Commission updates drilling permit terms
The Alaska Oil and Gas Conservation Commission is amending its regulations to
recognize the existence of multi-lateral wells: wells with concurrent production from
more than one well branch.
The change includes amending the defmition of well branch to include drilling
below the conductor casing to access more than one objective, or
when an initial bottomhole location is changed by plugging back
and rcdrilling. Pennit to d~iII requirements are also being amend-
ed to distinguish between a plug-back-and-redrill well branch
and concurrent multiple well branches.
At a Sept. 6 hearing Winton Aubert, a petroleum engineer on
the commission's staff, said the staff has been identifYing poten-
tial gaps in the agency's regulations and ambiguities in some
tenns.
Aubert said in a case where one well path has been plugged
and another well path drilled from the same bore, but they are not
active at the same time, the second well path is commonly called
a sidetrack.
In the case where "there are two or more well paths away from a given well bore·
which are active concurrently, those well paths are commonly called laterals.

What the commission is proposing, Aubert said, is to standardize the terminology:
every well path would be called a well branch.
Assistant Attorney General Rob Mintz said there is also another issue: a plug back
has been referred to as an abandonment, which is not consistent with the commission's
regulations because it implies that the entire well has been plugged and abandoned.
Under the proposed changes, he said, this is clarified to specifY that it is a well branch
which will be plugged.
Judy Brady, executive director of the Alaska Oil and Gas Association, said AOGA's
task group for AOGCC reviewed the proposed regulations. The amendments "provide
clarity in pennitting proposed drilling locations and provide a clear definition of a 'well
branch'." Brady also said the amendments do not change the current process for
drilling pennits and do not additionally burden operators.
Commission Chainnan John Noonan asked if changes in tcchnology were a factor
in these amendments, and Aubert said that when the commission last revised its regu-
lations industry was not drilling multi-lateral wells. Five well branches are active in one
North Slope well, Aubert said, the maximum for Alaska and also for the industry
worldwide.

Changes have been adopted to the regulations dealing with well branches, applications
for a permit to drill, changes in a drilling program, and redrilling a well. The affected
regulations are 20 AAC 25.005(e), 20 AAC 25.015(a)(I) and (b)(1), and 20 AAC
25.990(74). The Lieutenant Governor filed the regulation changes on December 6,
2005, with an effective date of January 5, 2006.

Under AS 44.62.060, we have reviewed the attached amendment of these regulations by
the Alaska Oil and Gas Conservation Commission, and approve the changes for filing by the
lieutenant governor. I have reviewed this project under a specific delegation dated December 5,
2005 from the Regulations Attorney. A duplicate original of this memorandum is being
furnished to the lieutenant governor, along with the two pages of regulations and the related
documents.
You might wish to contact the lieutenant governor's office to confinn the filing date and
effective date of the attached regulation changes.
The August 5, 2005 public notice and the November 8, 2005 certification order both state
that this action is not expected to require an increased appropriation. Therefore, a fiscal note
under AS 44.62.195 is not required.
In accordance with AS 44.62. 125(b)(6), some corrections have been made III the
regulations, as shown on the attached copy.

We have reviewed the attached regulations from the Alaska Oil and Gas Conservation
Commission. I have reviewed this project under a specific delegation dated November 5, 2005
from the Regulations Attorney. A duplicate of this memorandum is being furnished to John K.
Norton, the commission chair, along with a copy of the regulations.
The Department of Law has reviewed the attached regulations against the statutory
standards of the Administrative Procedure Act. Based upon our review, we find no legal
problems. This memorandum and the attached duplicate memorandum dated December 6, 2005
constitute the written statement of approval under AS 44.62.060(b) and (c) that authorizes your
office to file the attached regulations.
The regulation changes were adopted by the Alaska Oil and Gas Conservation
Commission after the close of the public comment period. The regulations refine provisions
pertaining to permits to drill and well branches.
The certification order for the regulations states that this action is not expected to require
an increased appropriation. Therefore, a fiscal note under AS 44.62.195 is not required.
We have made a few technical corrections to confoffil the regulations with the drafting
manual under AS 44.62.060 and 44.62.125. The corrections are shown on the attached copy of
the regulations.

