IT APPEARING THAT: Docket CO-12-40 Conservation Order No. 123B Swanson River Field Swanson River Unit Soldotna Creek Unit Hemlock Oil Pool August 28, 2013 1. By letters received October 25 and November 8, 2012, Hilcorp Alaska, LLC (Hilcorp) requests an order from the Alaska Oil and Gas Conservation Commission (AOGCC) to clarify the area affected by Conservation Order No. 123A (CO 123A), modify well spacing requirements of that order, and modify the rule that allows the order to be changed administratively. 2. On November 13, 2012, by certified mail, Hilcorp sent notice of the application to all owners, landowners, and operators of all properties within 3,000'of the Swanson River Field boundary. Hilcorp provided to AOGCC the notice, date of mailing, addresses to which the notice was sent, and proof of certified mailing. 3. Pursuant to 20 AAC 25.540, the AOGCC tentatively scheduled a public hearing for January 3, 2013. On November 20, 2012, the AOGCC mailed printed copies of the notice of the opportunity for public hearing to all persons on the AOGCC's mailing distribution list, published notice of the opportunity for that hearing on the State of Alaska's Online Public Notice website and on the AOGCC's website, and electronically transmitted the notice to all persons on the AOGCC's email distribution list. On December 2, 2012, the notice was published in the ALASKA JOURNAL OF COMMERCE. 4. No protest to the application or request for hearing was received. 5. AOGCC vacated tentatively scheduled public hearing on December 31, 2012. 6. On January 12, 2013, the AOGCC tentatively scheduled a second public hearing for February 26, 2013 in order to provide clear public notice that Hilcorp's letter of November 8, 2012 seeks to extend revised spacing requirements to all wells and all horizons within the field, in addition to those requests presented in Item 1, above. On January 20, 2012, the AOGCC mailed printed copies of the notice of the opportunity for public hearing to all persons on the AOGCC's mailing distribution list, published notice of the opportunity for CO 123B • • August 28, 2013 Page 2 of 6 that hearing on the State of Alaska's Online Public Notice website and on the AOGCC's website, and electronically transmitted the notice to all persons on the AOGCC's email distribution list. On January 18, 2013, the notice was published in the ANCHORAGE DAILY NEWS. 7. No protest to the application or request for hearing was received. 8. The tentatively scheduled public hearing was vacated on February 25, 2013. 9. Because Hilcorp provided sufficient information upon which to make an informed decision, the request can be resolved without a hearing. FINDINGS: 1. Operator: Hilcorp is the operator of the Swanson River Field, Swanson River Unit, and the Soldotna Creek Unit, which are located on the east side of the Cook Inlet, Kenai Peninsula Borough, Alaska. 2. Affected Area: The Swanson River Field —the Affected Area —lies onshore, Kenai Peninsula, Cook Inlet Basin. The northern two-thirds of the Swanson River Field are also known as the Swanson River Unit, and the southern one-third of the field is also known as the Soldotna Creek Unit. Owners and Landowners: Hilcorp is owner of the Swanson River Field. The U.S. Department of the Interior, Bureau of Land Management (BLM) and Cook Inlet Region, Inc. (CIRI) are landowners for the Swanson River Field. A single pooling agreement governs Swanson River Field.' 4. Pool Identification: Conservation Order No. 123A defines the Hemlock Oil Pool as all intervals which correlate with the interval 10,085' and 10,815' in the Standard Oil Company of California's (SOCAL) Soldotna Creek Unit No. 41-4 well.2 5. Exploration and Production History: The Hemlock Oil Pool within the Swanson River Unit was discovered in 1957 by the Swanson River Unit No. 13 well and confirmed by Swanson River Unit No. 24 in 1958 and Swanson River Unit No. 4A5 in 1959. Regular production from this portion of the Hemlock Oil Pool began in October 1958 and continues today. To date, 32 wells have produced oil from the Hemlock Oil Pool within the Swanson River Unit. The Hemlock Oil Pool in the Soldotna Creek Unit was discovered by Soldotna Creek Unit No. 41-42 in March 1960 and confirmed by the Soldotna Creek Unit No. 32-046 and No. 14- 047 wells in June and August 1960. Regular production from this portion of the Hemlock Oil 'Pooling Agreement for the Swanson River Field, Alaska; U.S. Department of the Interior, Geological Survey, Memorandum to Chief, Branch Oil & Gas Operations, dated December 28, 1964 2 API No. 50-133-10109-00-00; subsequently renamed Soldoma Creek Unit No. 341-04 by SOCAL circa 1967 3 Subsequently renamed Swanson River Unit No. 3 4- 10 4 Subsequently renamed Swanson River Unit No. 331-27 5 Subsequently renamed Swanson River Unit No. 14-15 6 Subsequently renamed Swanson River Unit No. 332-04 Subsequently renamed Swanson River Unit No. 314-04 CO 123B • • August 28, 2013 Page 3 of 6 Pool began in August 1960 and continues today. At present, 79 wells have produced oil from the Hemlock Oil Pool within the Soldotna Creek Unit. 6. Regulatory History: Conservation Order No. 5, issued November 25, 1960, approved a spacing pattern