REGULATIONS OF THE ALASKA OIL AND GAS CONSERVATION COMMISSION
The attached three pages of regulations, dealing with repeal of outdated, unnecessary, or
duplicative provisions, are certified to be a correct copy of the regulation changes that the Alaska
Oil and Gas Conservation Commission adopted at its June 3, 2020 meeting, under the authority
of AS 31.05.030 and after compliance with the Administrative Procedure Act (AS 44.62),
specifically including notice under AS 44.62.190 and 44.62.200 and opportunity for public
comment under AS 44.62.210.
This action is not expected to require an increased appropriation.
On the record, in considering public comments, the Alaska Oil and Gas Conservation
Commission paid special attention to the cost to private persons of the regulatory action being
taken.
The regulation changes described in this order take effect on the 30th day after they have been
filed by the lieutenant governor, as provided in AS 44.62.180.

The Department of Law has reviewed the attached regulations of the Alaska Oil and Gas
Conservation Commission against the statutory standards of the Administrative Procedure Act.
Based upon our review, we find no legal problems. This memorandum constitutes the written
statement of approval under AS 44.62.060(b) and (c) that authorizes your office to file the
attached regulations. The regulations were adopted by Alaska Oil and Gas Conservation
Commission after the close of the public comment period. The regulations concern the repeal of
outdated, unnecessary, or duplicative provisions, and also make conforming changes.

The November 3, 2019 public notice and the June 18, 2020 certification of adoption order
both state that this action is not expected to require an increased appropriation. Therefore, a
fiscal note under AS 44.62.195 is not required.

The Alaska Oil and Gas Conservation Commission (AOGCC) has repealed outdated, unnecessary,
or duplicative provisions of 20, AAC 25.005(c)(3), 20 AAC 25.035(a), 20 AAC 25.037, 20 AAC
25.047, 20 AAC 25.225, 20 AAC 25.245, 20 AAC 25.320, 20 AAC 25.260, 20 AAC 25.527(a)
and 20 AAC 25.528.
The Lieutenant Governor signed and filed the regulation changes on June 25, 2020, with an
effective date of June 25, 2020.
The regulations will appear in Register 235, October 2020, of the Alaska Administrative Code.

NOTICE OF PROPOSED REPEALED
REGULATIONS OF ALASKA OIL AND GAS CONSERVATION COMMISSION
The Alaska Oil and Gas Conservation Commission proposes to repeal regulation changes in 20
AAC 25. of the Alaska Administrative Code. The Commission proposes to repeal 20 AAC
25.037 well control requirements for other drilling and completion operations; 20 AAC 25.047
reserve pits and tankage; 20 AAC 25.225 potential of gas wells; 20 AAC 25.245 common
production facilities; 20 AAC 25.260 illegal production, 20 AAC 25.528 open pit storage of oil
and 20 AAC 25.320 filing of forms.
These regulations are proposed to be repealed. The intended effect of these repeals is to
eliminate outdated, unnecessary or duplicative regulations. A more detailed description can be
found on the AOGCC website https://www.commerce.alaska.jzov/web/aogcc/Home.aVxx.
You may comment on the proposed regulation changes, including the potential costs to private
persons of complying with the proposed changes, by submitting written comments to Jody
Colombie at 333 West 7a' Avenue, Anchorage, Alaska 99501. Additionally, the Alaska Oil and
Gas Conservation Commission will accept comments by facsimile at (907) 276-7542 and by
electronic mail at aogcc.customer.svc(cbalaska.gov. Comments may also be submitted through

5 This notice of the hearing was published in the

17 On January 22, 2019 the Office of the Governor
18 requested all agencies identify regulations that could
19 be repealed or amended that would increase efficiencies
20 and streamline government, yet not impact health and
21 safety. The following seven regulations were
22 determined by the AOGCC to be either outdated,
23 unnecessary, duplicative or covered adequately in other
24 sections or redundant of 20 AAC 25 and could be
25 eliminated.

1 Now I'm going to run through these proposed
2 repealed -- proposed repealing of the following
3 regulations, there's seven of them, but I'm going to be
4 fairly brief. I'm going to make a motion to make a
5 more comprehensive list available in the record of
6 those regulations that we'll be repealing. It is
7 available on our website. So at that time I'm going to
8 reference that document. The title is AOGCC Proposed
9 Regulatory Changes.

14 record. So in brief summary here are the following
15 reqs for repeal.
16 20 AAC 25.225, potential of gas wells. This
17 requirement prescribes a specific testing method for
18 gas wells prior to production. The regulation is
19 outdated. Repealing it would remove an unnecessary
20 testing and reporting burden for the operator.
21 20 AAC 25.037, well control requirements for
22 other drilling and completion operations. This
23 allowance for ultimate well control procedures is
24 duplicative as it is covered in other sections of 20
25 AAC 25.

