By application received April 4, 2012, the North Slope Borough (NSB), acting through its agent, Petrotechnical Resources Alaska, Inc. (PRA), requested amendment of Conservation Order 274, to add 1 -1/2 governmental sections to the Walakpa Gas Pool. The Walakpa Gas Pool is located in the North Slope Borough, Alaska. 2. Pursuant to 20 AAC 25.540, the Alaska Oil and Gas Conservation Commission (AOGCC) scheduled a public hearing for May 29, 2012. On April 16, 2012 the AOGCC mailed printed copies of the notice to all persons on the AOGCC' s mailing distribution list, published notice of the opportunity for that hearing on the State of Alaska's Online Public Notice website and on the AOGCC' s website, and electronically transmitted the notice to all persons on the AOGCC's email distribution list. On April 22, 2012, the notice was published in the Alaska Journal of Commerce. 3. The NSB is the landowner, owner and operator of the Walakpa Field and the Walakpa Gas Pool. On April 4, 2012, by certified mail, PRA sent notice of the application to Ukpeagvik Inupiat Corporation (UIC), surface owner for the Walakpa Field area. PRA provided the AOGCC the notice, date of mailing, and the addresses to which the notice was sent. 4. No protest to the application or request for hearing was received. 5. Because PRA provided sufficient information upon which to make an informed decision, the request can be resolved without a hearing. 6. The tentatively scheduled public hearing was vacated on May 23, 2012. FINDINGS: 1. Governing Orders: Conservation Order No. 274 (CO 274) defines and governs the Walakpa Gas Pool. Administrative Amendment CO 274.001 revised the well spacing requirements of CO 274, eliminating well spacing restrictions except within 1500' of an external property line where ownership and landownership changes. t Conservation Order No. 274A • • Page 2 September 4, 2012 2. Affected Area: CO 274 established the Walakpa Gas Pool Affected Area, which lies onshore, approximately 15 miles south - southwest of Barrow, Alaska. That Affected Area is: UMIAT Meridian (U.M.) Township and Range Sections T2ON, R2OW 11, 12, 13, 14, 23, 24, 25, 26, 35, and 36. T2ON, R19W 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, 31, 32, 33, 34, 35, and 36. 3. Operator: The NSB is operator for the Walakpa Gas Field and the Walakpa Gas Pool. 4. Owners and Landowners: The NSB is the subsurface landowner and owner for the Walakpa Gas Field and the Walakpa Gas Pool. UIC is surface owner. 5. Proposed Amendment: PRA's application seeks to amend CO 274 by adding Section 22, T2ON, R2OW, U.M. and the northern one -half of Section 27, T2ON, R2OW, U.M. to the Affected Area. Recently drilled horizontal gas production well Walakpa No. 13 lies within the southern half of Sections 22 and 23, T2ON, R2OW, U.M. Section 27 is located immediately south of, and adjacent to, Section 22, T2ON, R2OW, U.M. Since the issuance of CO 274, drilling of the Walapka No. 13 well has revealed that the boundaries of the Walapka Gas Pool are greater than originally believed. CONCLUSIONS: 1. An amendment to the existing Governing Orders is appropriate because the Walakpa No. 13 well demonstrates that the Affected Area of the Walakpa Gas Pool is greater than originally believed. 2. Correlative rights of owners and landowners of offset acreage will be protected by the 1500 - foot set -back requirement established by CO 274.001. 3. The proposed expansion of the Affected Area of the Walakpa Gas Pool will not promote waste or jeopardize correlative rights, is based on sound engineering and geoscience principles, and will not result in an increased risk of fluid movement into freshwater. If the notice was mailed, then the period of time shall be 23 days. An application for reconsideration must set out the respect in which the order or decision is believed to be erroneous. The AOGCC shall grant or refuse the application for reconsideration in whole or in part within 10 days after it is filed. Failure to act on it within 10 -days is a denial of reconsideration. If the AOGCC denies reconsideration, upon denial, this order or decision and the denial of reconsideration are FINAL and may be appealed to superior court. The appeal MUST be filed within 33 days after the date on which the AOGCC mails, OR 30 days if the AOGCC otherwise distributes, the order or decision denying reconsideration, UNLESS the denial is by inaction, in which case the appeal MUST be filed within 40 days after the date on which the application for reconsideration was filed. If the AOGCC grants an application for reconsideration, this order or decision does not become final. Rather, the order or decision on reconsideration will be the FINAL order or decision of the AOGCC, and it may be appealed to superior court. That appeal MUST be filed within 33 days after the date on which the AOGCC mails, OR 30 days if the AOGCC otherwise distributes, the order or decision on reconsideration. Since the pool rules (and the subsequent amendment to those rules) do NOT have a general Administrative Amendment clause, AOGCC must schedule a tentative public hearing. While we are at it, AOGCC can also update these 1991 - vintage rules if you feel it is needed. Please review Rules 4 through 7 of the attached CO, and let me know if any of you see a need to update any of the rules. I'd like to publish the Notice of Public Hearing on Friday, so I'II need your recommendations by 11AM tomorrow. The NSB is currently drilling additional development wells in the Walakpa Gas Field. Petrotechnical Resources Alaska (PRA) has been retained by the NSB to provide technical and management services for this project. New Walakpa wells #11 and #12 already have been completed in the eastern portion of the field. Drilling of the Walakpa #13 well (Permit To Drill No. 211 -157) is underway and targets the Walakpa Gas Pool in the western portion of the field. The wellbore extends into Section 22 of Township 20 North, Range 20 West, Umiat Meridian. Section 22 is not included in the current Pool Rules Area for the Walakpa Gas Pool. The NSB requests that all of Section 22 and the north half of Section 27 of T 20N, R 20W, UM be added to the Pool Rules area of the Walakpa Gas Pool. Enclosed is a copy of the well logs (field print) and the directional survey from the Walakpa #13 well indicating that the well penetrated the Walakpa Gas Pool in Section 22, as well as in the western portion of Section 23. Section 23 is already included in the Pool area. The NSB waives 1 1 Page 2 C.O. 274, Walakpa Pool Rules April 4, 2012 the confidentiality of the Walakpa #13 well logs and directional data submitted with this request. We expect the Walakpa #13 well to be finished drilling within the next 7 days and completed for regular production soon thereafter. The NSB is the owner of the oil and gas rights in Sections 22 and 27 and is the operator of the Walakpa Gas Field.