REGULATIONS OF ALASKA OIL AND GAS CONSERVATION
COMMISSION
The attached two pages of regulations, dealing with well branches, applications for a Permit to
Drill, changes in a drilling program, redrilling, and plugging under 20 AAC 25 are hereby
certified to be a correct copy of the regulation changes that the Alaska Oil and Gas Conservation
Commission adopted at its October 26,2005 meeting, under the authority of AS 31.05.030 and
31.05.040 and after compliance with the Administrative Procedure Act (AS 44.62), specifically
including notice under AS 44.62.190 and 44.62.200 and opportunity for public comment under
AS 44.62.210.
This action is not expected to require an increased appropriation.
On the record, in considering public comments, the Alaska Oil and Gas Conservation
Commission paid special attention to the cost to private persons of the regulatory action being
taken.
The regulation changes described in this order take effect on the 30th da after they have been
filed by the lieutenant governor, as provided in AS 44.62.180.

NOTICE OF PROPOSED CHANGES IN THE REGULATIONS OF THE
ALASKA OIL AND GAS CONSERVATION COMMISSION
The Alaska Oil and Gas Conservation Commission ("AOGCC") proposes to adopt
regulation changes in Title 20, Chapter 25, of the Alaska Administrative Code, dealing
with well branches, applications for a Permit to Drill, changes in a drilling program,
redrilling, and plugging, including the following:
the definition of "well branch" is proposed to be amended in 20 AAC 25.990(74)
to make clear that it applies where an initial bottom-hole location is changed by plugging
back and redrilling;
20 AAC 25.005(e) is proposed to be amended to clarify the Permit to Drill
requirements for well branches; and
20 AAC 25.015 is proposed to be amended to make clear that it applies to
prospective-only changes in drilling locations.
You may comment on the proposed regulation changes, including the potential costs to
private persons of complying with the proposed changes, by submitting written
comments to the AOGCC, 333 W. ih Avenue, Suite 100, Anchorage, AK 99501. The
comments must be received no later than 4:30 p.m. on September 13,2005.
Additionally, oral or written comments may be submitted at a hearing to be held on
September 6, 2005, at 333 W. ih Avenue, Suite 100, Anchorage, AK 99501. The
hearing will begin at 9:00 a.m. and may be extended from day to day if necessary to
accommodate those present before 9:30 a.m. who did not have an opportunity to
comment.

The Alaska Oil and Gas Association (AOGA) is pleased to have this opportunity to provide written
comments to the Alaska Oil and Gas Conservation Commission (AOGCC) on the proposed
regulation changes in Title 20, Chapter 25, of the Alaska Administrative Code dealing with well
branches. AOGA is a private, nonprofit trade association whose 18 member companies account
for the majority of oil and gas exploration, development, production, transportation, refining and
marketing activities in Alaska.
AOGA's task group for AOGCC, chaired by Barbara Fullmer of ConocoPhillips Alaska, has
reviewed the proposed regulations. As we stated in public testimony last week, we understand
the purpose of these proposed changes is to clarify the definition of "well branch" and permit to
drill requirements for well branches. We also understand that the proposed regulation changes
will not add additional burden to operators, nor do they cause any impacts with respect to the
current process for applying for permits to drill for well branches.
We appreciate the Commission's diligence in clarifying regulations to assist the industry and we
support the proposed regulation changes as outlined in the August 4, 2005 public notice. We
appreciate the opportunity to provide comments on this proposal.

DR. AUBERT: If you'll address Exhibits A and B, Exhibit A
represents a situation of a well that -- part of which had been
plugged and then another well path drilled away from part of
the existing well bore and the second well path is denoted by
the dashed line.
Contrast that with Exhibit B where two well paths have
been drilled away from a given well bore and they are active
concurrently rather than subsequently as in Exhibit A, so
therein lies the crux of this regulation change.
Common usage refers to -- or has been referring to Exhibit
A as a side track and the two well paths in Exhibit Bare
generally referred to as laterals within a multi-lateral well
system. We are proposing to standardize the language
describing those two situations and use the term well branch to
denote each and every well path that is visible there.
CHAIR NORMAN: Okay. And there is a second change in the
regulations also that adds the word proposed to before bottom
hole location in 20 25.015 and that is for clarity. It's my
understanding that that's always been the intention that it
applied to proposed, but that's added for clarity.
DR. AUBERT: That is correct. And that particular
regulation treats proposed changes to the existing permits to
drill either before drilling operations start or after drilling

