All within the Kenai Peninsula Borough, Third Judicial District, State of Alaska, and

T16N, R8, 9, 10, 11, 12, 13, 14, 15, 16W
T17N, R7, 8, 9, 10, 11, 12, 13, 14, 15, 16W

All within the Matanuska-Susitna Borough, Third Judicial District, State of Alaska,
2. Pursuant to 20 AAC 25.540, the Alaska Oil and Gas Conservation Commission (Commission)
published notice for public hearing concerning its intention to classify wells drilled within the listed
Townships as likely to have unexpected encounters of oil, gas or other hazardous substances.
Notices were published in the Anchorage Daily News on June 14, 2010, the Frontiersman on June
15, 2010, and the Peninsula Clarion on June 16, 2010.
3. One comment was received from a member of the public, a copy of which is in the record.
4. Commission staff presented testimony at the hearing held on July 27, 2010 at 9:00 am.

FINDINGS:
1. The onshore area of NW Cook Inlet is known to be underlain by laterally extensive coal deposits
beginning near surface;
2. Increasing interest in unconventional energy sources including Underground Coal Gasification
will likely result in exploratory drilling projects to assess the coal resource in the NW Cook Inlet
area;
3. Multiple biogenically sourced natural gas fields exist in this area and throughout Cook Inlet;
4. Drilling records throughout the area have established that natural gas can be encountered at
shallow depth;
5. Multiple natural gas fields have been developed on the west side of Cook Inlet in the designated
Townships and Ranges;
6. Commission records indicate that at least 3 wells have experienced well control problems drilling
at total depths of ~ 1500' or shallower;
7. On May 4, 1965, the Moquawkie # 1 (PTD 165-012) encountered shallow gas and experienced a
blowout and fire while drilling at ~ 1525';
8. On September 28, 2008, the Moquawkie #4 (PTD 207-084) encountered shallow gas and
experienced a blowout while drilling at ~ 900';
9. On May 18, 2010, well CC-4C-10 (no Commission PTD issued) encountered shallow gas and
experienced a kick while drilling at ~ 1320'; and
10. The above wells are all within the Townships listed above.
11. The Commission has no records indicating well control problems have been experienced
shallower than 500'.
CONCLUSION:
1. Based on the findings outlined above, the Commission concludes that sufficient likelihood exists
that wells drilled in the designated Townships could unexpectedly encounter oil, gas or other
hazardous substances below a depth of 500'.
NOW, THEREFORE, IT IS ORDERED:
The Commission hereby designates the area described above as an area in which wells or any borings
into the soil in excess of 500 feet TVD present a sufficient likelihood of an unexpected encounter with
oil, gas or other hazardous substances so as to warrant placing all such wells in these areas under the
Commission's regulatory jurisdiction in accordance with AS 31.05.030 (g). Accordingly, all wells
drilled after the date of this order to depths below 500 feet TVD, within the area described above are
subject to the regulations and requirements of the Commission. This order in no way constitutes
authority to drill for hydrocarbons without prior approval of the Commission.

RECONSIDERATION AND APPEAL NOTICE
As provided in AS 31.05.080(a), within 20 days after written notice of the entry of this order or decision, or such further time as the
Commission grants for good cause shown, a person affected by it may file with the Commission an application for reconsideration of
the matter determined by it. If the notice was mailed, then the period of time shall be 23 days. An application for reconsideration
must set out the respect in which the order or decision is believed to be erroneous.
The Commission shall grant or refuse the application for reconsideration in whole or in part within 10 days after it is filed. Failure to
act on it within 10-days is a denial of reconsideration. If the Commission denies reconsideration, upon denial, this order or decision
and the denial of reconsideration are FINAL and may be appealed to superior court. The appeal MUST be filed within 33 days after
the date on which the Commission mails, OR 30 days if the Commission otherwise distributes, the order or decision denying
reconsideration, UNLESS the denial is by inaction, in which case the appeal MUST be filed within 40 days after the date on which
the application for reconsideration was filed.
If the Commission grants an application for reconsideration, this order or decision does not become final. Rather, the order or
decision on reconsideration will be the FINAL order or decision of the Commission, and it may be appealed to superior court. That
appeal MUST be filed within 33 days after the date on which the Commission mails, OR 30 days if the Commission otherwise
distributes, the order or decision on reconsideration. As provided in AS 31.05.080(b), "[t]he questions reviewed on appeal are
limited to the questions presented to the Commission by the application for reconsideration."
In computing a period of time above, the date of the event or default after which the designated period begins to run is not included in
the period; the last day of the period is included, unless it falls on a weekend or state holiday, in which event the period runs until
5:00 p.m. on the next day that does not fall on a weekend or state holiday.

