructed on an existing
tote road to within a short distance of the proposed pad.
The remaining road will be cleared to approximately 40' wide
to permit road construction. The drill site is located in
a forested area. Cleared trees and brush will be stock
piled and dispos4 of in the sump at the time of cleanup.
2.. Existing Roads and Airstrip
A11 existing roads in this area from the Superior Landing
to the south to the Beluga River Bridge to the north were
built in the 1962-1965 era by Standard Oil Company of
California as operator for the Beluga River Unit as well
as during the course of other exploratory activity. The
proposed 500' access road to the proposed BW X33-12 location
will be a spur road from one built in 1965.
The Beluga River Airstrip will be used in support of the
proposed drilling operations at BW X33-12.
3. Water Supply
Water required for drilling will be pumped from the Beluga
River or local lakes, or alternately from a well site.

4. Drilling Rig
We plan to use the Brinkerhoff Drilling Co. Rig No. 60, to
drill the proposed well. We anticipate' moving to BW X33-12
during the first half of November from its stacked location
at Kenai.
5. Access to Site and MethOd O'f.~Su:pply
The site is remote and is not connected to the Anchorage area
by road. The only access is by ~one or more of the following
methods:
A. BARGING TO THE 'SUPERIOR.' LANUING ~('ST~TE RE'SERVED AREA)
During most of the year, barging is possible from Kenai
orAnchorage area to the Superior Landing and thence
by truck to the proposed wellsite. Use of this landing
will definitely be required to drill the proposed well.
Most of the materials and supplies required to drill
this well will have to be barged to the Superior Landing.
B. AIR TRANSPORT TO BELUC4~IRSTRIP
The Beluga Airstrip can handle up to Hercules-type air-
craft, and we intend using this method to move freight
and other items as can be justified economically, in
addition to barging.
Since the rig uses Diesel riel, we will probably fly
in the fuel. Sufficient hard tankage is available to
eliminate consideration of "bladder tanks". The rig
location will be graded so that any fuel leakage will be
conducted to the waste pit.
A 20,000 gallon fuel dump is established at the Drilling
site. These tanks will be installed in a diked area which
will contain any fuel spillage or leakage.
6. Personnel S.upport
The camp is capable of housing and feeding approximately
40 men and is installed in an area adjacent to the proposed
drill site and will be our base of operations. Personnel will
be flown in and out on a scheduled basis of approximately
14 days working and 7 days off. Food and other supplies will
be flown in on art'"as needed' basis.
Sanitation facilities for the camp, will be in approval of the
Anchorage Office of the Department of Environmental Conservation.
A water w~ll will be drilled and biologically tested.

In addition to the camp, a house trailer may be available on
site or barged in for Supervisory personnel.
7. Miscellaneous Related..Drill'.in~'..' Items
ao
The waste pit will be lined with an impervious membrane
and diked as necessary to prevent the possibility of
any seepage to the surrounding terrain or drainages.
Upon completion of the drilling activities, the waste
pit will be filled, leveled, and the area rehabilitated
as necessary.

The proposed location is approximately 800' from the
Beluga River and 300' from the bluff overlooking the
river. Our proposed drilling operations should cause
minimal disturbance in this area.
8. Well BW X33-12 is an exploratory location, and commercial
production may be encountered. There is no immediate
market for the oil or gas volumes expected. A merketing
plan will be programmed, should tSe well prove productive.
Accordingly, production facilities may not be immediately
installed. When they are installed, the production, dehy-
dration, and metering facilities on-site will be of a type
approved and probably similar to those already installed for
the existing producers in the area. The existing gas
gathering system may be extended northward in the future.

9. General Comments

Surface disturbance will be kept to a minimum, and no
unnecessary surface digging will be allowed. In the
past construction sites have been restored and measures
taken to encourage native vegetation within the area.
Regrowth in the Beluga Area is rapid and does not
appear from past experience to require much help except
for the use of fertilizer.
B~
Solid wastes such as mud sacks, kitchen waste, etc., will
be hauled to the burn pit on location, burned and buried,
while other hard wastes, such as drilling bits, etc.,
will be disposed of in the waste pit when it is closed
and covered after drilling is finished.