The following regulations are proposed for repeal:
• 20 AAC 25.225. Potential of Gas Wells.
o This regulation requires that all gas wells be tested by a multi -point back -pressure
method before regular production. Test results and calculations must be reported
to the commission on the Gas Well Open Flow Potential Test Report within 30
days.
o This requirement is outdated. These reports are not used by the AOGCC in any
decision-making capacity. Eliminating the requirement for them and only
requiring the operator submit a test report, in whatever format they normally
receive them, if they choose to conduct one, would remove an unnecessary testing
and reporting burden from the operator.
20 AAC 25.037. Well control requirements for other drilling and completion
operations.
o This regulation gives the AOGCC authority to approve alternate well control
procedures and equipment than what is required under 20 AAC 25.033 (Primary
Well Control for Drilling), 20 AAC 25.035 (Secondary Well Control for Primary
Drilling and Completion: Blowout Prevention Equipment and Diverter
Requirements), and 20 AAC 25.036 (Secondary Well Control for Through -
Tubing Drilling and Completion: Blowout Prevention Equipment Requirements),
if the procedures and equipment in place are adequate to maintain well control.
o This section is unnecessary and duplicative as it is covered adequately in other
sections. Specifically, 20 AAC 25.0330), 20 AAC 25.035(h), and 20 AAC
25.036(f) all provide opportunities for variances from the above mentioned well
control requirements.
20 AAC 25.047. Reserve Pits and Tankage.
o This regulation requires prior to drilling, the construction of a reserve pit or
installation of a storage tank for the collection and confinement of drilling fluids
and cuttings. The regulation further requires the operator to leave the reserve pit
in a condition that is not a hazard to freshwater.
o This regulation is outdated and outside the authority of AOGCC and is more
substantively covered by ADEC regulations. ADEC regulates the storage of
drilling waste (18 AAC 60.430), drilling waste monofills (18 AAC 60.432), and
closure of inactive reserve pits (18 AAC 60.440).
o ADEC has confirmed to AOGCC that they do not refer to 20 AAC 25.047.
Specifically, 18 AAC 60.430 requires a storage plan to be submitted to ADEC at
least 30 days in advance of beginning operations. Storage may not begin until the
storage plan is approved. ADEC's storage plan must include:
■ Responsible parties for conducting the drilling activity
■ Location and type of storage container
■ Plans and material specs of container
■ Methods to prevent discharge of drilling waste
■ Location transferred drilling waste
• Anticipated dates of storage and removal
■ Location of ultimate disposal of drilling waste
■ Certification that waste will be removed from property no later than one
year from permit issuance
• 20 AAC 25.245. Common Production Facilities.
o This regulation allows common production facilities from any number of wells or
pools to be used if appropriate measuring equipment is installed so that
production from each well can be determined by the AOGCC.
o This regulation is redundant with requirements for custody transfer measurement
(.228) and allocation measurement (.230) and can be eliminated completely.
20 AAC 25.260. Illegal production.
o This regulation prohibits anyone from producing or transporting crude oil or
natural gas when in violation of the regulations and orders of the commission.
o This is extremely vague and overly broad. AOGCC would benefit from greater
flexibility through utilizing emergency actions using authority under 20
AAC25.539 and through our robust enforcement program than a rigid regulation.
20 AAC 25.528. Open Pit Storage of Oil.
o This regulation provides, in an emergency, the ability for an operator to store
crude oil in an open earth containment or in an open receptacle.
o There is no specific statute that applies to AOGCC providing authority for this
regulation. ADEC would be the more appropriate agency of jurisdiction.
• 20 AAC 25.320. Filing of Forms.
o If a form is to be filed or submitted, this regulation requires original signatures
with exception, along with appropriate copies.
o This regulation is unnecessary and can be better handled by a guidance document.
• 20 AAC 25.037. Well control requirements for other drilling and
completion operations. This allowance for alternate well control procedures
is duplicative as it is covered in other sections of 20 AAC 25.
• 20 AAC 25.047. Reserve Pits and Tankage. This regulation is outdated as
operators no longer use reserve pits. Regardless, ADEC has statutory
authority and comprehensive regulations over the collection and disposal of
drilling fluids and cuttings.
• 20 AAC 25.245. Common Production Facilities. This regulation is

• 20 AAC 25.260. Illegal production. This regulation is unnecessary and

efficiencies and streamline government, yet not impact health or safety. The

Subject: Public Notice Regulations R-19-001
The Alaska Oil and Gas Conservation Commission proposes to repeal regulation changes in 20 AAC 25. of the Alaska
Administrative Code. The Commission proposes to repeal 20 AAC 25.037 well control requirements for other drilling and
completion operations; 20 AAC 25.047 reserve pits and tankage; 20 AAC 25.225 potential of gas wells; 20 AAC 25.245
common production facilities; 20 AAC 25.260 illegal production, 20 AAC 25.528 open pit storage of oil and 20 AAC 25.320
filing of forms.
These regulations are proposed to be repealed. The intended effect of these repeals is to eliminate outdated, unnecessary
or duplicative regulations. A more detailed description can be found on the AOGCC website