6 before the Alaska Oil & Gas Conservation Commission. The
7 hearing is being held at the Commission's office at 333 West
8 Seventh Avenue, Suite 100, Anchorage, Alaska.
9 I'll first introduce the bench. To my left is
10 Commissioner Cathy Foerster, the engineering commissioner and
11 my name is John Norman. And our Chair Commissioner Dan
12 Seamount is occupied with another pressing matter today. We do
13 have a quorum and so we will proceed with conduct of business.
14 If anyone here has any special needs that would allow them
15 to participate in the meeting please see the Commission's
16 special assistant Jody Colombie.

2 This particular matter comes before the Commission this
3 morning under Docket No. CO 10 -7. This is a matter that it
4 comes upon the motion of the Commission. The special law that
5 brings it before the Commission is Alaska Statute 31.05.030
6 subsection (g). And briefly stated that is the section of the
7 Alaska law that states that when the Commission anticipates
8 that within a designated area there may be a potential for
9 unexpected encounters of oil and gas or other hazardous
10 substances the Commission may so classify the area following a
11 Public Hearing such as we're having today and, thereafter,
12 regulate the drilling.
13 Notice of this hearing was duly published in the Anchorage
14 Daily News on 14, June, 2010, in the Frontiersmen on 15, June,
15 2010, Peninsula Clarion 16, June, 2010, as well as on the State
16 of Alaska on -line notices and the AOGCC's website. The reasons
17 that it was published both in the Valley and Kenai papers, of
18 course, are that I believe portions of the designated area lie
19 within the Kenai Peninsula area and other portions of the
20 designated area lie within the Mat -Su Borough.
21 The Commission has received one comment from a member of
22 the public. That comment is dated June llth from Mr. Jerry
23 McCutcheon (ph) and if there's no objection that comment will
24 be admitted as part of the record.

1 ACTING CHAIRMAN NORMAN: I think that covers all the
2 preliminaries and Mr. Saltmarsh, you'll be presenting for the
3 Commission?
4 MR. SALTMARSH: Yes.
5 ACTING CHAIRMAN NORMAN: Please proceed.
6 MR. SALTMARSH: My name is Art Saltmarsh. I'm a senior
7 petroleum geologist with the Oil and Gas Conservation
8 Commission. And I've prepared a statement and a map so that we
9 can outline and it's clear the outline of the areas that we'd
10 like to designate under that Alaska Statute.
11 There's been an increasing interest in unconventional
12 energy sources which have previously not fallen underneath the
13 AOGCC regulations. Underground Coal Gasification is one of
14 these. Under Alaska Statutes 31.05.030 subsection (g) the
15 Commission proposes to require a drilling permit in the
16 Townships and Ranges listed below for wells drilled to a depth
17 greater than 500 feet that have the potential for unexpected
18 encounters of oil, gas and other hazardous substances.
19 The areas listed below all lie within the known oil and
20 gas provence. I'm not going to go through them, but on the
21 map, if I may, there are two sections. They were broken out
22 according to the Borough that they lie in. This is the Mat -Su
23 Borough Townships and Ranges and this is the Kenai Borough.
24 Historically there have been two shallow blowouts in this
25 area of the west side of Cook Inlet. The Moquawkie #1 on May

