(ARCO) submitted an application on October 23, 1989 requesting an exception to 20 AAC 25.055(a)(1) to permit the drilling of Pt. Mclntyre State No. 7 exploratory well closer than 500' from a drilling unit boundary. · Notice of hearing on this request was published in the Anchorage Daily News on December 9, 1989 pursuant to 20 AAC 25.540. 3. No protests to the application were received. 'FINDINGS: · ARCO proposes to drill Pt. McIntyre State No. 7 from a surface location 1512' from the south line and 491' from the east line of Section 16, T12N, R14E, Umiat Meridian, to a bottomhole location 339' from the south line and 1444' from the west line of Section 3, T12N, R14E, Umiat Meridian. · Offset operator/owners Exxon Corporation and BP Exploration (Alaska) Inc have been duly notified. · Exxon Corporation as leaseholder of the bottomhole location has designated ARCO as operator for the drilling of Pt. Mclntyre State No. 7. · An exception is necessary to achieve compliance with 20 AAC 25.055(a) (1). · 20 AAC 25.517 provides for integrating the interests of all persons owning an interest in a pool or portion of a pool before commencing regular production of oil or gas. Mclntyre State No. 7 well as proposed will not result in waste nor jeopardize correlative rights. NOW, THEREFORE, IT IS ORDERED: ARCO Alaska, Inc.'s application for an exception to 20 AAC 25.055 for the purpose of drilling the Pt. McIntyre State No. 7 well is approved as proposed. ARCO Alaska, Inc by letter dated October 23, 1989, has re- quested an exception to the provisions of 20 AAC 25.055. The exception would allow drilling the Point Mclntyre State No. 7 Well from a location closer than 500 feet from the boundary of a drilling unit. The well will be directionally drilled from a surface location in Section 16, Township 12N, Range 14E of the Umiat Meridian to a bottomhole location in Section 3, T12N, R14E, Umiat Meridian. A person who may be harmed if the requested order is issued, may file a written protest prior to 4:30 pm January 19, 1990 with the Alaska Oil and Gas Conservation Commission, 3001 Porcu- pine Drive, Anchorage, Alaska 99501, and request a hearing on the matter. If the protest is timely filed, and raises a substantial and material issue crucial to the Commission's determination, a hearing on the matter will be held at the above address at 9:00 am February 6, 1990 in conformance with 20 AAC 25.540. If a hearing is to be held, interested parties may confirm this by calling the Commission's office, (907) 279-1433, after Janu- ary 19, 1990. If no proper protest is filed, the Commission will consider the issuance of the order without a hearing.
