20 AAC 25.120 is repealed and readopted to read:
20 AAC 25.120. Well abandonment marker. The exact surface location of an
abandoned onshore well must be shown by a well abandonment marker plate that
(1) is constructed of steel that is at least 1 /4 inch thick;
(2) is welded to, and covers the outermost casing string, including the conductor casing;
(3) does not extend beyond the outermost casing string; and
(4) contains the following information bead-welded directly to the marker plate:
(A) the name of the operator that plugged and abandoned the well;
(B) the number assigned by the Commission to the Permit to Drill (Form 10-401)
for the well under 20 AAC 25.040(b);
(C) the name designated for the well by the operator under 20 AAC 25.005(fj;
(D) the API number for the well, with any suffix appended to the number under
20 AAC 25.005(f). (Eff. 4/13/80, Register 74; am 4/2/86, Register 97; am 11/7/99,

Amended Regulations Dealing with Well Abandonment Markers
The Alaska Oil and Gas Conservation Commission have revised its regulations dealing
with well abandonment marker requirements in 20 AAC 25.120. The amended
regulation specifies the required dimensions, configuration, and placement of well
abandonment markers, and eliminates the use of marker posts. The Lieutenant Governor
signed and filed the regulation changes on February 19, 2010, with an effective date of
March 21, 2010.

REGULATIONS OF ALASKA OIL AND GAS CONSERVATION
COMMISSION
The attached 1 page of regulations, dealing with well abandonment markers under 20 AAC 25, is
certified to be a correct copy of the regulation changes that the Alaska Oil and. Gas Conservation
Commission adopted at its December 2, 2009 meeting, under the authority of AS 31.05.030 and
AS 31.05.040 and in compliance with the Administrative Procedure Act (AS 44.62), including
the notice provisions (AS 44.62.190 and AS 44.62.200) and opportunity for public comment
provision (AS 44.62.210).
This action is not expected to require an increased appropriation.
On the record, in considering public comments, the Alaska Oil and Gas Conservation
Commission paid special attention to the cost to private persons of the regulatory action being
taken.
As provided in AS 44.62.180, the subject regulation changes take effect on the 30th day after
they are filed by the lieutenant governor.

Under AS 44.62.060, we have reviewed the Alaska Oil and Gas
Conservation Commission's changes to this regulation and approve the changes for
filing by the lieutenant governor. A duplicate original of this memorandum is being

You might wish to contact the lieutenant governor's office to confirm the
filing date and effective date of the regulation changes.
The September 23, 2009 public notice and the December 22, 2009
certification of adoption order both state that this action is not expected to require an
increased appropriation. Therefore, AS 44.62.195 does not require a fiscal note.
Finally, we have made some technical corrections to the regulation in
accordance with AS 44.62.125. The corrections are shown on the attached copy of the
regulation.

We have reviewed the attached Alaska Oil and Gas Conservation
Commission (commission) regulation. A duplicate of this memorandum is being
furnished to Daniel T. Seamount, Jr., chair of the commission, along with a copy of
the regulation changes.
The Department of Law has reviewed the attached regulation against the
statutory standards of the Administrative Procedure Act. Based upon our review, we
find no legal problems. This memorandum and the attached duplicate original
memorandum dated February 10, 2010 constitute the written statement of approval
under AS 44.62.060(b) and (c) that authorizes your office to file the attached
regulation.
The regulation changes were adopted by the commission after the close of
the public comment period and oral hearing. The regulation changes are regarding the
standards for marking the surface location of an abandoned onshore well with a well
abandonment marker plate.
The certification adoption order for the regulation states that this action is
not expected to require an increased appropriation. Therefore, a fiscal note under
AS 44.62.195 is not required.
Finally, we have made some technical corrections to the regulation in
accordance with AS 44.62.125: The corrections are shown on the attached copy of the
regulation.

REGULATIONS OF ALASKA OIL AND GAS CONSERVATION
COMMISSION
The attached 1 page of regulations, dealing with well abandonment markers under 20 AAC 25, is
certified to be a correct copy of the regulation changes that the Alaska Oil and Gas Conservation
Commission adopted at its December 2, 2009 meeting, under the authority of AS 31.05.030 and
AS 31.05.040 and in compliance with the Administrative Procedure Act (AS 44.62), including
the notice provisions (AS 44.62.190 and AS 44.62.200) and opportunity for public comment
provision (AS 44.62.210).
This action is not expected to require an increased appropriation.
On the record, in considering public comments, the Alaska Oil and Gas Conservation
Commission paid special attention to the cost to private persons of the regulatory action being
taken.
As provided in AS 44.62.180, the subject regulation changes take effect on the 30th day after
they are filed by the lieutenant governor.

NOTICE OF PROPOSED CHANGES IN THE
REGULATIONS OF THE
ALASKA OIL AND GAS CONSERVATION COMMISSION
The Alaska Oil and Gas Conservation Commission proposes to adopt regulation changes in Title 20,
Chapter 25 of the Alaska Administrative Code, governing well abandonment markers, including:
20 AAC 25.120 is proposed to be amended. The intended effect of the repeal and readoption is
clarification of the required dimensions, configuration, and placement of a well abandonment
marker, and elimination of the use of marker posts.
You may comment on the proposed regulation changes, including the potential costs to private persons of
complying with the proposed changes, by submitting written comments to the Alaska Oil and Gas
Conservation Commission at 333 West 7`" Avenue, Suite 100, Anchorage, Alaska 99501. The comments
must be received no later than 4:30 p.m. on November 2, 2009.
Oral or written comments also may be submitted at a hearing to be held from 9:00 a.m. to 12:00 p.m. on
November 19, 2009, at 333 West 7`h Avenue, Suite 100, Anchorage, Alaska 99501. The hearing may
continue beyond 12:00 p.m. to allow comment by those present before 9:30 a.m. The public comment
period will close at the end of the November 19, 2009 hearing.