1 4th of 1965 encountered shallow gas at a depth of approximately
2 1,525 feet. The well blew out and a fire started causing
3 extensive damage to the rig. Several workers were burned,
4 although none seriously. The fire was extinguished and the
5 blowout stopped with heavy mud.
6 More recently the Moquawkie #4, September 28 of 2008
7 encountered shallow gas at approximately 900 feet and
8 experienced a blowout. Thee was no rig damage. The well was
9 brought under control with heavy drill muds. In each case it
10 appears that the drilling fluid employed was insufficient to
11 overbalance the formation pressures.
12 CIRI recently conducted a five well exploration project on
13 the west side of Cook Inlet near the location of the Coffee
14 Creek #1 well for the purposes of identifying thick coal seams
15 for an Underground Coal Gasification project.
16 When the Coffee Creek well was drilled it was necessary
17 for the operator to employ mud weights over 10 pounds per
18 gallon while drilling at approximately 800 feet and over 10.6
19 pounds per gallon at approximately 2,600 feet in order to
20 suppress and contain formation gases encountered while
21 drilling.
22 While drilling the fourth well, the CC- 4C -10, CIRI in
23 their recent exploration project, CIRI encountered shallow gas
24 at approximately 1,320 feet resulting in the expulsion of 2,000
25 gallons of brackish drilling fluid in the wellbore. The BOP's

1 were closed and the well was brought under control with 12
2 pounds per gallon mud and then successfully cemented. Records
3 indicate that approximately 3,100 units of gas was also
4 released.
5 Due to the high likelihood of encountering gas while
6 drilling the proposed wells, Senior Staff at the AOGCC worked
7 with the Coal Regulatory group at DNR to ensure that proper
8 BOPE, blowout prevention equipment, and sufficient heavy weight
9 drilling muds were employed on the project.
10 Underground Coal Gasification currently falls under the
11 regulatory control of the Coal Regulatory group at DNR which
12 issues permits for surface coal exploration and extraction.
13 Based on the local stratigraphy, it is possible to
14 encounter thick coals and gas charged sands at very shallow
15 depths in this areas. By designating the Townships and Ranges
16 listed as having the potential for unexpected encounters of
17 oil, gas and other hazardous substances, the AOGCC can ensure
18 that proper drilling practices are utilized for Underground
19 Coal Gasification exploration on the west side of Cook Inlet.
20 The third page I've included is a synopsis of what
21 occurred on May 18th at the #4 -- the fourth well that CIRI was
22 drilling. Is there any questions?
23 ACTING CHAIR NORMAN: Mr. Saltmarsh, I believe in addition
24 to working in the area of petroleum geology and so forth, just
25 for the record so that someone reading the transcript later,

1 you've also had some experience with coal horizons and coal,
2 have you not?
3 MR. SALTMARSH: Yes, I have.
4 ACTING CHAIR NORMAN: Commissioner Foerster?
5 COMMISSIONER FOERSTER: I think the record speaks for
6 itself. No questions.
7 ACTING CHAIR NORMAN: There being no questions before we
8 vote then in order to implement this I -- my assumption is then
9 that we will notify both DNR and CIRI by letter that today the
10 Commission did officially designate this as an area that would
11 be subject to the Commission's regulations so that going
12 forward they will know.
13 Commissioner Foerster, have you put any thought in how
14 well implement this going forward?
15 COMMISSIONER FOERSTER: I think we'll just do it as we're
16 doing, the geothermal wells.
17 ACTING CHAIR NORMAN: Do you know, Mr. Saltmarsh, if there
18 are additional wells planned over there? I'm assuming there
19 are.
20 MR. SALTMARSH: There have been no formal applications
21 that I have heard of yet through DNR, but I have heard that the
22 plan is to commence drilling some time in the early winter and
23 continue their exploration -- an expanded exploration program
24 with additional wells.
25 Although most all of that project is confidential, we have

