The Pan American Petroleum Corporation petitioned the Alaska 0~ and Gas Conservation Committee for the referenced order on February 2, 1970. 2. A notice of the hearing was published in the Anchorage Daily News on February II, 1970, pursuant to Title II, Alaska Administrative Code, Section 2009. 3. A public hearing on this matter was held February 26, 1970, in the Ben Crawford Memorial Building, Anchorage, Alaska, at which time the applicant and others were heard. AND IT FURTHER APPEARING THAT Pan American Petroleum Corporation is an owner of lands within or adjacent to the pools defined in Conservation Order Nos. 83-A, 83-B, and 83-C and may be affected by said orders. AND IT FURTHER APPEARING THAT there is evidence in the record of the November 13 and 14, 1969, hearing to support Finding No. 5 of Conservation Order No. 83-B and Finding No. 6 of Conservation Order No. 83-C and Rule 2 of both orders. AND ~T FURTHER APPEARING THAT the Committee considered only the evidence in the record of the November 13 and 14, 1969, hearing in establishing the findings and rules of Conservation Order Nos. 83-A, 83-B, and 83-C. CONSERVATION ORDER NO. 88 Page 2 March 25, 1970 AND IT FURTHER APPEARING THAT the applicant's request to substitute the following words in Conservation Order Nos. 83-A, 83-B, and 83-C, "It is further ordered that the pool limits and well spacing hereby established may be changed or may be made permanent with or without change upon the application of any owner of lands within the pool, after notice and hearing as required by law, and based on the evidence produced at said hearing." is unnecessary because Title II, Alaska Administrative Code, Section 2004, states, "Upon request of the Committee or any interested party at any time after the discovery of oil or gas in a pool, a hearing shall be held and the Committee shall issue an order based upon the evidence p. resented prescribing any necessary field rules for the development of the pool." (emphasis supplied) AND IT FURTHER APPEARING THAT the automatic termination provision of Conservation Order Nos. 83-A and 83-B was supported by statements at the November 13 and 14, 1969, hearing that the orders should not be effective for a prolonged period of time and the orders written can be terminated after public hearing or extended by the Committee. NOW, THEREFORE, iT IS ORDERED THAT Pan American Petroleum Corporation's request for amendment of Conservation Order Nos 83-A, 83-B, and 83-C is denied. Pennzoil United~ Inc. very much appreciates the tremendous amount of research and diligent work ~.one in this regard by both the Alaska Oil and Gas Conservation Committee and the several o~erators. Pennzoil Un. ited~ Inc. feels that suffi~'e cz ~nt data has not been presented to the Committee or the industry to reach a present determination as to the optimum area which can be economically and efficiently drained by one 'well. It does appear that initial well spacing of one well to 640 acres will result in early definition of the areal extent of the field which Alaska Oil and Gas Conservation Committee February 26, 1970 Page 2 in turn will result in accumulation of data u~on which a more refined and equitable order establishing well spacing could be based. At the same time such spacin~ will not interfere with proper development of the field while protectin.~ correlative rights of the lessees in the field. Pennzoil also strongly feels that orders for all pools in the subject area be expressly recognized as temporary until adequate geological and engineering data upon which rules can be based are presented to the Committee. In support of its request for reconsideration, Pan American Petroleum Corporation states: 1. It is the owner, as defined by statute of lands within, or immediately adjacent to each of the pools defined in Conservation Orders 83-A, 83-B and 83-C, and its property rights as such owner will be affected by said order. - 2 - 2. There is no evidence in the record to support finding No. 5 of Conservation Order No. 83-B or finding No. 6 of Conservation Order No. 83-C. 3. Said findings do not support Rule 2 of Order No, 83-B and 83-C. Neither finding establishes 640 acres as the area which can reasonably be expected to be efficiently and economically drained by one well, 4~ If the available evidence now held in confidential status were produced, it could not at the present stage of development in either pool establish pool limits, nor could such evidence establish pressure communication between wells or the area which could efficiently and economically be drained by one well. 52 Neither the findings objected to nor any evidence based on information now held in confidential status are necessary in order to support Rule 2 of Conservation Orders No. 83-B or 83-C. 6, There is sufficient evidence in the record to support the finding proposed in this request for reconsideration and amendment, and said finding is sufficient to support Rule 2 of both Conservation Orders 83-B and 83-C, 7. The findings in Conservation Order 83-A are sufficient to support said Order.. 8. If the requested change in findings is made in Conservation Order 83-B and 83-C, Conservation Orders 83-A, 83-B, and 83-C should remain in effect for an indefinite period, since if changes are later found to be necessary the period of time which may elapse before the information necessary to support the change will be accumulated is uncertain, and. will probably be_ different in each pool. ~.L~~ FEB - 3 - 9. At such time as an application is filed requesting-an order changing the pool limits or establishing permanent well spacing based upon comprehensive geological and engineering evidence the Committee, after notice and hearing can then determine whether the pool limits or well spacing or both, as established by each individual Conservation Order should be amended, enlarged, diminished, or made permanent with or without change. 10~ The record contains competent evidence to support those rules and provisions of Orders 83-A, 83-B, and 83-C not concerned with definition of pool limits or with well spacing, and such rules and provisions should remain in effect until there is competent evidence showing a need for a change therein.