PLAN OF OP'ERATIONS
BURGLIN WELL X33-12
BELUGA RIVER AREA, ALASKA
.1. Well Site and Setting
The proposed location for well B.W. X33-12 is approximately
1500' north and 2050' west of the SE corner of Section 12,
T13N, R1OW, S.M.. A new permanent gravel pad will have to
be constructed at the proposed site. About 2' to 3' of
tundra covers the underlying gravel, and this will be
cleared in the area of the site including the mud waste
pit. Excavation material from the pit will be used for a
portion of the location gravel. Additional gravel will~L~e
needed for the pad and will be needed to build approximately
500' of new road and upgrading of an old road from an. exist-
ing road. This gravel will be removed from a borrow pit
Presently developed on the lease with the approval of the
State of Alaska, Divison of Lands. It is estimated that a
total of 8,000 cubic yards of new gravel will be required
for pad and road construction. Application for gravel
permits will be submitted in the near future.
The proposed access road will be constructed on an exist-
ing tote road to within a short distance of the proposed
pad. The remaining road will be cleared to approximately.
40' wide to permit road construction. The drill site is
located in a forested area. Cleared trees and brush will
be stock piled and disposed of in the sump at the time of
cleanup.
2. Existing Roads and Airstrip.
All existing roads in this area from the Superior Landing
to the south to the Beluga River Bridge to the north were
built in the 1962-1965 era by Standard Oil Company of
California as operator for the Beluga River Unit as Well
as during the course of other exploratory activity.. The
proposed 500' access road to the proposed BW X33-12
location will be a spur road from one built in 1965.
The Beluga River Airstrip will be used in support of the
proposed drilling operations at BW X33-12.
3. Water Supply
Water require~I for drilling will be pumped from the 'Beluga
River or local lakes, or alternately from a well site.

4. Drilling Rig
We plan to use the Kenai Drilling Company Rig No.1, to
drill the proposed well. We anticipa'te moving to BW
X33-12 during the first half of November from its
stacked location at the Beluga River airstrip.
5. Access to Site and Method of Supply
The site is remote and is not connected to the Anchorage
area by road. The only access is by one or more of the
following methods:
A. BARGING TO THE SUPERIOR LANDING (STATE RESERVED AREA)
During most of the year, barging is possible from Kenai
or Anchorage area to the Superior Landing and thence
by truck to the proposed wellsite. Use of this landing
will definitely be required to drill the proposed well.
Most of the materials and supplies required to drill
this well will have to be barged' to the Superior Landing.
B. AIR TRANSPORT TO BELUGA AIRSTRIP
The Beluga Airstrip can handle up to Hercules-type air-
craft, and we i~'tend using this method to move freight
and other items as can be justified economically, in
addition to barging.
Since the rig uses Diesel fuel, we will probably fly
in the fuel. Sufficient hard tankage is available to
eliminate consideration of "bladder tanks". The rig
location will be graded so that any fuel leakage will be
conducted to the.-waste pit.
A 50,000 gallon fuel dump is established at the Beluga
Airstrip at the same location as existing faciliti.es..
These tanks are installed in a diked area which will
contain any fuel spillage or leakage.
6. Personnel Support
The camp is capable of housing and feeding approximately
40 men and is installed in an area adjacent to the existing
airstrip and will be our base of operations. Personnel will
be flown in and out on a scheduled basis of approximately
10 days working and 5 days off. Food and other supplies
will be flown in on and "as needed" basis.
Sanitation facilities for the camp, consisting of a septic
tank and two leach pits, are in use with the approval of
the Anchorage Office of the Department of Environmental
Conservation. A water well, drilled and biologically tested
during 1974, is in use at the camp.

Gentlemen:
Mr. Clifford Burglin on behalf of himself and others, pla~s
to conduct drilling operations north of the Beluga River Unit
area this year. In order to carry out and provide logistical
support for the proposed operations, it is necessary for us
to obtain your approval of our Plan of Operations.
Accordingly, we are enclosing our Plan of Operations for this
project. The items covered by the plan should answer any
questions requarding surface operations. If you have need for
further clarification, please detail these, and we will attempt
to provide answers.
Constrution and drilling equipment is available in the Beluga
River area, and the ground should be frozen in the area of the
proposed construction. The proposed well site and access road
are on high ground and should support heavy construction
equipment. It is most important that we start work in the near
future as the~!~is committed to another job in January.
For this reason we respectfully request early approval of
our Plan of Operations.
