IT APPEARING THAT:
1. Union Oil Company of California, operator of the Kenai
Unit, submitted an application dated December 13, 1979,
requesting an exception to the 3000 foot minimum distance
between completions' requirement of Title 11, Alaska
Administrative Code, Section 22.055(a)(3) for the Kenai
Unit KBU No. 41-7 well.
2. The Kenai Unit KBU No. 41-7 well has been vertically
drilled from.a surface location that is 185 feet from
the north line and 4303 feet from the west line of
Section 7, T4N, RllW, SM.
3. The subject well has been drilled into the middle Beluga
gas sands and the upper Tyonek gas sands.
4. The referenced well is to be dually completed in the
middle Beluga gas sands, which are about 2850 feet from
the same sands open to production in Kenai Unit KBU No.
13-8 well, and in the upper Tyonek gas sands, which are
about 2300 feet and about 2500 feet respectively from
the Kenai Unit KDU No~ I and KDU No. 2 wells where the
same sands are open to production.
5. The gas. bearing sands in the upper, middle and lower
Beluga Formation are not currently defined as gas pools.
The Kenai Tyonek Gas Pool 1 is defined as the accumula-
tion of gas common to the accumulation in an interval of
the Tyonek formation in the ~Kenai Unit KDU #1 well.
6. The referenced well is located at a structural position
that will allow for increased gas production and could
increase ultimate recover if all of the gas bearing
sands are not continuous.
7. Notice of the application was published in the Anchorage
Daily News on December 15, 1979.
8. There was a protest to the application and a public
hearing was held on December 27, 1979 at the office of
the Commission. There was no evidence presented in
opposition to the application.
FINDING:
The Kenai Gas Field has a great number of defined and
undefined gas-bearing sands. There have been a sufficient number
of wells drilled to adequately define the structure at various
stratigraphic levels. The well data indicates that the various
sands thicken and thin in short distances. The proposed well has
been drilled and the evidence indicates that gas-bearing sands
are present in the Beluga and Tyonek formations.
CONCLUSION:
The requested exception to Title 11, Alaska Administrative
Code, Section 22.055(a)(3) will not decrease the ultimate recovery
of gas in the Kenai Field and could increase the recoverable
reserves in the field. The exception would not affect correlative
rights since they are adequately protected in the Kenai Unit.
NOW, THEREFORE, IT IS ORDERED THAT:
The Kenai Unit KBU No. 41-7 well may be completed and
produced at the proposed location in Section 7, T4N, RllW, S.M.
DONE at Anchorage, Alaska and dated December 31, 1979..

This is a hearing of the Alaska Oil and Gas Conservation
Ccmmission
I'm Hoyle Hamilton, Chairman of the Ccxmmission
At my immediate left is Harry Kugler, Cc~nmissioner, to his
left is Jeff Lowenfels, Assistant Attorney General and to my
immediate right is Lonnie Smith, Cc~ssioner.
This hearing is a result of a protest received frcm the
applicant Union Oil' s request for an exception, spacing
exception, in the Kenai Unit Field for their 41-7 well. A
notice was filed in the newspaper December 15 advertising
the request for this exception. A protest was received on
December 24 during the 10-day protest period frcm
Mr. Jerry McCutcheon and at this time I would like to ask
Mr. McCutcheon' s nature of his protest.
Is there going to be any presentation by Union?
There's no prepared presentation, by Union.
Union does not intend to make a presentation
No. We're going to listen to your nature of your protest
first.
Alright no that didn't answer my question Union does not
intend to make a presentation?
If they're called on they're here to answer questions, yes.
Then at this juncture which you want to do is hear frcm me
is that correct? And that's all you're interested in.
Alright First of all I received the notice on Dec. 17 no it
was mailed frcm this office on Dec. 17 received by me on
Dec. 21st late in the afternoon. I called here and was
referred to Mr. Hamilton and made a verbal protest at that
time-this is now late Friday afternoon. Monday morning
which was the 24th I came to see Mr. Kugler. Mr. Kugler
wasn't here and I delivered my written protest at that time;
in fact the oral protest I returned the 21st, the afternoon
of the 24th I beg your pardon, and at that juncture there
was still no information available at that time. Again on
the 26th I returned for what time that was available to me
and got what information I can. Now ah so we all understand
it very clearly, you're here at Mr. Lowenfels' request. My
protest is over the lack of time, study etc. And I was

