FINDINGS: · The Ninilchik No. 1 well was drilled and abandoned by Union Oil Company of California in 1962. · The Ninilchik No. 1 well is located 144 feet from the south line and 1489 feet from the east line of Section 6, TlS, R13W, S.M. The bottom-hole location is 652 feet from the south line and 3081 feet from the east line of Section 6, TlS, R13W, S.M. · Far North 0il and Gas, Inc. claims the right to enter the Ninilchik No. 1 well to explore, produce and remove hydrocarbons by virtue of an oil and gas lease from Clarence L. McCoy, the owner in fee of the mineral rights beneath a nominal 117 acre tract comprising parts of Sections 5, 6 and 7, TlS, R13W, S.M. · The Ninilchik No. 1 well is located 144 feet from the south line of the western portion of the Clarence L. McCoy lease. · Far North Oil and Gas, Inc. states the Ninilchik No. 1 well has potential as a crude oil producer. Conservation Orde?i+' -o. Page 2 August 19, 1985 · Exceptions to spacing requirements can be obtained as provided for in 20 AAC 25.055(b). CONCLUSIONS: · An exception to 20 AAC 25.055(a)(1) is required to re-enter the subject well in order to explore for hydrocarbon production. ~ Should a hydrocarbon pool be discovered by re-entry of the Ninilchik No. 1 well, the Commission must establish a drilling unit for the pool in accord with AS 31.05.100(a) and enforce the protection of correlative rights for the owners in the pool in accord with AS 31.05.100(c). NOW, THEREFORE, it is ordered that: With an approved drilling permit, Far North Oil and Gas, Inc. is permitted to re-enter the Ninilchik No. 1 well to explore for hydrocarbons. If the well proves capable of hydro- carbon production, regular production will not be permitted until the Commission establishes a drilling unit for the pool and issues an order integrating the interests of owners within the drilling unit, absent voluntary integration by the owners. Notice is hereby given that Far North Oil and Gas, Inc. has requested the Alaska Oil and Gas Conservation Commission to issue an order granting an exception to 20 AAC 25.055(a)(1) to provide for the re-entry of the abandoned Ninilchik No. 1 well which is located 144 feet from the property line upon which the well is located. An exploratory well must be 500 or more feet from a property line (20 AAC 25.055(a)(1)) but 20 AAC 25.055(b) provides for an operator to request an exception to the 500 foot s tandback. Parties who may be aggrieved if the referenced order is issued granting the referenced request are allowed 10 days from the date of this publication in which to file a written protest stating in detail the nature of their aggrievement and their request for a hearing. The place of filing is the Alaska Oil and Gas Conservation Commission, 3001 Porcupine Drive, Anchorage, Alaska 99501. If such a protest is timely filed, a hearing on the matter will be held at the above address at 9:00 AM on August 15, 1985 at which time protestants and others may be heard. McCoy. FAR NORTH OIL AND GAS, INC. has the oil and gas lease on this fee simple tract. Union 0tl Company of California originally leased the mineral rights from C. L. McCoy and drilled the we~ (Coastal Drilling Company) between the dates of~O July 1962 and November 2t, 1~62. The well was plugged and abandoned December 2, 1962.
