Exploration Services Company, Inc. submitted an application dated February 7, 1973 requesting the referenced order. 2. A notice of public hearing was published in the Anchorage Daily News on February 17, 1973 pursuant to Title 11, Alaska Administrative Code, Secti~on 2009. 3. A public hearing was held on February 28, 1973 in the City Council Chambers of Z. J. Loussac Library, 5 th Avenue and F Street, Anchorage Alaska at which time the applicant and others were heard. The record of Conservation Order No. 116 was made part of the record of this hearing. Conservation Order 121 ~ Page 2 March 20, 1973 FINDINGS: 1. Referenced locations 10, ll, 12 and 13 were approved by Conservation Order No. 116. 2. The applicant proposes to drill the referenced stratigraphic tests on unleased State of Alaska lands at an estimated cost of five million dollars. 3. Lease sales are not anticipated in the area near the referenced locations within the foreseeable future. 4. Under terms of Miscellaneous Land Use Permit to be issued by the Alaska Division of Lands the State of Alaska will be provided with all well information at the time the operations are completed. Conditions under which the data will be released will be specified in the permit. 5'. Participation in the program will be open to all companies and individuals and will be well publicized. 6. Approximately 20 companies or individuals are expected to participate. 7. The companies and individuals would not have an opportunity to benefit from their investment in this project if geological well information were filed and released two years after the date of filing pursuant to Title il, Alaska Adminis- trative Code, Section 2008. 8. Provisions will be made for late participation by payment of proportionate share plus a penalty. 9. Geophysical information will be utilized to locate the wells off-structure to minimize accidental discovery of hydrocarbons. 10. Applicant will furnish an adequate bond and tt~e requested program will be carried out in conformance with conditions of the individual well permit and the oil and gas conservation regulations. ll. The program will provide the state free of charge with valuable geological data useful in making regional geological interpretations. CONSLUSION: It is in the best interest of tile State of Alas~ka to allow the requested exceptions. THEREFORE, IT IS ORDERED THAT: Rule 1. For the referenced locations the operator is relieved from the requirements of the following subsections of Title ~l, Alaska Administrative Code, Section 2008: a(3), b, c and d (except that form 10-407, Well Completion or Recompletion Report and Log, without geological information, is required). This Is a public hearing of the Alaska 011 and Gas Conservatlon Committee, Conservation File #121, an additlonal appllcatlon of Exploratlon Service Company, Inc., for an excep- tion to Title II, Alaska Admlnlstratlve Code, Section 2008, for stratigraphic tests to be drilled on unleased State submerged lands. The applicant's application was published February 17, 1973 In the Anchorage Dally News, and It provides for a revision of four locations previously approved by the 011 and Gas Conservatlon Committee by Order No. 116, and it also requests flve new locations, all of which appeared In a notice. They're all Indicated on the map on the wall. My name ls Homer Burrell, I'm Chairman of the Committee. To my right is Tom Marshall, Excutlve Secretary and member of the Committee, and to my left Is Mr. O. K. Gllbreth, who is a member of the Commlttee. Is the app I I cant ready to testl fy? Mr. Osborn: Yes. Mr. Burrell: Would you please step forward and identify yourself? Please address the chair, Mr. Osborn. Mr. Marshall.will want to swear you in, sir. Mr. Marshall: Please raise your right hand. In the matter now at hearing do you swear to tell the truth, the whole truth and nothing but the truth so help you God? Mr~ Osborn: Yes I do. Mr. Marshall: You may be seated. Thank you. Mr. Burrell: Would you please Identify yourself for the record? Mr. Osborn: B.C. Osborn, President, Exploration Services Company. Mr. Burrell: Mr. Osborn, do you have any prepared remarks or? Mr. Osborn: Might start off by stating that these additional loca- tions that we have requested are to al Iow us certain flexlbillty in the event that some of the previously requested and approved locations are unfeasible to drill in this program. We've also made certaln refinements on the basis of additional Information supplied by some of the interested participants, which necessitated revising some of the