quite willing yesterday afternoon to make a short statement
and go out and use a typewriter, hand it in writing; that
this was withdrawal of my request for hearing. So I suppose
Mr. Low~nfels doesn't have much else to do. So we're here
now that apparently we've got more than me now involved. I
understand the Alaska Center for the Environment is going to
be involved, that the Ombudsman also is going to be involved
that one state agency is now become involved, so I've been
told, ah and its unfortunate we have to tangle your well up
in the question of appropriate timing for opportunity to
respond. So what was being presented here with was an
acccmplished fact; your drilling on the hole, you're already
there, you're doing it. Ah, you knew at the time that the
procedure would be rubber stamped. 5~f objection here is the
lack of time for study or preparation and since there is no
tiros for preparation I can make no presentation as to what
my objections are or even determine what they may or may not
even be. I don't know whether the reservoir is being
properly managed or not being managed or whether it's of a
gut and run operation or what it is. It's just simply not
sufficient time. I request a rehearing after sufficient
time has been granted and I also request an equal
opportunity to correct those tapes like you and the oil
companies do after the hearing, before you publish a
transcript. With that I'm through.

Is anybodys correlative rights in the Kenai gas field being
impaired by your request, Mr. Anderson?
Mr. Commissioner not to my knowledge its a unitized
operation and the well is within, well within, the middle of
the field ah if it were on the boundary, exterior boundary,
there could be other affected parties but certainly ah being
where its located ah no I can't see that anyone and all of
the operators have been notified.

Working interest owners in the unit have been notified.

answer this question but will there be any loss in ultimate
recovery in the Kenai gas field frcr~the drilling of this
well.

Steve Lambert, I'm the Reservoir Engineer for the field.
The drilling of the well, 41-7, should actually improve the
recovery frcm the field. Several of the sands in the field
are lenticular in nature and often discontinuous and is
believed this well will tap sands which are not currently
being produced by existing wells.
I'd like the record to reflect that the so called protestor
Mr. McCutcheon leftthe msetingduring the recess and has
not reappeared.
Did he indicate to anybody during recess that he would
reappear?
He indicated that he was through talking and he was going to
leave andthat he had said all that he was going to say and
he had nothing else to say and he was going to leave.

I would like to have the record reflect that you were here
Mr. Chairman on the 24th
Yes I'd like to review the sequence of events in relation to
Mr. McCutcheon' s testimony. He, as I recall, stated that
when he was here Monday the 24th and turned in his written
protest there was no one to help him in the office. I was
here personally all day along with one of the engineers on
the staff and the geologists plus about half of our clerical
staff. He did not ask for any assistance. He asked for
Fran Jones who is our librarian who was on annual leave but
he did not ask anyone else for any assistance or did not
give the nature of what he wanted. But we were here to
assist him if he had so requested.
I'd like to further make the record, too, that on December
the 26th, in the afternoon, that Mr. McCutcheon was here and
examined the data and by oral ccmmunication he indicated
that he would like to drop his protest and the Commission,
upon legal advise, determined that we'd better proceed with
the hearing and that is why we're having the hearing today.

