By letter received March 26, 2013, Hilcorp Alaska, LLC (Hilcorp) requests an amendment to clarify Conservation Order No. 648 (CO 648) to allow recompletion, testing, and regular production of Beluga Formation reservoir sands within the Susan Dionne No. 7 (SD 7) development gas well within 3,000 feet of, and in the same governmental section as, wells that are, or maybe capable of, producing from the same pool. 2. On March 22, 2013, by certified mail, Hilcorp sent notice of the application to all owners, landowners, and operators of all properties within 3,000' of the SD 7 well. Hilcorp provided the Alaska Oil and Gas Conservation Commission (AOGCC) the notice, date of mailing, addresses to which the notice was sent, and proof of certified mailing. 3. A public hearing was scheduled for May 14, 2013. On April 9, 2013, the AOGCC mailed printed copies of the notice of the opportunity for public hearing to all persons on the AOGCC's mailing distribution list, published notice of the opportunity for that hearing on the State of Alaska's Online Public Notice website and on the AOGCC's website, and electronically transmitted the notice to all persons on the AOGCC's email distribution list. On April 10, 2013, the notice was published in the ANCHORAGE DAILY NEWS. 4. No protest to the application or request for hearing was received. 5. The tentatively scheduled public hearing was vacated on May 10, 2013. 6. Because Hilcorp provided sufficient information upon which to make an informed decision, the request can be resolved without a hearing. Order 648A • • May 31,2013 Page 2 of 3 FINDINGS: 1. The SD 7 development gas well is located within the Ninilchik Unit, which lies along the eastern coastline of the Cook Inlet, Kenai Peninsula Borough, Alaska. Marathon Alaska Production LLC (Marathon) was the original owner and operator for SD 7 and the Ninilchik Unit. On February 1, 2013, Hilcorp became owner and operator of the unit and the well. 2. SD 7 is an onshore, deviated development gas well with a surface location 206' from the south line and 3,624' from the west line of Section 6, T1S, R13W, Seward Meridian (S.M.). The bottom -hole location is 409' from the south line and 877' from the east line of Section 12, T1S, R14W, S.M. 3. CO 648, approved by the AOGCC on May 24, 2011, authorizes exceptions to 20 AAC 25.055(a)(4) to allow drilling, completion, testing, and regular production of the SD 7 well. CO 648 addresses gas reservoirs within the Tyonek Formation (Tyonek). CO 648 does not mention gas reservoirs within the overlying Beluga Formation (Beluga). 4. Marathon drilled SD 7 during 2011. In September 2012, the well was completed in the SD Tyonek Undefined Gas Pool and regular gas production began. SD 7 was shut in during February 2013. 5. Hilcorp plans to recomplete SD 7 to test and regularly produce gas from Beluga reservoirs. 6. SD 7 may open Beluga reservoirs that lie within 3,000' of development gas wells Susan Dionne 5, Susan Dionne 6, Paxton 2, and Paxton 4. SD 7 may open Beluga reservoirs within the same governmental section as Susan Dionne 5 and Susan Dionne 6. 7. Hilcorp's application seeks to clarify CO 648 by specifying that the exceptions granted to 20 AAC 25.055(a)(4) apply to Tyonek and Beluga gas reservoir sands. 8. In the Ninilchik Unit area, Beluga reservoir sands are thin, laterally discontinuous, and encapsulated by impermeable claystone and siltstone layers. 9. SD 7 is located within State of Alaska lease ADL- 387372 and Cook Inlet Region, Inc. (CIRI) lease C- 061505, which are owned and operated by Hilcorp. 10. Other potentially affected owners, landowners, and operators within a 3,000' radius of the well are the State of Alaska, Department of Natural Resources (DNR); CIRI; University of Alaska; Kenai Peninsula Borough; and 14 individuals. Hilcorp sent notice of its application to these entities and individuals by certified mail on March 22, 2013 and provided the AOGCC with copies of the Certified Mail Receipts. 11. The AOGCC received no comments, objections, or protests in response to Hilcorp's application. CONCLUSIONS: 1. Recompletion of SD 7 to test and produce Beluga gas reservoirs will maximize resource recovery by developing reserves that are inaccessible to Hilcorp's other existing wells. 2. An amendment to CO 648 is needed to clearly state that the exceptions granted to 20 AAC 25.055(a)(4) apply to Tyonek and Beluga gas reservoir sands. • 411 Order 648A May 31, 2013 Page 3 of 3 3. Amendment of CO 648 is consistent with sound engineering and geoscience principles and will not result in waste. NOW THEREFORE IT IS ORDERED: Hilcorp's March 26, 2013 application for an amendment to CO 648 allowing completion, testing, and regular production of the SD 7 development gas well in Beluga and Tyonek reservoir sands is hereby approved. Hilcorp may proceed with testing and regular production from SD 7 as long as it complies with the terms of the Ninilchik Unit Agreement, applicable Alaska laws, and all other legal requirements. If the notice was mailed, then the period of time shall be 23 days. An application for reconsideration must set out the respect in which the order or decision is believed to be erroneous. The AOGCC shall grant or refuse the application for reconsideration in whole or in part within 10 days after it is filed. Failure to act on it within 10 -days is a denial of reconsideration. If