is intuitively okay, but is not really consistent with the
technical definition of abandonment that the regs use because
that implies the complete plugging of the entire well.
So this will make it clear that what's really being
plugged is a well branch and therefore the -- all of the
implications -- all the way that a well branch is treated under
the regs such as getting permission to plug a well branch under
section 107 and the requirement to file well data within 30
days after a well branch has been completed or plugged will be
more clear that these apply in the same way to a portion of a
well that's been plugged back to allow redrill.
CHAIR NORMAN: Okay. Thank you. And for the record that
was Mr. Rob Mintz, Assistant Attorney General, legal counsel
for the Commission.
Dr. Aubert, is it correct to say as a general matter that
because of the advances and innovations in drilling technology
it's given rise to the ability to drill these well branches and
to engage in greater variation from directional drilling and
that's created the, perhaps, ambiguity since our regulations
were originally adopted?
DR. AUBERT: It certainly contributed to it because
technology now exists allowing multiple well branches under our

9 familiar with all your regulatory things.

12 capacity of the Commission is? Under the Alaska Lands Interest

in the state of Alaska and our regulatory authority is similar
in varying degrees to what you would find in virtually every
other oil and gas producing state.
MS. OLSON: Well, it does -- the Alaska Lands Interest Act
does say that it's an interpretation of Article 8, section 10
of the Alaska Constitution and that is not implicable (sic) to
other states and so that's why I'm going to be raising these
issues.
I have a federal petition that I filed when I went to the
Alaska
not -- what it is, the National Petroleum Preserve.
I filed a petition asking how the federal government would
deviate from the state standards that was set previously and so
that is out there.
I have a problem where in the Constitution it requires
that grants and privileges have the right to sue and at this
time I don't know what the public's means for the right to sue
because what I'm seeing here is a lot of grants and privileges
without the right to sue and so this, I believe, is a legal
problem.
The other thing I see is the diversity issue. The
commissioner recently denied me -- of Natural Resources
recently denied me an administrative appeal. The Alaska Lands
Interest Act is supposed to be under the Administrative Code
and so that brings up an issue when I went to the Courts then
the Courts were confused whether or not this should be

administrative or whether this should be a civil suit. I told
them it had to be both so that issue is a recently filed case
in Anchorage where the Courts themselves cannot determine
whether this is an administrative issue or whether it's a
civil.
Let's see what else, one of the issues I raised federally
was the issue of tax credits actually creating a different type
of interest than originally under the leases. And I want to
state for the record that Alaska Survival versus DNR has been
implemented for a standard for oil and gas activities and I
wanted to state that for 21 years I've not paid any taxes so I
guess I got a tax credit.
So that's why I'm here tonight is because I'm a pipeline
standard. I'm the state equivalency of the NEPA and I don't
find that -- that those issues are being adequately addressed
and this is why the diversity issue of the commissioner having
a different standard than you. You having a different standard
than under a land use plan. They're all different standards
and there's no means to show what one you should be prevailing.
So the

2 I bought up the issue that the oil industry, its own
3 activities in the past was reported that their activities
4 impaired the pollination of grasses, for example.
5 The rules of civil procedure federal require that there be
6 scientific analyst (sic) and I believe that violates the Alaska
7 Lands Interest Act if it were solely implemented that way
8 because of our requirement of public notice.
9 Lastly in there is the other safeguards as prescribed by
10 law and I don't think you've ever really defined what the other
11 safeguards prescribed by law are and in not doing it so it
12 it leaves a potential to challenge and I really think that you

should have defined what other safeguards as prescribed by law
14 are if you are solely the authority. I don't think you are,
15 but then I'm not a legal professional.
16 I just know that I've been held as a mitigation standard
17 for coal bed methane. I have been a legal standard for a
18 pipeline. I've been a narrative quality water standard. I've
19 been a permeability standard and I'm having problems with, I
20 guess, the Alaska Lands Act where classifications are being
21 changed without the public process and an interpretation of
22 what the classification is.