locations. We have also, as the program has developed, developed our priorities and the exact or more exact areas In which we hope to be able to drill these holes. J think that is our primary reason. We do need the back-up in the event that the seismic Information that we have obtained prior to the actual drilllng operations Indicates that any one location is unsafe In any way shape or form, from the standpoint of the poi lutlon, water depth, or operations. We have taken in consideration weather conditions and all of the factors that go Into making up a safe and efficient operation of this type. That's about all ! have to say with respect to the generalities of the Iocatlon of the project itself. Now the Individual locations have been selected by a majority of the companies Interested in participating in the project. And i have really nothing to say specifically about any one of the Jocatlons. Mr. Burrell: Thank you Mr. Osborn. ~s that all the testimony you have? Mr. Osborn: Yes. Mr. Burrel I: We' II have a very few questions for you. Would you have any objection If the record of Conservation Fl ~e No. 116 were -2- Incorporated Into the record of this hearing? Mr. Osborn: No, i wish that it were incorporated. Mr. Burrell' Unless there is an objection, we'll incorporate it In because there Is considerable testimony In that hearing as to the methods and techniques that you propose to use. Are you faml lar with that order, Mr. Osborn? There are some ten findings In that order, relating to where you propose to drill, estimated cost, benefit to those who would partlclpate In the program if the information Is not fi led pursuant to Section 2008 of the 011 and Gas Conservation Regulations, the fact that lease sales are not antlclpated In any of the areas within the foreseeable future, the detai ~s of the mlscel laneous land use permit and the broad terms of the miscellaneous land use permit, which you're supposed to get from the Division of Lands, the fact the invltatlon to participate wl~l be solicited from all companies and Indlvlduals, the number that may participate, late participation penalty, the use of geophysical Information to minlmlze drilling on structure, bond in compliance with the Oil and Gas Conservation Regulations, and the fact that the information will be made available to the State free. Are all these true, al~ these ten findings true with respect to the locations you've requested in this hearing? Mr. Osborn: Yes, as far as ~ can determine, you might update finding No. I, In that the estimated cost of the program at the present time Is 5 ml I I lon dollars. Mr. Burrell: Alright, as far as you know the rest are al~ true, the rest of those flndlngs In respect to these locations? Mr. Osborn: Yes, that is true. Mr. Burre~l: Except number one? Mr. Osborn: Except number one. -3- Mr. Burrell: I have one other question. You requested all locations be subject to further minor change after acquisition of additional geophy- sical and bathymetry data. What does minor mean, one mile, one hundred mi les or do you have any idea? Mr. Osborn: It's difficult to say. I think we're looking at within a mile, on the average. If the information we obtain indicates that it is not feasible to drlll a test hole within, well I'd say at least ~vo to three miles, then that location would probably be disregarded or left out of the program and we'd move on to one of the alternate Iocatlons. Mr. Burrell: Would you say three mi les would be adequate administrative discretion for, any.'of the:agencies involved? Mr. Osborn: With one possible exception, yes. Mr. Burrell: Yes, how far would It be in the case of that possible except I on? Mr. Osborn: Nine miles. Mr. Burrell: Nine miles. Ten mi les I'm sure would be adequate for all? Mr. Osborn: Yes, ten mi les would be adequate for all locations. Mr. Burrell: Do you have permits from the Corps of Englneers which restrict you more than that, or are you pretty loose in your application wi th them? Mr. Osborn: The Corps of Engineers permits, we have updated some of the locations as we are updating them with our request for this hearing. There Is some flexibility with the Corps of Engineers, but we would prefer to change our locations with them inasmuch as they are notifying or you might say, protecting the navlgatlonal aspects of the area, so that they -4- will need an exact Iocatlon prior to the initiation of drilling operations in order to notify all of the appropr|ate agencles as to the vessel being located there for that period of time. Mr. Burrell: Well, i've noticed that you Intend to provide an exact location ten days before you start? Mr. Osborn: Yes, very deflnltelyo Mr. Burrell~' To us, also? Mr. Osborn~ Yes, to all agencies we will. Mr. Burrell: I have no further questions of Mr. Osborn. Mr. Marshall do you have any questions? Mr. Marshal l~ Yes, Mr. Osborn, when do you feel that your program will actually start now? Do you have any firm date on, what's your ideal date to start the program? Mr~ Osborn.