Texaco Inc. submitted a request dated August 23, 1968, for a Conservation Order which would permit the sale of gas from either Nicolai Creek Unit well #1 or #2 or both wells. 2. Conservation Order #28, dated August 23, 1966, stipulates that a field spacing order providing for the allocation of production must be issued before prodUction from either Nicolai Creek Unit well #1 or #2 can be sold. 3. Subsequently, the Nicolai Creek Unit Agreement was approved by the State of Alaska on March 15, 1968, and by the United States Geological Survey on April 2, 1968. 4. The geology of the area indicated that two participating areas be designated and one of these areas, Participating Area "A," includes the Nicolai Creek Unit wells #1 and #2. 5. The terms of the Nicolai Creek Unit Agreement provide that production from either the #1 and #2 Nicolai Creek Unit well or both wells will be allocated to the entire Participating Area "A." 6. Notice of the hearing on the request was published in the Anchorage Daily News on August 27, 1968, pursuant to Section 31.05.050 of the Alaska Statutes as amended by Chapter 190 of the 1968 Legislature of the State of Alaska, but no protest was received. AND IT FURTHER APPEARING THAT the production from the Nicolai Creek Unit #1 well and the Nicolai Creek Unit #2 well has been effectively allocated by the terms of the Nicolai Creek Unit Agreement, and the field spacing order required by Conservation Order #28 is no longer necessary. Notice is hereby given that Texaco, Inc., has requested the Oil and Gas Conservation Committee to issue an order, as provided in Section 31.05.030 of the Alaska Statutes and in compliance with Conservation Order #28, amending Conservation Order #28 and permitting the sale of gas from the #1 and #2 Nicolai Creek State wells, located in the Nicolai Creek Unit. Parties who may be aggrieved if the requested order is issued are allowed thirty days from the date of this publication in which to file a protest and a request for a hearing. If such a protest is timely filed, a hearing on the matter will be held at the above address at 9:30 a.m., September 27, 1968, at which time protestants and others may be heard. Marshall, Executive Sec. Alaska Oil & Gas Conservation Committee Division of Mines & Minerals 3001 Porcupine Drive Anchorage, Alaska Dear Mr. Marshall: Texaco Inc., as operator of the Nicolai Creek Unit Well ~2, was granted a spacing exception to Section 2061.2 of the Alaska Oil & Gas Conservation Regulation, by Conser- vation Order f'.~28, dated August 23, 1966. The order provided that gas sold from either Unit Wells ~1 or ~2, or both, shall be allocated in a manner approved 'by the Conservation Committee. Since both unit Wells f~.t and .$~'2 are now within the approved Nicolai Creek Unit, and more particularly located within the recently approved Nicolai Creek Participating Area A, the matter of allocation of production from either or both wells has 'been resolved. Texaco contemplates the sale of gas from Unit Participating Area A during the latter part of September, 1968.