24 would have to say from what you've given to me I am going to

Good morning. My name is Judy Brady and I am the Executiv~
Director of the Alaska Oil & Gas Association (AOGA). AOGA is a
non-profit trade association whose member companies represent the
majority of oil and gas exploration, production, transportation, refining
and marketing activities in Alaska.
We are pleased to have this opportunity to provide public testimony to
the Alaska Oil and Gas Conservation Commission (AOGCC) on
the proposed regulation changes in Title 20, Chapter 25, of the
Alaska Administrative Code dealing with well branches and
applications for a Permit to Drill.
AOGA's1ask group for AOGCC has reviewed the proposed
regulations. Representatives of the task group are present in the
audience. They are Barbara Fullmer - ConocoPhillips, and Harry
Engel - BP. We understand the purpose of these proposed changes
is to clarify the definition of "well branch" and permit to drill
requirements for well branches.
· First, these proposed regulation changes do not diminish
environmental standards.
· Second, the proposed regulations provide clarity in permitting
proposed drilling locations and provide a clear definition of a
"well branch".
· Third, the proposed regulations do not alter the current process

I am writing in response to your request, in your August 23, 2005, letter to the Alaska Oil
and Gas Conservation Commission ("AOGCC"), for special accommodations for the September
6, 2005, AOGCC hearing. That hearing concerns proposed changes in Title 20, Chapter 25, of
the Alaska Administrative Code, dealing with well branches, applications for a Permit to Drill,
changes in a drilling program, redrilling, and plugging.
In your letter, you stated that you have a "disability in communication in writing and in
speech." You requested that the AOGCC provide you with a facilitator during the September 6th
hearing to help you "focus," and you requested up to three hours to present your comments.
The type of assistance you are seeking from a facilitator is not clear. In any event
however, the AOGCC does not have facilitators available tó assist persons in formulating and
communicating their comments. Neither can the AOGCC reasonably provide persons with up to
three hours to present their comments, but you and others who wish to testify at the hearing will
have the same reasonable amount of time in which to do so.
Please note that other means of presenting your comments are available. You may have
someone else speak on your behalf at the hearing. And, if you believe that you cannot orally
communicate your comments in the reasonable time allowed, you can submit (during or after the
hearing) a tape recording of your comments; any such tape recording will become part of the
official record of the hearing. Also, you can make any written submission on the proposed
regulation changes. There is no restriction on the length of the written comments that can be
submitted by you or someone acting on your behalf. To be considered by the Commission, your
tape recorded and/or written comments must be received by the AOGCC (at 333 W. 7th Avenue,
Suite 100, Anchorage, AK 99501) no later than 4:30 p.m. on September 13,2005.

with well branches, applications for a Permit to Drill, changes in a drilling program,
redrilling, and plugging, including the following:
the definition of "well branch" is proposed to be amended in 20 AAC 25.990(74)
to make clear that it applies where an initial bottom-hole location is changed by plugging
back and redrilling;
20 AAC 25.005(e) is proposed to be amended to clarify the Permit to Drill
requirements for well branches; and
20 AAC 25.015 is proposed to be amended to make clear that it applies to
prospective-only changes in drilling locations.
You may comment on the proposed regulation changes, including the potential costs to
private persons of complying with the proposed changes, by submitting written
comments to the AOGCC, 333 W. ih Avenue, Suite 100, Anchorage, AK 99501. The
comments must be received no later than 4:30 p.m. on September 13, 2005.
Additionally, oral or written comments may be submitted at a hearing to be held on
September 6, 2005, at 333 W. 7th Avenue, Suite 100, Anchorage, AK 99501. The
hearing will begin at 9:00 a.m. and may be extended from day to day if necessary to
accommodate those present before 9:30 a.m. who did not have an opportunity to
comment.

20 AAC 25.005(e) is amended to read:
( e) [IF A WELL HAS MULTIPLE WELL BRANCHES,] Each [EACH] well branch
requires a separate Permit to Drill. If a previously drilled well is proposed to be redrilled
below the structural or conductor casin2; to a new bottom-hole location, the application for
a Permit to Drill must be accompanied bv all items required under (c) of this section. If
concurrent multiple well branches are proposed from a single conductor, surface, or production
casing,
ill the applicant shall designate one well branch as the primary wellbore and
include all items [INFORMATION] required under (c) of this section for a Permit to Drill for
that well branch~[.]
(2) for [FOR] each other [SUBSEQUENT] well branch, the application for a
Permit to Drill need only include information under (c) of this section that is unique to that well