1 been holding it confidential also so I can't give any details.
2 I don't have them right now any way, but the wells generally
3 are drilling to about 2,000 to about 2,500 feet. I don't know
4 how many wells are planned, but we should be finding that out
5 shortly.
6 ACTING CHAIR NORMAN: Okay.
7 COMMISSIONER FOERSTER: Well, this is the exploration
8 phase of a development project, so
9 MR. SALTMARSH: Yes.
10 COMMISSIONER FOERSTER: unless they wound nothing
11 they're going forward.
12 MR. SALTMARSH: I would presume so, but I'm not privy to
13 CIRI's total plans.
14 COMMISSIONER FOERSTER: Okay.

Cook Inlet RCAC is a nonprofit corporation organized exclusively for the oversight,

Organizations terminal and oil tanker operations, and environmental impacts of oil tanker and oil
terminal operations in Cook Inlet under the provisions of Section 5002 of the Oil
Pollution Act of 1990. Our mission is to represent the citizens of Cook Inlet in

CIRI is moving forward, good. If nobody request a hearing the AOGCC will adopt its
regulations.
CIRI still does not understand C02 injection into an oil reservoir, Cook Inlet Oil platforms,
where the gas was removed prematurely. There is no such thing as C02 injection unless
you have reservoir of C02. EOR, enhance oil recovery, uses the whole flue gas stream,
C02 as well as N2. Why blow money separating out C02 when you can use the entire flue
gas stream and obtain 9 times as much injectable gas. You repressurize the oil reservoir 9
time faster and you get your money back quicker and the profit is lot higher. This C02
mystic is just BS.
Fairbanks is the one to watch both the Air Force and DOE want it and have for more than a
decade. The hold up is ? Somebody should go put it together for them. Any development
that takes place North of or around Anchorage, is money in Anchorages pocket...
Anchorage should not be bashful in helping thy neighbor.

Hole CC-4C-10 Incident Report, May 18, 2010
Approximately 11:30 AM on May 18, 2010, Boart Longyear dayshift drill crew began to pull HQ casing,
they had pulled one 10' length to break the string off the bottom. Per usual operation, they broke the
joint at the foot clamp in order to rig up the break out tool spinner to trip the rods. During this process
the drilling crew experienced a gas blowout, with water spraying to a height of about 10 feet above the
deck, followed by visible gas vapors. The drilling crew initiated blowout prevention measures, closing
the well in accordance with standard operating procedures (i.e., engagement of the blowout prevention
equipment and use of heavy drilling mud).
Following these initial actions, a decision was made to abandon the well by cementing the hole from
bottom (about -1,320') to top, in accordance with well abandonment procedures provided for in the
above referenced permit (the Permit). 920' of HQ casing could not be retrieved during the well
abandonment process and was sealed in place (from -400' to 1320') as part of the cementing process.
The blowout incident and well closure was successfully addressed over the course of four days, with the
use of approximately 8,000 pounds of barite in 12 pound mud and 4,550 pounds of Portland cement in
15 to 16 pound cement.
The incident was reported to CIRI and DNR within 4 hours of the incident, and both parties were kept
informed on subsequent actions of the drilling crew. No personnel were injured or equipment
damaged. During the blowout, initial gas readings were not recorded, and an approximate 2,000 gallons
of brackish water escaped the well during the incident, with no resulting harm to the surrounding
environment. During well closure activities, approximately 3100 units of gas were measured by the
mudloggers. All activity was contained within the drill pad area, which will be restored in accordance
with restoration requirements of the Permit.
The actions of the crew and performance of the blowout prevention equipment were reviewed by AES
management, in consultation with senior management at Boart Longyear. Based on that review it was
determined that the crews' actions were correct prior to and after the blowout and that the blowout
prevention equipment functioned properly.