of 80 acres per well for reservoir development wells drilled in all pools of the Hemlock Zone within the limits of the Swanson River Field for a period of 18 months. Conservation Order No. 8, approved May 11, 1962, established the permanent spacing pattern of 80 acres per well for the Hemlock Zone within the field. Conservation Order No. 9, approved May 11, 1962, authorized injection of natural gas for pressure maintenance purposes into the Hemlock Zone of the Swanson River Field through specified wells. Conservation Order No. 123 (CO 123), approved August 23, 1973, defined the Hemlock Oil Pool within the Swanson River Field as all intervals that correlate with the interval from 10,230' to 10,585' in SOCAL's SCU 41-4 well and established pool rules to govern development. CO 123 Rule 5, Spacing Acreage, specified not more than two completed wells in any governmental quarter section, and Rule 6 specified that that no well shall be completed less than 500' from the exterior boundary of the Swanson River Field Working Interest Agreement Area. Between 1974 and 1982, eight Administrative Approvals were issued granting exceptions to CO 123 Rule 5, Spacing Acreage. Conservation Order No. 123A (CO 123A), approved December 5, 1995, expanded the Hemlock Oil Pool vertically to all intervals that correlate with the interval from 10,085' to 10,815' in SOCAL's SCU 41-4 well. The expanded pool includes the overlying G Zone of the Tyonek Formation and the underlying lower Hemlock sands HI through H15. CO 123A did not alter the well spacing requirements of CO 123. Between 2000 and 2012, three Administrative Approvals were issued granting exceptions to CO 123A Rule 5, Spacing. For all other hydrocarbon -bearing horizons within the Swanson River Field, statewide regulation 20 AAC 25.055 governs well spacing and specifies notification by certified mail of potentially affected owners, landowners and operators when a proposed well location will not conform to property -line setback requirements. 7. Application Notification: Hilcorp provided evidence to the AOGCC that the application was sent by certified mail to all affected working interest owners and landowners—i. e. , Cook Inlet Region, Inc. and the U.S. Bureau of Land Management —on November 13, 2012. 8. Proposed Change to the Well Spacing Requirements: Hilcorp's revised letter of application requested the AOGCC modify well spacing requirements to remove spacing restrictions except that no well shall be completed less than 500' from the exterior boundary line of the Affected Area. Hilcorp also requested the AOGCC expand the modified well spacing requirements to include all wells and all horizons within the Swanson River Field. 9. Proposed Change to the Affected Area: Hilcorp's revised letter of application requested the AOGCC modify the Affected Area of this order to conform to Hilcorp's map of the combined area of the Swanson River and Soldotna Creek Units that accompanied the revised letter of application! 8 Hilcorp Alaska, LLC, (Revised) Proposed Second Amendment to Conservation Order No. 123A, Letter of Application, dated November 8, 2012, Exhibit A. Proposed Change to the Administrative Approval Rule: Hilcorp's revised letter of application requested the AOGCC modify the text of Rule 7 of CO 123A to authorize any reasonable operation designed to maximize the recovery of oil and all other hydrocarbons in the Swanson River Field and to allow administrative changes to the boundaries of the Affected Area. CONCLUSIONS: 1. The Hemlock Oil Pool within the Swanson River Field is a mature, producing pool. 2. Revising well spacing provisions for the Hemlock Oil Pool within the Affected Area will increase the operator's flexibility when placing wells to optimize resource recovery. Revising well spacing provisions for the Hemlock Oil Pool will not promote waste, jeopardize correlative rights, or result in an increased risk of fluid movement into freshwater. 3. Changing well spacing requirements for other oil or gas pools or reservoirs within the Swanson River Field is unwarranted at this time as Hilcorp provided no supporting geologic or engineering evidence to show that proposed change will not promote waste, jeopardize correlative rights, or result in an increased risk of fluid movement into freshwater. 4. Correlative rights of owners and landowners of offset acreage will be protected by a 500-foot property line set -back requirement for the external boundary of the Affected Area that conforms with regulation 20 AAC 25.055(a)(1). 