20 AAC 25.015(a)(1) and (b)(1) are amended to read:

Review of recent applications to plug back the productive portion of a wellbore
and "sidetrack" to a new target has brought to light some apparent regulatory ambiguities
and possibly gaps, as well as tenninological issues, regarding wells that experience such
sequential plugging and drilling operations.
The terminological issues involve the proper use of the tenns "abandon,"
"sidetrack," "well branch," and "redrill." These issues, however, can be easily disposed
of once it is decided how to address the underlying substantive issues. The substantive
issues involve how to apply regulatory provisions governing: applications for a Permit to
Drill, including the application fee; assignment of API numbers; single-well bonds; filing
of data and reports upon completion or plugging; and Commission approval of plugging
operations.
To provide context for understanding these issues, it will be helpful to compare
several different scenarios. The descriptions below are based on my reading of the
Commission's regulations and on information provided to me by Winton Aubert as to
actual Commission practices.
Simple well
First, consider the conventional case of a simple well with a single bottom-hole
location. Before commencing drilling operations, the operator must submit an
application for a Pennit to Drill (Form 10-401), meeting all the requirements of
20 AAC 25.005, including payment of a $100 application fee. The operator must also
file a single-well bond, which contains an identification of the specific well in question,
unless a blanket state-wide bond is in effect. 20 AAC 25.025. The well is assigned a
unique API number by the Commission. 20 AAC 25.005(f). If, after drilling operations

start, the operator wishes to change the bottom-hole location by more than 500 feet, a
new application for a Permit to Drill, accompanied by a fee of $100, is required. Smaller
changes can be approved in response to an Application for Sundry Approvals (Form 10-
403). When a divergence from the planned the well path is necessary only "for the
pUlpose of straightening the original hole, bypassing junk, or correcting mechanical
difficulties in the original hole," this is known as a "sidetrack operation,"
20 AAC 25.990(63), and it does not usually even require a sundry approval. See
20 AAC 25.050(a)(1).
If the well is completed, within 30 days thereafter the operator n1ust file with the
Commission (1) a digital copy of each inclination and directional survey not previously
filed, 20 AAC 25.050(d); (2) a complete well record on the Well Completion or
Recompletion Report and Log (Form 10-407), 20 AAC 25.070(3); and (3) logs, cutting
samples, tests, and other geologic data, 20 AAC 25.071. If the well produces, the
volumes of produced gas, oil, and water must be reported. monthly to the Commission
using the well's API nun1ber. 20 AAC 25.230.
Ultimately, the well will have to be abandoned, i.e., plugged in accordance with
the plugging requirements of 20 AAC 25.112. See 20 AAC 25.990(1). However, under
ce1iain conditions, the well may be suspended before being abandoned, which means that
all but the surface plugging requirements for well abandonment must be 111et and the
operator reserves the right later to re-enter the suspended well for redrilling or
completion. 20 AAC 25.110; 20 AAC 25.990(70). In either case, the operator must
submit for Comn1ission approval an Application for Sundry Approvals before carrying
out the plugging operations. 20 AAC 25.105; 20 AAC 25.110. If the well had not
previously been completed, the filing requiren1ents for a well record, geologic data, etc.,
referred to above must be met within 30 days after the well is suspended or abandoned.
No later than a year after an onshore well is abandoned, the operator must
satisfactorily perform location clearance operations, 20 AAC 25.170, and install a well
abandonment marker, 20 AAC 25.120. Then, the Commission releases the single-well
bond covering the well. 20 AAC 25.025(c).
Multilateral well
Now let's consider a "well with multiple well branches drilled to different bottom-
hole locations." 20 AAC 25.990(73). Each well branch is a "portion of a well drilled
below the structural or conductor casing to access a separate objective."
20 AAC 25.990(74). A well branch is often referred to as a "lateral," and a well with
multiple well branches is often referred to as a "multilateral" well, although the
regulations do not use these terms.

