The Hamilton Brothers Oil Company submitted an application dated March 17, 1969, for an exception to the well spacing provisions of Section 2061(a) of the Oil and Gas Conservation Regulations for the referenced well. 2. The No. 1 Point Storkersen well will be drilled as an exploratory test. 3. The referenced well location is 240 feet west of the west line of U.S.S. 4044, an unleased tract withdrawn by the Federal Government for military purposes under P.L.O. 1571. 4. The Federal Government is the only affected party. 5. Notice of the hearing on the request was published in the Anchorage Daily' News on March 21, 1969, pursuant to Section 31.05.050 of the Alaska Statutes. m, 6. The Federal Government stated it would interpose no objection to the granting of the exception provided that certain conditions are imposed on the applicant. AND IT FURTHER APPEARING THAT the conditions proposed by the Federal Government are reasonably necessary for the protection of the correlative rights of the affected party. AND IT FURTHER APPEARING THAT an exception to Section 2061(a) of the Oil and Gas Conservation Regulations permitting the Hamilton Brothers Oil Company to drill the referenced well at the described location should be granted. CONSERVATION ORDER NO. 72 Page 2 April 9, 1969 NOW, THEREFORE, IT IS ORDERED that the Hamilton Brothers Oil Company be permitted to drill the No. 1 Point Storkersen well at a location 500 feet from the south line and 500 feet from the west line of Section 7, T12N, R14E, U.Mo, provided that: (a) all well data be provided on a confidential basis to the Regional Oil and Gas Supervisor, U.S. Geological Survey, Anchorage, Alaska, and (b) prior to the sale of any production, sufficient acreage around the well be unitized or pooled. However, in the event that operators in the spacing unit are unable to agree on unitization or pooling, the Committee will issue an order regulating production to assure that the applicant will produce no more than a just and equitable share of the oil and gas in the pool. That all well data be provided on a confidential basis to the Regional Oil and Gas Supervisor, Geological Survey, and 2. a stipulation be included that in the event a com- mercial well is obtained sufficient acreage around the well will be unitized, cormaunitized or pooled prior to the sale of any production.