I basically was going through mail y~sterday-Peg Tileston,
Alaska Center for the Envinronment and all of a sudden saw
that this notice had come in the week before the holidays
and called to see if indeed there was a meeting ccming up
and was informed indeed there was. I came basically for
information and now might be a good time to mention a
request possibly. I think there are a number of people in
the c~ty who are interested in whats happening in terms
of conservation, oil conservation, in place so on so forth.
I think we all suffer frcm a vast lack of understanding
about the technical information, about why in the first
place, the three thousand foot limitation is there. What
are the ramifications of when a request comes in for closer
drilling so on and so forth and maybe at some time if indeed
we, as possibly the organizing body, might get a group of
people together, maybe ten or twelve people, who are
interested in just picking some brains in terms what does it
mean, what are some of the conservation measures, how do
they work; if we could ask your assistance to spread a
little knowledge around. I know I see the legal notices
often times and I think-hunm thats interesting but whats it
mean, where do we go frcm here?
This is Hoyle Hamilton for the record.
The Commission would be glad to cooperate in any way we
could in this respect.
We'll work toward possibly in a couple or three months to
get something pulled together. What kind of time frame do
you have materially? I don't see it as anything more than
an informal give and take session between people who would
like more information.
We really don't need any time well we'll have people
available at anytime for discussions of that nature.

Dear Mr. Kugler:
Union Oil Company as Operator for the Kenai Unit made application
December 13, 1979 for commission approval of a permanent exception to
i.ill AAC 22.055 (a) (3) and approval for multiple completion pursuant to
11AAC 22.210 for the KBU #41-7 well, as more particularly setforth in
said application.
Inorder to prevent economical waste and hardship in rig stand-by time
and other related costs to operator and the well participants, applicant
requests the Commission to grant an emergency order for the completion
and production testing of the Upper Tyonek and Middle Beluga Gas Sands
in the KBU #41-7 well.
The Unit Operator and Unit participants are the °nly affected parties in
this action and no other parties will be adversely affected.

Union Oil Company as Operator for the Kenai Unit hereby applies for an
exception to Title II AAC 22.055 (a) (3), minimum distance between pools
and.'ll AAC 22.210, multiple completion approval for the above captioned
well, presently drilled to 7,290' total depth.
The proposed KBu #41,7, as reflected on the enclosed plat, is to be
completed with dual strings in the Upper Tyonek and Middle Beluga Gas Sands.
The KBU.¢13-8 is c. ompleted in the Upper and Lower Beluga,.a distance of
2,850' from the proposed KBU ¢41~7 Beluga compl, etion. The KDU ¢1 and KDU #2
wells completed in the Tyonek "D" Zone, a distance of. 2,300' and 2,500',
respectively, from the proposed KBU ¢41-7 UpperTyonek undifferentiated
completion.
Applicant requests that the Commission granta permanent exception
order to the distances, completions, and .production from the pools
setforth above in the KBU #'41,7 well.
Only the Operator and Unit participants are affected by this action
and no other parties will be adversely affected.

Notice is hereby given that Union Oil Company of California
has requested the Alaska Oil and Gas Conservation Commission to
issue an order granting an exception for the minimum distance of
3,000 feet between completions requirement of the referenced
regulation. The operator states that the Kenai Unit KBU No. 41-7
well will be dually completed in the Upper Tyonek and Lower
Beluga gas sands. The Kenai Unit KBU No. 13-8 well is completed
in the Upper and Lower Beluga gas sands, a distance of about
2,850 feet from the proposed completion. The Kenai Unit KDU No.
1 and KDU No. 2 wells are completed in the Tyonek gas sands and
are about 2,300 feet and 2,500 feet respectively from the pro-
posed completion. The operator further requests approval to
dually complete the proposed well presently drilled to 7,290 feet
total depth.
Parties who may be aggrieved if the referenced order is
issued are allowed 10 days from the date of this publication in
which to file a protest and a request for a hearing. The place
of filing is the Alaska Oil and Gas Conservation Commission, 3001
Porcupine Drive, Anchorage, Alaska 99501. If such a protest is
timely filed, a hearing on the matter will be held at the above
address at 9:00 AM on December 27, 1979 at which time protestants
and others may be heard. If no such protest is timely filed, the
Commission will consider the issuance of the order without a
hearing.
