Subsequently, effective December 1, 2000, CIRI sold all its oil, gas and associated substances in the above subject lands to Marathon Alaska Production LLC. On February 01, 2013, BLM approved the 100% Record Title Interest transfer in the above subject lands from Marathon Alaska Production LLC to Hilcorp Alaska, LLC (Hilcorp). The lands listed below have been removed and segregated out of federal lease A028056 into a new lease, AA093821 according to the Conformity to Survey Decision dated February 23, 2010. Hilcorp is the 100% owner of the oil, gas, and associated substances of lease AA093821. The BLM no longer administers leases if the federal mineral interest is less that 100%. Therefore, as of the date of this decision, the administration of lease AA093821 is hereby waived and transferred to Hilcorp. Lands segregated from A028056 into AA093821, Administration Waived to Hilcorn Alaska, LLC Township 5 North, Range 11 West, Seward Meridian, Alaska Section 28: SE4 Section 29: SW4NW4 containing 200.00 acres 2 The BLM maintains 13.969% interest in the Kenai Unit and will continue to administer the unit and associated participating areas (PA). Hilcorp, as lessee and operator, must continue to report all production from wells associated with lease AA093821, listed in the attached Appendix 1, to the Office of Natural Resource Revenue (ONRR), as allocated for each PA. Hilcorp is also required to provide courtesy copies of the following to the BLM: • Permits to Drill, approved by the Alaska Oil and Gas Conservation Commission (AOGCC), for any new well drilled on lease AA093821; • All Well Completion/Recompletion Reports; • All notifications of well shut-in/resumption of production for wells associated with lease AA093821. As of the date of this Decision and the Waiver of Administration of lease AA093821, Hilcorp assumes any and all liabilities and obligations that may be outstanding for: • The proper plug and abandonment of all existing wells; • Reclamation of the lease area; • Restoration of any lands or surface waters adversely affected by lease operations after the abandonment or cessation of oil and gas operations on the lease. This decision may be appealed to the Interior Board of Land Appeals, Office of the Secretary, in accordance with the regulations contained in the enclosed 43 CFR, Part 4 and Form 1842-1. If an appeal is taken, the notice of appeal must be filed in this office (at the above address) within 30 days from receipt of this decision. The appellant has the burden of showing that the decision appealed from is in error. Failure to file the notice of appeal with the Bureau of Land Management within the time allowed will result in dismissal of the appeal. In order to avoid dismissal of the appeal, there must be strict compliance with the regulations. As indicated in the table, Marathon anticipates a measured program of P&A activities, averaging three -to -five well abandonments per year. Marathon has already begun such a program with its offshore wells, beginning with the Spark Platform wells in 2009. All of the onshore wells on the list are within active oil and gas leases that are regularly visited and inspected. Marathon anticipates updating plans for its inactive wells in the appropriate annual Plan of Development for each property. Any and all forward activities are subject to funding approval. Please also note that your June 22 letter erroneously referenced "KU 41-08". We believe that your June 22 letter reference to well "KU 41-08" was a typo and is intended to refer to Well KU 41-18.