5. The ability to administratively change the external boundary of the Affected Area is not warranted. The notification requirements of 20 AAC 25.055 and 20 AAC 25.540 protect the correlative rights of owners and landowners of adjacent acreage who may be impacted by proposed changes to the Affected Area. NOW THEREFORE IT IS ORDERED: Hilcorp's November 8, 2012 application for an order modifying the well spacing and Administrative Action provisions of CO 123A is approved for the Hemlock Oil Pool within the Affected Area specified below. Hilcorp may proceed as long as it complies with the terms of the Pooling Agreement for the Swanson River Field, the Swanson River and Soldotna Creek Unit Agreements, applicable Alaska laws, and all other legal requirements. CO 123B • August 28, 2013 Page 6 of 6 Rule 7 Administrative Action (Source: CO 123A, revised this order) Upon proper application, or its own motion, and unless notice and public hearing are otherwise required, the AOGCC may administratively waive the requirements of any rule stated herein or administratively amend this order as long as the change does not promote waste or jeopardize correlative rights, is based on sound engineering and geoscience principles, and will not result in an increased risk of fluid movement into freshwater. Foerster Chair, Commissioner I.kill III II JJIVllcl RECONSIDERATION AND APPEAL NOTICE As provided in AS 31.05.080(a), within 20 days after written notice of the entry of this order or decision, or such further time as the AOGCC grants for good cause shown, a person affected by it may file with the AOGCC an application for reconsideration of the matter determined by it. If the notice was mailed, then the period of time shall be 23 days. An application for reconsideration must set out the respect in which the order or decision is believed to be erroneous. The AOGCC shall grant or refuse the application for reconsideration in whole or in part within 10 days after it is filed. Failure to act on it within 10-days is a denial of reconsideration. If the AOGCC denies reconsideration, upon denial, this order or decision and the denial of reconsideration are FINAL and may be appealed to superior court. The appeal MUST be filed within 33 days after the date on which the AOGCC mails, OR 30 days if the AOGCC otherwise distributes, the order or decision denying reconsideration, UNLESS the denial is by inaction, in which case the appeal MUST be filed within 40 days after the date on which the application for reconsideration was filed. If the AOGCC grants an application for reconsideration, this order or decision does not become final. Rather, the order or decision on reconsideration will be the FINAL order or decision of the AOGCC, and it may be appealed to superior court. That appeal MUST be filed within 33 days after the date on which the AOGCC mails, OR 30 days if the AOGCC otherwise distributes, the order or decision on reconsideration. As provided in AS 31.05.080(b), "[t]he questions reviewed on appeal are limited to the questions presented to the AOGCC by the application for reconsideration." In computing a period of time above, the date of the event or default after which the designated period begins to run is not included in the period; the last day of the period is included, unless it falls on a weekend or state holiday, in which event the period runs until 5:00 p.m. on the next day that does not fall on a weekend or state holiday. Hilcorp proposes to delete any restriction on the number or spacing of wells, but does not seek to alter the prohibition against any well being completed less than 500 feet from the Swanson River Field exterior boundary line. Hilcorp proposes to expand the scope of Rule 7, which allows administrative changes to the rules or geographic area affected by Conservation Order No. 123A. The AOGCC has tentatively scheduled a public hearing on this application for February 26, 2013 at 9:00 a.m. at the Alaska Oil and Gas Conservation Commission, at 333 West 71' Avenue, Suite 100, Anchorage, Alaska 99501. To request that the tentatively scheduled hearing be held, a written request must be filed with the AOGCC no later than 4:30 p.m. on February 4, 2013. I assume this is not an issue, but wanted to check with you before we went forward with adding perforations in this well. According to the agreement, consolidated operation of the entire Swanson River Field was deemed necessary for the most efficient and economic operation of a gas repressuring program to recover the maximum amount of unitized substances and prevent waste of natural resources. HilcoT Alaska, LLC ("Hilcorp"), as Operator, respectfully requests administrative action be taken by the Commission to eliminate well spacing requirements within 500 feet from the exterior boundary of the Swanson River Field, and also to clarify the area to which such rules apply. Rule No. 5 of Conservation Order No. 123A (August 23, 1773, as amended, December 5, 1995) currently limits the number of wells in any given governmental quarter section to two (2) wells. There shall be no restriction as to well spacing except that no No well shall be completed less than 500 feet from the Swanson River- Field Working 1n4er-est Agreement Afe exterior boundary line of the Swanson River Field, as defined in Rule 2. The Swanson River Field is a mature field with a complex administrative history. Discovery occurred in 1957, followed by development and first production in 1958. To date, 126 development and service wells have been drilled. The field consists of two federally -administered units, the Swanson River Unit and the Soldotna Creek Units, which were consolidated into a single operating area in 1964. See Conservation Order 123, Rule 2 (1973). This same definition of the Swanson River Field was utilized in 1995, when the order was amended to expand the Tyonek G-zone and Lower Hemlock intervals to the Hemlock Oil Pool. See Conservation Order 123A, Rule 2 (1995). 