BRIEF DESCRIPTION
The Alaska Oil and Gas Conservation Commission (AOGCC) has amended 20 AAC.25.030(c)(3).
The proposed change is in response to the AOGCC conducting a statewide review of wells and
finding that the regulation needed to be amended to add the phrase "below the base of permafrost'.
The Lieutenant Governor signed and filed the regulation changes on June 18, 2018, with an
effective date of July 18, 2018.
The regulations will appear in Register 227, October 2018, of the Alaska Administrative Code.

the Alaska Oil and Gas Conservation Commission adopted at its March 7, 2018 meeting, under
the authority of AS 31.05 and after compliance with the Administrative Procedure Act

Surface Casing and Permafrost
We have reviewed the attached Alaska Oil and Gas Conservation Commission
regulations against the statutory standards of the Administrative Procedure Act. Based upon our
review, we find no legal problems. This memorandum constitutes the written statement of
approval under AS 44.62.060(b) and (c) that authorizes your office to file the attached
regulations.
The regulations were adopted by the commission after the close of the public comment
period. The regulations concern requiring that surface casing be cemented below the base of
permafrost.
The November 7, 2017 public notice and the March 7, 2018 certification of adoption
order both state that this action is not expected to require an increased appropriation. Therefore, a
fiscal note under AS 44.62.195 is not required.
We have made a minor technical correction to conform the regulations in accordance
with AS 44.62.125 as shown on the attached copy of the regulations.

NOTICE OF PROPOSED CHANGES ON CASING AND CEMENTING REGULATION
IN THE REGULATIONS OF ALASKA OIL AND GAS CONSERVATION COMMISSION
The Alaska Oil and Gas Conservation Commission proposes to adopt the following change to 20 AAC
25.030 of the Alaska Administrative Code, dealing with Casing and Cementing:
(1) 20 AAC 25.030(c)(3) is proposed to be changed to add the requirement that surface casing
must be set below the base of permafrost.
You may comment on the proposed regulation change, including the potential costs to private persons of
complying with the proposed change, by submitting written comments to Jody J. Colombie at 333 West 7"
Avenue, Anchorage, Alaska 99501. Additionally, the Alaska Oil and Gas Conservation Commission will
accept comments by facsimile at (907) 276-7542 and by electronic mail at jody.colombienn alaska.gov. The
comments must be received not later than 5:00 p.m. on December 20, 2017.
A hearing on the proposed change will be held on January 4, 2018 at 333 West 71' Avenue, Anchorage,
Alaska 99501. The hearing will be held at 10:00 a.m. and might be extended to accommodate those present
before 10:15 a.m. who did not have an opportunity to comment. Oral or written comments may be submitted
at the hearing.
You may submit written questions relevant to the proposed action to Jody J. Colombie,
jodv.colombie@alaska.gov and 333 West 7" Avenue, Anchorage, Alaska 99501. The questions must be
received at least 10 days before the end of the public comment period. If deemed relevant to the proposed
change, the Alaska Oil and Gas Conservation Commission will address the questions at the hearing. If you

4 meeting to order, please, we'll come to order. It's
5 about 10:02 in the morning of January the 4th, 2018.
6 We're at the headquarters of the AOGCC at 333 West
7 Seventh Avenue. To my right is Commissioner Foerster,
8 to my left is Commissioner Seamount, I'm Hollis French,
9 also a Commissioner.
10 If any person's here who may have a need for
11 special accommodations -- I don't think we have that, I
12 don't think that's applicable.
13 Computer Matrix will be recording the
14 proceedings. Upon completion and preparation of the
15 transcript, persons desiring a copy will be able to
16 obtain it by contacting Computer Matrix. Today we
17 are proposing to adopt changes to Title 20, Chapter 25,
18 of the Alaska Administrative Code. The hearing is
19 being held in accordance with AS 44.62 and 20 AAC
20 25.540 of the Alaska Administrative Code, regulations
21 governing public hearings. The hearing of course will
22 be recorded.
23 The main thing I want to put on the record
24 before we start is that when we take up questions of
25 regulations we're always to keep in mind the cost to

