Conoco, Inc. submitted an application dated March 12, 1993 requesting an exception to 20 AAC 25.055 (a)(3) to allow drilling the Milne Point Unit L-Il development oil well closer than 500 feet to a drilling unit boundary. 2~ Notice of hearing was published in the Anchorage Daily News on March 20, 1993 pursuant to 20 AAC 25.540. 3. No protests to the application were received. FINDINGS: · The Milne Point Unit L-11 well as proposed will be directionally drilled from a surface location 2023 feet from the north line (FNL) and 471 feet from the west line of Section 8, T13N, R10E, Umiat Meridian (UM). The proposed target location is 351 feet FNL and 1081 feet from the east line (FEL) of Section 5, T13N, R10E, UM, and the proposed bottom-hole location is 101 feet from the south line and 839 FEL of Section 32, T14N, R10E, UM. · Offset owners Chevron USA, Inc. and Oxy USA, Inc. have been duly notified. CONCLUSION: Granting a spacing exception to allow drilling of the Milne Point Unit L-11 well as proposed will not result in waste nor jeopardize correlative rights. NOW, THEREFORE, IT IS ORDERED: Conoco, Inc.'s application for an exception to 20 AAC 25.055 for the purpose of drilling the Milne Point Unit L-11 development oil well is approved as proposed. Conoco Inc., Inc. by correspondence dated March 12, 1993, has requested an exception to the provisions of 20 AAC 25.055(a)(3) for the drilling of a development oil well in the Milne Point Unit. The exception would allow drilling the Milne Point Unit L-11 development oil well to a location closer than 500 feet from a quarter section line. A person who may be harmed if the requested order is issued may file a written protest prior to 4:00 pm April 5, 1993 with the Alaska Oil and Gas Conservation Commission, 3001 Porcupine Drive, Anchorage, Alaska 99501, and request a hearing on the matter. If the protest is timely filed and raises a substantial and material issue crucial to the Commission's determination, a hearing on the matter will be held at the above address at 9:00 am on April 20, 1993, in conformance with 20 AAC 25.540. If a hearing is to be held, interested parties may confirm this by calling the Commission's office, (907) 279-1433, after April 5, 1993. The intent of Rule 3 is to provide astandoff of at least 500 feet from the unit boundary to any point of drainage in a wellbore. Therefore, the Commission concurs with your assessment that the proposed program for well MPU L-11 is consistent with the intent of Rule 3. Johnston Chairman Alaska Oil and Gas Conservation Commission 3001 Porcupine Drive Anchorage, Alaska 99501-3192 RE: MPU L-11; REQUEST FOR INTERPRETATION OF AOGCC REGULATIONS Dear Mr. Johnston, Conoco, Inc. requests that the Commission make an interpretation of AOGCC regulations as they relate to our recently submitted Permit To Drill, Form 10-401, for Milne Point Unit development well L-11. The need for this interpretation arises because of a slight deviation in the language of Conservation Order No. 173 Rule 3 from the language in 20 AAC 25.055(a)(3). 20 AAC 25.055(a)(3) clearly indicates that the distance from a section line to the Point in a well bore that is open to an oil pool may not exceed 500 feet. The language in Conservation Order 173 Rule No. 3, however, has recently been interpreted by the Commission's technical staff as implying that no portion of the well bore may be closer than 500 feet from a section line. The proposed drilling program for MPU L-11 is such that the location of the perforations in the well bore is greater than 500 feet from the nearest quarter section line, but the proposed bottom hole location is slightly, less than 500 feet from the nearest section line. In the case of MPU L-11, it should also be noted that the lease holder of the adjacent property is an interest owner in the Miine Point Unit.
