IT APPEARING THAT:
I ,
ARCO Alaska, Inc. submitted an application dated February 5,
1992 requesting an exception to 20 AAC 25.055(a)(3) to allow
drilling the ARCO Pt. McIntyre No. P2-49 well closer than 500
feet to a quarter section line.

Notice of hearing was published in the Anchorage Daily News and
the Anchorage Times on February 12, 1992 pursuant to
20 ACC 25.540 and in the Alaska Administrative Journal on
February 17, 1992.
3. One protest to the application was received February 27, 1992.
4. The protest was deemed improper and denied.
FINDINGS:

The ARCO Pt. McIntyre No. P2-49 well as proposed will be
directionally drilled from a surface location 481 feet from the
north line (FNL), 1262 feet from the west line (FWL) of Section
14, T12N, R14E, Umiat Meridian to a bottomhole location 60 feet
FSL, 1220 feet FWL, Section 12, T12N, R14E, Umiat Meridian.

(Alaska) Inc. have been duly notified.

An exception to 20 AAC 25.055(a)(3) is necessary to allow drilling
of the well.
CONCLUSION:
Granting a spacing exception to allow drilling of the ARCO Pt. McIntyre
No. P2-49 well as proposed will not result in waste nor jeopardize
correlative rights.
NOW, THEREFORE IT IS ORDERED:
ARCO Alaska, Inc.'s application for an exception to 20 AAC 25.055 for
the purpose of drilling the Pt. McIntyre No. P2-49 well is approved as
proposed.

Dear Mr. Burglin:
The commission has received your correspondence of February 27, 1992
requesting hearings in the matters of ARCO Pt. McIntyre wells 2-49,
2-50 and 2-56. After reviewing ARCO's applications and your protest,
the commission perceives no harm to any interests on ADL leases 34622
nor 34623 from granting the spacing exceptions. The proposed targets
for all of these wells exceeds the 500 foot standoff from the
aforementioned leases as required by regulation and therefore
correlative rights are protected.
Therefore the ,commission hereby denies your request for hearings
regarding ARCO's applications for spacing exceptions for Pt. McIntyre
wells 2-49, 2-50 and 2-56. Should you have additional evidence to show
actual harm, please contact the commission within 24 hours for
reconsideration of this decision.

Pursuant to the Notice of Public hearing, published February
12, 1992, regarding the.above referenced matter, I am notifying
you that I have an interest, pursuant to Alaska Federal court
case number A90-479 and Texas Federal court ca~e number H-90-
3995~ which may be harmed if the requested exception is
granted. The above referenced lawsuits involve interests in ADLs
34622 and 34623°
Currently, I have insuffi.ient information to allow me to
determine if the granting of this exception would be detrimental
to my interest. I, therefore~ request a hearing in order to
determine .the reason for the 'request for exception, and the
potential harm granting the exception may have on my interest.

ARCO Alaska, Inc. ("ARCO") hereby applies for an exception to the provisions
of 20 AAC 25.055 for the drilling and completion of ARCO's Pt. Mclntyre No.
P2-49 Exploratory Oil Well (the "Well"). The Well will be drilled as a
directional hole with a surface location of 481'FNL and 1262'FWL of Section
14, T12N, R14E, UM. The target location for the well is 42'FSL and 1056'FWL
of Section 12, T12N, R14E, UM and the bottom hole location is 60'FSL and
1220'FWL of Section 12, T12N, R14E, UM. Section 14 is under lease (ADL-
34624) to ARCO and Exxon Corporation as co-leasees. Section 12 is under
lease (ADL-365548) to BI= Exploration (Alaska) Inc..
A plat showing the location of the well, all other completed and drilling wells
on the property, and all other adjoining properties and wells is attached as
Exhibit 1. The names and addresses of all owners and operators of the
governmental quarter sections directly and diagonally offsetting the proposed
drilling unit for the well are set forth in Exhibit 2. Included in Exhibit 3 is the
verification required by the referenced provisions, a copy of the notice sent to
the owners and operators listed in Exhibit 2, and the date such notice was
mailed.

James R. Winegarner, being first duly sworn, upon oath, deposes and states as
follows:
1. My name is James R. Winegarner. I am over 19 years old and have personal
knowledge of the matters set forth herein.
2. I am a General Landman for the well operator, ARCO Alaska, Inc.
3. I am acquainted with the facts associated with the drilling of Pt. Mclntrye No. P2-
49 exploratory oil well.
4. I have reviewed the application submitted for the exception to 20 ACC 25.055.
To the best of my knowledge and belief all facts therein are true and accurate.
5. I have reviewed the plat attached as Exhibit I and it correctly portrays pertinent
and required data.
6. Pursuant to 20 AAC 25.055 (b), ARCO Alaska, Inc. ("ARCO"), the well operator,
prepared a Notice of Request for Exception to the Provision of 20 AAC 25.055. A copy of this
notice is attached hereto.
7. On February 5, 1992, pursuant to 20 AAC 25.055 (b), ARCO sent a copy of said
notice by certified mail to the last known address of all owners and operators of governmental
quarter sections directly and diagonally offsetting the governmental quarter section of the
proposed locations of ARCO's Pt. Mclntyre No. P2-49 well. These names and addresses are
set forth on Exhibit 2 attached to ARCO's Request for Exception to Provisions of 20 AAC
25.055 dated February 5, 1992.

Prudhoe Bay, Alaska
Pursuant to the provisions of 20 AAC 25.055 (b), ARCO Alaska, Inc. hereby gives notice
of a request to the Alaska Oil and Gas Conservation Commission (AOGCC) for an
exception to the well spacing requirements of 20 AAC 25.055.
ARCO's request if approved, will permit the drilling and completion of the Pt. Mclntyre No.
P2-49 well as a directional hole with a surface location of 481'FNL and 1262'FWL of
Section 14, T12N, R14E, UM. The target location for the well is 42'FSL and 1056'FWL of
Section 12, T12N, R14E, UM and the bottom hole location is 60'FSL and 1220'FWL of
Section 12, T12N, R14E, UM. Section 14 is under lease (ADL-34624) to ARCO and
Exxon Corporation as co-leasees. Section 12 is under lease (ADL-365548) to BP
Exploration (Alaska)Inc..
