IT APPEARING THAT:
·
ARCO Alaska, Inc (ARCO) submitted an application on
January 18, 1989 requesting an exception to 20 AAC
25.055(a)(3) to permit the penetration by Pt Mclntyre
State #4 well of possible crude oil bearing strata at a
location closer than 500 feet to the boundary of the SW¼ of
Section 11, T12N, R14E, Umiat Meridian.

Notice of hearing on this request was published in the
Anchorage Daily News on January 27, 1989 pursuant to 20 AAC
25.540.
3. No protests to the application were received.
FINDINGS:
·
ARCO proposes to directionally drill Pt McIntyre State #4
from a surface location 1489'FSL and 681'FEL of Section 16,
T12N, R14E, Umiat Meridian to a bottom hole location 500'FSL
and 500'FWL of Section 11, T12N, R14E, Umiat Meridian.
·
Intersection of the proposed wellbore with the top of the
anticipated crude oil bearing strata is projected to be
172'FSL, 6'FWL of Section 11, T12N, R14E, Umiat Merdian.
·
·
Pool rules have not been established which govern well
spacing for the projected crude oil bearing strata.
An exception is necessary to achieve compliance with 20 AAC
25.055(a) (3).
·
An agreement between ARCO Alaska, Inc and BP Exploration
(Alaska), Inc [formerly SAPC] has been made designating ARCO
as operator of the SW¼ of Section 11, T12N, R14E, Umiat
Meridian of State lease ADL-365548.

20 AAC 25.517 requires that correlative rights be protected
prior to development and operation of an oil or gas pool.
CONCLUSION:
Granting a spacing exception to allow drilling of the Pt McIntyre
State #4 well as proposed will not result in waste nor jeopardize
correlative rights.
NOW, THEREFORE, IT IS ORDERED:
ARCO Alaska, Inc's application for an exception to 20 AAC
25.055(a)(3) for the purpose of drilling the Pt McIntyre State #4
well is approved as proposed.

pursuant to 20 AAC 25.055(a)(3) for Pt. Mclntyre State 4.
ARCO Alaska, Inc. by letter dated January 17, 1989, has
requested an exception to 20 AAC 25.055(a)(3). The exception
would allow the Pt. McIntyre State 4 wellbore to penetrate an oil
bearing horizon closer than 500 feet to a quarter section line.
A person who may be harmed if the requested order is issued,
may file a written protest prior to 5:00 pm February 13, 1989
with the Alaska Oil and Gas Conservation Commission, 3001 Porcu-
pine Drive, Anchorage, Alaska 99501, and request a hearing on the
matter. If the protest is timely filed, and raises a substantial
and material issue crucial to the Commission's determination, a
hearing on the matter will be held at the above address at
9:00 am on February 28, 1989 in conformance with 20 AAC 25.540.
If a hearing is to be held, interested parties may confirm this
by calling the Commission's office, (907) 279-1433, after
February 13, 1989. If no proper protest is filed, the Commission
will consider the issuance of the order without a hearing.

Dear Commissioner Chatterton:
ARCO Alaska Inc. ("ARCO") hereby applies for an exception
to the provisions of 20 AAC 25.055 for the drilling of
the Pt. McIntyre #4 Well (the "Well"),for which the
proposed bottomhole location is:
(1) Surface Location: 1489' FSL, 681' FEL, Section
16, Township 12N, Range 14E, Umiat Meridian
(2) Intersection with Top of Productive Interval:
172' FSL, 6' FWL, Section 11, Township 12 N,
Range 14E, Umiat Meridian
(3) Total Depth: 500' FSL, 500' FWL, Section 11,
Township 12N, Range 14E, Umiat Meridian.
The owners and operators of all governmental quarter
sections directly and diagonally offsetting the proposed
location of the Well are ARCO Alaska, Inc., Exxon
Corporation, and Standard Alaska Production Company. The
plat required by the regulation is attached as Exhibit
1. The verification required by the regulation is
attached as Exhibit 2. Copies of the notifications to
the owners and operators, as well as the required
information with respect to mailing are attached in the
package designated as Exhibit 3.

Jon W. Wood, being first duly sworn, upon oath, deposes and
states as follows:
1. My name is Jon W. Wood. I am over 19 years old and
have personal knowledge of the matters set forth herein.
2. I am an Area Landman for the well operator, ARCO
Alaska, Inc.
3. Pursuant to 20 AAC 25.055(b), ARCO Alaska, Inc.
("ARCO"), the well operator, prepared a Notice of Request for an
Exception to the Provision of 20 AAC 25.055. A copy of this
notice is attached hereto as Exhibit A.
4. On January 17, 1989, pursuant to 20 AAC 25.055(b) ARCO
sent a copy of said notice by registered mail to the last known
address of each owner and operator of governmental quarter
sections directly and diagonally offsetting the quarter section
of the proposed location of the oil well. Attached hereto as
Exhibit B is an Affidavit of Mailing of Notice.

Gentlemen:
Pursuant to the requirements of 20 AAC 25.055(b), ARCO
Alaska, Inc. hereby gives notice of a request to the
Alaska Oil and Gas Conservation Commission for an excep-
tion to the spacing requirements of 20 AAC 25.055(a) (3).
ARCO's request, if approved will permit the intersection
of the wellbore of the captioned well with the top of the
Kuparuk formation within 500 feet of the south line and
within 500 feet of the west line of the governmental
section in which the well will be bottomed.
Specifically, the intersection point applied for will be