· We're still shooting for May 15, and no later than June I. Mr. Marshali~ May 15. Mr. Osborn: Our problem still, at the present time, Is the avallablllty of drilling vessel. Mr. Marshall: Yes. Finding number five Conservation Order 116 reads~ '~Invitatlon to participate in the program wlll be open to all companies and indlvlduals and will be well publlclzed,v~ When will you start to publicize your program, when can you? Mr. Osborn: The pubic, we started publicizing the program in January, after our last hearing, and we sent a notice to some I00 to I10 companies or indlvlduals who have, are listed In the Alaska Petroleum Directory, with respect to the program and in addition to that we have cooperated wlth the various newspapers and Scouting Services wi th respect to publiclzl ng --5-- the Information freely. Mr. Marshall-' Have you advertlsed In the 0II and Gas Journal yet? Mr. Osborn~ We sent one In, I haven't seen it published slnce we're, the delay In getting an 011 and Gas Journal up here is so long that I don't know whether it In there or not. Mr. Marshal l~ I haven't seen one yet, that's really the purpose of the question. I notlce on your appllcatlon, you're speaking of an estimated total that of 7,000'~ plus or minus. I'd just Ilke to mentlon that if its deeper than 7,000', we may want an amended application to drill. We have a maximum limit that we speak of In our appllcatlon~ it can be of course less, but you may want to talk with us on whether or not to apply for a depth greater than 7,000' or else be aware that we may want an amended application If you go deeper than 7,000'. Mr. Osborn: We don't anticipate going deeper than 7,000. I think, the thing that I was looking at with respect to this plus or minus was that it may be 7,050 or 7,100, depending on where we wear a bit out or somethl ng I I ke that. Mr. Marshall~ Just very mi nor. Mr. Osborn~ Very minor difference~s in the 7,000, yes. Mr. Marshall~ Thls past week we've had a phone call concerned as to whether or not you were going to drill near King Island~ and I of course looking over your application could not see any location anywhere near King Island, but t understand that there is a Cape ~]ouglas, shows up on, on very many maps which is just to the east of Cape Douglas, the same latitude, just a little blt below Point Spencer, below Polnt Clarence -6- there. There is another Cape Douglas and one of your locations bore that name and i think this is probably the source for this concern about King Island. Would you confirm that you're not going to drlll near King Island? Mr. Osborn: Yes, we have no proposed location near King Island. Mr. Marshall: Thank you. That's all the questions that I have at this time. Mr. Burrell: Mr. Gllbreth? Mr. Gllbreth: Mr. Osborn, at the last hearing you testified regardlng your plans for drllllng these wells. Are your plans the same for the additional wells as they were for the other wells, all of them to be drilled about the same way? Mr. Osborn: Yes they, It is. Mr. Gilbreth: Utilizing the same safety features and everything else? Mr. Osborn: Yes. Mr. Gllbreth: That's all I have. Mr. Burrell: Does anybody In the audience have any questlons? Do you w lsh to make a statement? I'd better read one letter Into the record although It does not Identify with this hearing, it is a form letter, from the lawflrm of Kay, Miller, Libbey, Kelly, Chrlstle & Fuld In Anchorage, signed by one John Anthony Smith of that firm. It Is a form letter dlrected to me. It reads as fol lows: "This Is to infor~ you that the Aleut Corporation considers Itself an Interested party In any matter which comes before your agency relating to transactions taking place in the Aleutlan region. By this letter the -7- Aleut Corporation glves notice that It will take whatever steps are nec- cessary to protect the Aleut's rights in the Aleutian region. Some of these locations are In what I believe to be the Aleut reglon, and for the record I would state that all notices of public hearings In the past and In the future will be published In accordance with applicable laws and regulatlons whlch would give adequate notice to the