Each branch of a well with multiple branches requires a separate Permit to Drill,
but only one $100 application fee need be paid. 20 AAC 25.005(e). One branch is
designated the primary wellbore. [d. Each well branch is assigned an API number by
adding a suffix to the basic API number. 20 AAC 25.005(f). It appears that one single-
well bond will suffice for a well with multiple branches.
It is possible to complete fewer than all branches in a multilateral well.
20 AAC 25.990(14). Within 30 days after completing a well branch, the operator must
file with the COlnmission (1) a digital copy of each inclination and directional survey not
previously filed, 20 AAC 25.050(d); (2) a complete well record on the Well Completion
or Recompletion Report and Log (Form 10-407), 20 AAC 25.070(3); and (3) logs, cutting
samples, tests, and other geologic data, 20 AAC 25.071. If the well produces, the
volumes of produced gas, oil, and water must be aggregated for all well branches and
reported monthly to the Con1mission using the primary wellbore's API number.
20 AAC 25.230.
An operator n1ay plug a well branch before abandoning or suspending the well.
20 AAC 25.107. An Application for Sundry Approvals must be submitted and approved
before plugging operations are begun. Plugging a well branch does not trigger location
clearance or well abandonment marker requirements or affect continued bond coverage.
However, it does trigger the requirement to file reports and data under
20 AAC 25.050(d), 25.070(3), and 25.071, as described above.
RedrilIing
The regulatory treatment of the above two scenarios is reasonably clear and wen
defined. N ow we con1e to the remaining scenario, whose regulatory treatment is less
clear.
Under this scenario, after a well has been drilled to a single bottom-hole location,
and often has been completed and producing for some period of time, the operator wishes
to plug back most of the wellbore and drill to a new bottomhole location from below the
existing structural or conductor casing. Although the new drilling operation is often
referred to as "sidetracking," that usage is inconsistent with the regulations' definition of
sidetrack operation (see above). Probably the correct term under the regulations is
"redrilling." Although that term is not defined, the way it is used in 20 AAC 25.005(a),
20 AAC 25.110(a)(I)(B), and 20 AAC 25.990(70) is consistent with this scenario.
The central unresolved question is this: is the newly-drilled portion of the well a
"well branch" under the regulations, or is it something different? If it is a well branch,
then the existing regulations prescribe how to treat it. (However, in practice the
Commission does not treat it in all respects like a well branch in a multilateral well.) If

the newly-drilled portion of the well is not a "well branch," then there are gaps in the
existing regulations.
The Commission's current administrative practice is to treat the redrilled well as a
new and different well. I believe that, unlike with a branch in a multilateral well, a new
$100 fee is required in connection with the application for a Permit to Drill. Although
the basic API number remains the same, a new suffix is assigned to the well, using a
numbering convention that differs from that used for a branch in a multilateral well.
After the redrill, production is reported under the new API number. Also, the wellbore
associated with the original API number is shown as "abandoned" in the Con1mission's
records. This is an incorrect usage, because in order to be abandoned a well l11Ust be
completely plugged, including surface plugs, and if the well is onshore the operator is
required to perform site clearance and install an abandonment marker. Also, treating the
redrill as a new well raises questions about the applicability of a single-well bond, unless
the Con1mission requires the filing of an additional bond. Presumably, the surety on the
original bond would resist demands to pay for abandoning the redrill, on the ground that
it only undertook obligations with respect to the original well.
If there are good regulatory reasons for treating redrills differently from well
branches in a multilateral well, then the regulations should be amended to explicitly cover
the plugging of the initial wellbore portion and the drilling to a new bottomhole location.
Right now, the operator's report-and-data-filing obligations are triggered by abandoning
or suspending a well and by plugging a well branch, but not by plugging back a portion
of a wellbore to allow for a redrill. And while the regulations authorize an operator to
apply for the Commission's approval to abandon or suspend a well or plug a well branch,
there is no express procedure for approving the plugging back of a portion of a wellbore
to allow for a redrill.
On the other hand, if there is no good reason to distinguish between a redrill and a
well branch, then the definition of well or well branch or both should be revised to make
clear that a well can have more than one branch consecutively even if only one well
branch exists at anyone time.
Or if the appropriate treatment of redrills and well branches is generally identical
but there are one or two differences that should be observed - e.g., a greater need for
updated information in the Form 10-401 in the former case - it would be possible to
include redrills in the definition of well branch but also provide where necessary for
special regulatory treatment of a well branch that is drilled long after the well was
initially completed.