the AOGCC denies reconsideration, upon denial, this order or decision and the denial of reconsideration are FINAL and may be appealed to superior court. The appeal MUST be filed within 33 days after the date on which the AOGCC mails, OR 30 days if the AOGCC otherwise distributes, the order or decision denying reconsideration, UNLESS the denial is by inaction, in which case the appeal MUST be filed within 40 days after the date on which the application for reconsideration was filed. If the AOGCC grants an application for reconsideration, this order or decision does not become final. Rather, the order or decision on reconsideration will be the FINAL order or decision of the AOGCC, and it may be appealed to superior court. That appeal MUST be filed within 33 days after the date on which the AOGCC mails, OR 30 days if the AOGCC otherwise distributes, the order or decision on reconsideration. As provided in AS 31.05.080(b), "[t]he questions reviewed on appeal are limited to the questions presented to the AOGCC by the application for reconsideration." We're concerned that the existing spacing exemption was limited to the Tyonek and may not cover our plans to recomplete this well in the Beluga. As a result, we've prepared an application to amend CO 648 to allow for the proposed perforations. Former Unit Operator, Marathon Oil Company ( "MOC "), drilled and completed SD -7 in 2011. Numerous intervals were perforated in the Tyonek Formation between 8,314 — 11,605' (MD) and subsequent testing indicated no commercial gas production.' MOC obtained only gamma ray and resistivity Togs over the open hole section from surface to 7000' total depth, so accurate pay definition in the Beluga Formation above 7000' was not possible. As successor Unit Operator, Hilcorp has reviewed SD -7's well log data and determined that the shallow Beluga Formation sands may have commercial gas potential. On February 2, 2013, Hilcorp submitted an Application for Sundry Approval (Form 10- 403) to isolate the Tyonek perforations with a cemented bridge plug, cut and pull the existing tubing, then run new tubing and packer completion to test the shallow Beluga interval. AOGCC subsequently approved Hilcorp's application on February 13, 2013. Upon closer review, Hilcorp is now concerned that the spacing exception granted under Conservation Order 648 may have been limited to SD -7's original completion within 1 To date, all reported production of SD -7 has been from the Susan Dionne- Paxton Participating Area, Tyonek Undefined Pool. Therefore, to the extent required, Hilcorp requests that the Commission amend Conservation Order No. 648 to permit the re- completion, testing, and regular production of SD -7 from the Beluga Formation. To date, no special Pool Rules have been established within the Ninilchik Unit, and all gas produced within the Susan Dionne - Paxton Participating Area has been reported as either "SD Tyonek Undefined" (Field Pool Code 562560) or "SD Beluga Undefined" (Field Pool Code 562550). Therefore, statewide spacing regulation, 20 AAC 25.055(a)(4) is controlling. This regulation provides: If gas has been discovered, the drilling unit of the pool is a governmental section; not more than one well may be drilled to and completed in that pool on any governmental section; a well may not be drilled or completed closer than 3,000 feet to any well drilling to or capable of producing from the same pool. The surface and bottom -hole location of SD -7 are described in Conservation Order 648 as 3624' FWL, 206' FSL of Section 6, R13W, Seward Meridian (S.M.), and 877' FEL and 409' FSL of Section 12, T1S, R14W, SW, respectively. The proposed perforation interval is unchanged from that described in the approved Application for Sundry Approval and falls within Section 7, T1S, R 13W and Section 12, T1S, R14 W. The location of SD -7 and its relationship to adjoining properties and wells within 3000' is depicted in Exhibit A. As demonstrated by this plat, other wells with perforations at the Beluga -135 level inside the 3000' radius include: Paxton 2, Paxton 4, Dionne 5 and Dionne 6. Based on geological and engineering data available to Hilcorp, it is apparent that the Beluga sandstones within the 3000' radius of SD -7 are particularly discontinuous and unpredictable, that they drain small areas (^'40 to 60 acres), and that the proposed development of SD -7 is necessary to maximize recovery of gas from the Beluga Formation. See Exhibits B and C (confidential). As demonstrated above, the correlative rights of all affected owners, landowners and operators will be protected by amendment to Conservation Order 648 to allow SD -7 to be completed within the Beluga Formation. If the proposed well completion is successful, and produces gas from the Beluga Formation in commercial quantities, Hilcorp anticipates expanding the existing Susan Dionne Paxton Participating Area and submitting proposed Pool Rules to formally define both the Tyonek and Beluga Formations. • • Ninilchik Unit Application to Amend CO 648 March 22, 2013 Page 3 of 8 Hilcorp, as Operator, owns a 100% working interest in the Ninilchik Unit. At the date of this mailing, a copy of this proposed amendment was sent by certified mail to the all affected landowners. Should AOGCC find that Conservation order 648 allows for the completion of SD -7 in the Beluga Formation, no further action is required.