1 private persons of the proposed regulatory action.
2 So that's the -- those are the ground rules.
3 We are amending 20 AAC 25.030(c)(3) which
4 pertains to casing and cementing. We are adding to
5 that regulation the phrase, below the base of
6 permafrost. So that's the proposed regulation.
7 Do we want to have -- do we want to build a
8 record and have somebody comment on why we're doing
9 that, Commissioners?
10 COMMISSIONER FOERSTER: Sure. I'll comment.
11 CHAIR FRENCH: Okay. Thank you.
12 COMMISSIONER FOERSTER: We had an incident with
13 a couple of BP wells that had -- well, one BP well that
14 had casing -- surface casing set above the base of the
15 permafrost. And because of the rest of the well
16 construction geometry that created a breach in
17 mechanical integrity. So we've done a statewide review
18 -- North Slope wide review of other wells and found a
19 few have similar construction, but not identical. One
20 had identical and that well's been shut-in. The other
21 ones with similar have been reviewed thoroughly and
22 there's nothing to cause us to have the concern that
23 they will have similar mechanical integrity issues.
24 But just to ensure we don't have other wells
25 with potential for this problem we are adding to our

1 regulations that surface casing must be set below the
2 base of the permafrost because of the fact that this
3 casing being set in the permafrost was one of the
4 critical factors that created the mechanical integrity
5 breach.

The Alaska Oil and Gas Conservation Commission proposes to adopt the following change to 20 AAC
25.030 of the Alaska Administrative Code, dealing with Casing and Cementing:
(1) 20 AAC 25.030(c)(3) is proposed to be changed to add the requirement that surface casing
must be set below the base of permafrost.
You may comment on the proposed regulation change, including the potential costs to private persons of
complying with the proposed change, by submitting written comments to Jody J. Colombie at 333 West 7°i
Avenue, Anchorage, Alaska 99501. Additionally, the Alaska Oil and Gas Conservation Commission will
accept comments by facsimile at (907) 276-7542 and by electronic mail atjody.colombie agalaska.gov. The
comments must be received not later than 5:00 p.m. on December 20, 2017.
A hearing on the proposed change will be held on January 4, 2018 at 333 West 7" Avenue, Anchorage,
Alaska 99501. The hearing will be held at 10:00 a.m. and might be extended to accommodate those present
before 10:15 a.m. who did not have an opportunity to comment. Oral or written comments may be submitted
at the hearing.
You may submit written questions relevant to the proposed action to Jody J. Colombie,

IN THE REGULATIONS OF ALASKA OIL AND GAS CONSERVATION COMMISSION
The Alaska Oil and Gas Conservation Commission proposes to adopt the following change to 20 AAC
25.030 of the Alaska Administrative Code, dealing with Casing and Cementing:
(1) 20 AAC 25.030(c)(3) is proposed to be changed to add the requirement that surface casing
must be set below the base of permafrost.
You may comment on the proposed regulation change, including the potential costs to private persons of
complying with the proposed change, by submitting written comments to Jody J. Colombie at 333 West 7°i
Avenue, Anchorage, Alaska 99501. Additionally, the Alaska Oil and Gas Conservation Commission will
accept comments by facsimile at (907) 276-7542 and by electronic mail at jodv. colombiegalaska.gov. The
comments must be received not later than 5:00 p.m. on December 20, 2017.
A hearing on the proposed change will be held on January 4, 2018 at 333 West 7'h Avenue, Anchorage,
Alaska 99501. The hearing will be held at 10:00 a.m. and might be extended to accommodate those present
before 10:15 a.m. who did not have an opportunity to comment. Oral or written comments may be submitted
at the hearing.

We are requesting that you open a new file for a regulation project regarding Casing and
Cementing, 20 AAC 25.030 for Alaska Oil and Gas Conservation Commission.
