A copy of the Nicolai Creek Field Plan is attached as Exhibit 1. Notice of public hearing to be held on December 20, 2001 was published in the Anchorage Daily News. A public hearing was held on Aurora Gas, LLC's Field Plan on December 20, 2001. No testimony was received. The Nicolai Creek Field Plan contains a voluntary agreement by Aurora Gas to use its best efforts to employ residents of this state, consistent with law, and to contract with firms in this state for work in connection with the development of the field, whenever feasible. NOW, THEREFORE, IT IS ORDERED that Aurora Gas, LLC's Nicolai Creek Field Plan is approved pursuant to AS 31.05.030(1). (~ Description of Best Effarts to Employ Residents of the State and to Cnntraet with Firms of the State: To date Aurora Cias has no employees in the field, other than intermittent supervisors or engineers, and has no immediate plans to hire employees for the development of this Field. However, should plans change and Aurora Gas decide to hire employees for the development or operation of the Field, Aurora will use its best eflforts to emplay residents ~rf the State of Alaska, consistent with law. Currently contractors do most work; and to date most contractors have been "firms m the state." For example, the three contractors doing the rr~st work (on a cost basis} for the No. 3 well development were all "firms in the state": Pear Oilfield Service Co., Inlet Drilling Alaska, Inc., and Fairweather E & P Services. In excess of 90°l0 of the fabr~cat~on and almost 100°l0 of the installation of facilities were done by Alaska-based companies .Aurora's policy is: a) to hire residents of the State whenever such candidates far an open position are available, well qualified, and competitive in wages or salary requirements, and b} to use local firms to contract development work whenever these firms are competitive in price anti service. During the pl~~rrning stages of development work, contractors, including some Alaska firms, are contacted to solicit proposals, with cost estimates or bids, for each facet of the work. Contractors are chosen based upon evaluation of the puce and quality of services expected. The fabrication and installation work required for the development of this Fieldis limited in scale, and it is expected that Alaskan firms will have the resources required and can be competitive for most of it. AS 31.05.030(1) requires the Commission to hold a public hearing on the plan and within 45 days after receipt of the plan, grant approval of the plan if the plan contains a voluntary agreement by the lessee to use it best efforts to employ residents of this state consistent with law and to contract with fields in this state for work in connection with the development of the field, including the fabrication and installation of required facilities whenever feasible.
