The referenced location lies 250' from the drilling unit boundary. The referenced regulation requires a location to be a minimum of 500' from the drilling unit boundary. Notice of opportunity for public hearing on this request was published in the Anchorage Daily News on April 29, 1988 pursuant to 20 AAC 25.540. No protest to the application was filed. i · It is prudent to place this location less than 500' from the drilling unit boundary so that the location will lie on an area which is cleared of forest and is contiguous to the road system. CONCLUSION: I · Granting the applicant's request will not result in waste or impair correlative right of affected parties. The application of ARCO Alaska, Inc. for an .exception to 20 AAC 25.055 to permit the drilling of a well in Sec. 1, T5N, R9W, SM. By letter dated April 18, 1988, ARCO Alaska, Inc. has requested the Alaska Oil and Gas Conservation Commission to issue an exemption to 20 AAC 25.055(1) to allow the Moose River No. 1 well to be drilled closer than 500' to the section line. The proposed location is 290'FNL and 250'FWL of Sec. 1, T5N, R9W, SM. A person who may be harmed if the requested order is issued, may file a written protest prior to May 16, 1988 with the Alaska Oil and Gas Conservation Commission, 3001 Porcupine Drive, Anchorage, Alaska 99501, and request a hearing on the matter. ~If the protest is timely filed, and raises a substantial and materi- al issue crucial to the Commission's determination, a hearing on the matter will be held at the above address at 9:00 AM on May 30, 1988, in conformance with 20 AAC 25.540.