Aleut Corporation. Notice is hereby given that Exploration Services Company, Inc. has requested an order granting an exception to Title II, Alaska Administrative Code, Section 2008, which requires the making and filing of certain geological reports, logs and other data and Information on wells and stratigraphlc tests, with respect to proposed stratlgraphlc tests at the approximate locations listed below. Four locations approved by Conservation Order 116 have been revised and five new locations have been requested. The approxlmate locations of the proposed addltlonal stratigraphic tests for which this exception is requested are as follows: I. Yakataga Area Offshore - One hole to be located within Townshlps 22 to 23 South and Range 18 to 21 East, Copper River Meridlan. 2. Middleton Island Offshore - One hole to be located within three mi les of Mlddleton Island. 3. Narrow Cape Offshore - One hole to be located wlthln Townships 32 to 33 South and Range 18 to 19 West, Seward Meridian. 4. Amak Island Offshore - One hole to be located withln three mi les of Amak Island, north of Cold Bay, Alaska 5. Yukon River Delta - One hole to be located on State of Alaska submerged lands near the mouth of the Yukon River. In order to obtaln more flexlbillty in locating the holes with respect to safe oceanographic and geologic condltlons the following changes in location previously approved by Conservation Order 116 are requested: I. Kuskokwim Bay, Alaska - change from approx. T7S-R76W, SM to one hole to be located on State of Alaska submerged lands near the mouth of the Kuskokwim River. Offshore Chirikof Island, Gulf of Alaska - c~ange from T49S-R42W, SM to one hole to be located within three mi les of Chirikof Island. 3. Offshore Cape Douglas, Shelikof Straits - change from approx. TI5S- TR4~2~W., SM. to one hole to be located wlthin ownships 15 South to 17 South and Range 24 West, Seward Meridian. 4. Offshore Cape Suckling, Gulf of Alaska - change from approx. T22S R9E, Crm to one hole to be located within Township 22 South and Ranges 9 and I0 East, Copper River Meridian. It is also requested that all locations be subject to further mlnor change after acquisition of additional geophysical and bathymetry data. Final locations will be submitted to the State of Alaska, Department of Natural Resources at least ten (10) days prior to moving on to the location with the drill ship. The Alaska (')il and Gas Conservation Committee will hold a publlc hearing, pursuant to Title II, Alaska Administrative Code, Section 2_~)09 to consider whether applicant's request is in the best interests of the State. Subsequent to the issuance of Conservation Order No. 116, dated January 26, 1973 which excepts Exploration Services Company, Inc. from the filing of such information on eight (8) holes, we have revised our program as a result of certain logis.t..~,,.,a,%..p~pb!ems. We are now requesting the the same consideration be given to the below listed locations. We again only propose to drill eight (8) core holes to a depth of 7,000 feet plus or minus on unleased Alaska submerged lands, but we are requesting approval on a total of thirteen (13) locations inorder to have sufficient back-up in the event weather, bathymetry or geological problems preclude the drilling of one or more of the primary locations. We respectively request that the Alaska Oil and Gas Conservations Committee except us from the filing of such data as is required by section 2008 on the below listed additional locations or revised locations. Such exception will allow us to organize a group participation program in which any and all interested companies and individuals may participate on a equal share basis. The primary objective of such a program will be to acquire certain geological information which would not otherwise be available in remote areas of Alaska. Exploration Services Company, Inc. will file Miscellaneous Land Use applications with the Alaska Division of Lands in which provisions will be made for eventual public release of the information obtained by this program. The approximate locations of the proposed additional core holes for which this exception is requested are as follows: 1. Yakataga Area Offshore - One hole to be located in the area bounded by Townships 22 to 23 South and Range 18 to 21 East, Copper River Meridan. 2. Middleton Island Offshore - One hole to be located within the three mile limit of Middleton Island. 3. Narrow Cape Offshore - One hole to be located in the area bounded by Townships 32 to 33 South and Range 18 to 19 West, Seward Meridan. 4.