ACTING CHAIRMAN FOERSTER: All right. I'll call this
meeting to order. This is a hearing to consider proposed
amendments to the well abandonment marker regulations of the=_
Alaska Oil and Gas Conservation Commission. The hearing is
being held on the morning of November 19th, 2009. And we'rE=_
about five minutes after 9:00 a.m. The location is the
Commission's offices at 333 West Seventh Avenue, Anchorage,
Alaska.
To my right is Commissioner John Norman and I'm Cathy
Foerster.
R & R Court Reporters will be recording the proceeding.
Upon completion and preparation of the transcript persons
desiring a copy will be able to obtain it by contacting R & R
Court Reporters or alternatively by contacting Jody Colombie,
the Commission's special assistant who will facilitate your
getting a copy.
There are two microphones in front of our speaker and
anyone who wants to speak. One is for amplification within
this room and the other is for purposes of facilitating the
Court Reporters work. It is the practice to swear witnesses. in
and we will follow that practice.

If you intend to be testifying as an expert witness, that
is someone with experience and background on the subject matter
of the regulations then I'll ask you to indicate your
background and your experience so the Commission can gauge
whether you fall into the category of expert witness.
The Alaska Oil and Gas Conservation Commission proposes to
amend Title 20, Chapter 25, Section 110 of the Alaska
Administrative Code deal with the well abandonment markers, 20
AAC 25.120.
The notice of this hearing was published in the Anchorage
Daily News on September 23rd, 2009. It has also been posted on
the State of Alaska on line notices website, as well as the
AOGCC's own website.
These proceedings are being held in accordance with the
general hearing regulations specifically found in AS 44.62 and
20 AAC 25.540 of the Alaska Administrative Code.
I'm looking at the sign up sheet and it appears that we
have one person who wishes to testify and before we hear from
him I will ask Commissioner Norman if he has any preliminary
comments?

1 ACTING CHAIRMAN FOERSTER: Okay. I do have one
2 preliminary comment before we get into the meat of the hearing.
3 I was informed -- notified by BP that last night they had a
4 fatality at Prudhoe Bay. And it was a contract employee
5 conducting pipeline integrity inspections. And he got out of
6 his truck to check one of the inspection points and apparently
7 the truck popped into gear and pinned him to the pipeline and
8 when he was found attempts to resuscitate him failed. So I
9 just wanted to take a moment of silence in honor of the fellow
10 who was killed last night at Prudhoe Bay.
11 If there are no other preliminary comments then I'll ask
12 Dr. Winton Aubert to come and testify.
13 DR. AUBERT: Thank you. Good morning. For the record I'm
14 Winton Aubert, senior engineer in the Commission Staff. Today
15 we're proposing a change to Title 20, Chapter 25 of the Ala;~ka
16 Administrative Code which is a repeal and readoption of Section
17 120 of the Commission regulations entitled well abandonment
18 marker.
19 Our proposed repealed and readoption of Section 120 is
20 presented on the Commission's motion to clarify the required
21 dimensions, configuration and placement of a well abandonment
22 marker and eliminate abandonment marker post use.
23 The current Commission well abandonment marker
24 requirements were enacted before the general availability o:E
25 such technologies as the global positioning system instead

relying on magnetic metal detection capability of the day.
The currently specified abandonment marker plate
configuration also unfortunately allows significant physical
stress to be exerted on marker plates as water freezes and ice
expands and abandonment marker posts can obviously constitute
surface hazards.
Finally we believe today's change to Section 120 will not
effect industry's regulatory burden.
ACTING CHAIRMAN FOERSTER: Thank you, Dr. Aubert.
Commissioner Norman, do you have any questions, comments for
our.....
COMMISSIONER NORMAN: The only question I have, I'm
thinking about existing marker plates posts which if they are a
hazard the question goes to retroactivity of this requirement.
Is it the intent that we require retrofitting of these if there
are posts protruding?
DR. AUBERT: Do we are not suggesting that current marker
posts be retrofitted and fortunately there are not many of them
in the state.
COMMISSIONER NORMAN: Thank you. That's the only question
I I have.
ACTING CHAIRMAN FOERSTER: So my only question is a
procedural question for our attorney, is it appropriate for us
to vote on these or do we consider them for a future hearing
and move on them (ph).....

20 AAC 25.120 is repealed and readopted to read:
20 AAC 25.120. Well abandonment marker. The exact surface location of an abandoned
onshore well must be shown by a steel well abandonment marker plate that must:
(a) be at least 1 /4 inch thick;
(b) be welded to, and must cover the outermost casing string (including conductor);
(c) not extend beyond the outermost casing string; and
(d) have the following information bead-welded directly to the marker plate:
(1) the name of the operator that plugged and abandoned the well;
(2) the number that the commission has, under 20 AAC 25.040(b), assigned to the
Permit to Drill for the well;
(3) the name designated for the well by the operator under 20 AAC 25.005(f);
(4) the API number for the well, with any suffix appended to the number under 20
AAC 25.005(f).
