Williams DATE , May 16, 1963 SUBJECT: ~ Am - l~jonek St,~te No. 1 Re Simasko's letter of May 13 forwarded by Bakke's memo of May 14, Phil and I are not in agreement on what is meant by the next to last sentence. Phil thinks it only means that Interior is saying that the well bottoms under Indian lands because of their claim that the tidelands are Indian lands, To me, the wording sounds as if they are saying that the well is not deviated as reported and is bottomed under land above the high tide line rather than below. I seem to recall ~..m~y that you reported to me Quite some time ago that Soyster questioned that Pan Am was giving us the straight dope on the deviation--or it might have been Don Bruce. Do you recall anything on this? Any other thoughts you may have will be appreciated. I hope I am wrong and that there is nothing to worry about as far as the directional drilling is concerned. We ha,e been advised by our Washington attorney that the Department of l~ter~er Is taking the position that the State of Alaska has no authority to lease tidelands adjacent to the Moquawkie Indian Reserve and that State of Alaska leases issued for tidelands (between the line of mean high tide and the line of ~ean iow tide) and adjacent to the Moquawkie Reserve are invalid. The Department contends that in his letter of non-objection to the State of .Alaska for the leasing of tide and ~ubmerged lands north ef the ~aat amd West Forelands, Secretary Udall specifically excepted the rights of the ~atives of the Village of Tyonek with respect to the use and oceupaney of the tidelands in question. The Department of the Interior has intimated that the direction- ally drilled Tyonek State No. 1 well didn't bottom in the adJaeent Brats · Alaska lease but, in fact, bottomed under Indian lands. In order that w~ may assure ourselves of our rights in the area, we ask that you invest!gate this situation and render an opinion with regard to the State of Alaska~ right to lease tidelands adjacent to the Moquawkie Reserve up to the ~i?~ ~eam high tide.