1 Conservation Order 123A, Rule 7 (Administrative Approval) provides that "[ulpon request of the Operator and showing that all affected parties have been notified of such request, the Committee may authorize any operation reasonably designed to further the progress of the project and maximize the recovery of oil from the Hemlock Oil Pool in the Swanson River Field." Swanson River Field 0 (Revised) Proposed Conservation Order Amendment November 8, 2012 Page 2 of 3 As currently drafted, Rule 2 describes the area to which applicable rules apply in both geographic terms ("the combined area of the Swanson River and Soldotna Creek Units") and by legal descriptions (i.e., metes and bounds). However, both the 1973 and current 1995 version of Rule 3 also define the Hemlock Oil Pool stratig_raphically as "...all intervals which correlate with the interval 10,085 feet to 10,815 feet in the Stand Oil Company of California, Soldotna Creek unit 41-4 well." In order to give clear meaning to the 500 foot well spacing buffer required by Rule 5, Hilcorp proposes to clarify the definition of the "Swanson River Field" as follows: Rule 2: Area to Which these Rules apply These rules apply throughout the Swanson River Field, which is comprised of the combined area of the Swanson River and Soldotna Creek Units, as illustrated on Exhibit A. However, they will clarify that the 500 foot buffer required by Rule 5 applies to all wells and all horizons within the Swanson River Field, and eliminate any erroneous reference that such spacing rules only apply to wells targeting production from the Hemlock Oil Pool. Finally, Hilcorp proposes to amend Rule 7 (Administrative Approval), as follows: Rule 7: Administrative Approval Upon the request of the Operator and a showing that all affected parties have been notified of such request, the Committee Commission may authorize any operation reasonable designed to further the progress of the project and maximize the recovery of oil and all other hydrocarbons from the uomieek Oil Pool in the Swanson River Field. Dear Commissioner Foerster, Hilcorp Alaska, LLC ("Hilcorp"), as Operator of the Swanson River Field, hereby requests administrative action be taken by the Commission to eliminate well spacing requirements within the boundary of the Swanson River Field, Hemlock Oil Pool, yet maintain the 500 feet setback from the exterior boundary of the Swanson River Field.' This action is necessary to maximize recovery from this mature field. Approval of this proposed amendment will reduce filings associated with future spacing exceptions and will result in administrative efficiencies for both the Operator and the Commission. Pool Rule No. 5 of Conservation Order No. 123A, Swanson River Field, Hemlock Oil Pool (August 23, 1773, as amended, December 5, 1995) currently limits the number of wells in any given governmental quarter section to two (2) wells. The proposed amendment is as follows: Rule 5: Spacing No more than two eempleted wells are allowed in any gevet:mnental quai4er- seefien. There shall be no restriction as to well spacing except that no No well shall be completed less than 500 feet from the Swanson River Field - Working Interest Agreement Area exterior. The Hemlock Oil Pool includes all intervals which correlate with the interval 10,085 feet to 10,815 feet in the Soldotna Creek unit ("SCU") 41-4 well. This pool was first established by Conservation Order No. 123 on August 23, 1973. On December 5, 1995, the Commission expanded the Hemlock Oil Pool to include the G zone of the Tyonek ' Conservation Order 123A, Rule 7 (Administrative Approval) provides that "[u]pon request of the Operator and showing that all affected parties have been notified of such request, the Committee may authorize any operation reasonably designed to further the progress of the project and maximize the recovery of oil from the Hemlock Oil Pool in the Swanson River Field." Swanson River Field Proposed Conservation Order Amendment October 10, 2012 Page 2 of 2 Formation and the lower portion of the Hemlock Formation.2 The purpose of this expansion was to "prevent waste, protect correlative rights and improve ultimate recovery from the Swanson River Field."3 The Swanson River Field is a mature field Discovery occurred in 1957, followed by development and first production in 1958. To date, 126 development and service wells have been drilled to the pool. Hilcorp estimates that the remaining reserves available from the pool cannot be captured through continued reliance on existing wellbores and unit infrastructure. Hilcorp's current development program seeks to maximize remaining reserves by targeting un-drained portions of the pool that cannot be reached by wells conforming to current spacing restrictions. Less restrictive spacing requirements will help to maximize recovery from this faulted and stratigraphically variable pool, while allowing for continued production from established development wells. Retention of the existing 500 foot buffer from the external boundary of the Swanson River Field will protect the correlative rights of adjoining or nearby property owners.
