IT APPEARING THAT:
BP Exploration (Alaska), Inc. submitted an application dated
December 23, 1993 requesting exception to 20 AAC 25.055(a)(3) to
allow drilling the BP Niakuk No. 12A development oil well to a
location that is closer than 500 feet to a drilling unit boundary
and is the second well drilled to a single pool within a
governmental quarter section.

Notice of opportunity for public hearing was published in the
Anchorage Daily News on December 24, 1993 pursuant to
20 AAC 25.540.
3. No protests to the application were received.
FINDINGS:
The BP Niakuk No. 12A well as proposed will be a deviated hole
drilled from a surface location 1327' from the south line and 996'
from the east line (FEL) of Section 36, T12N, R15E, Umiat
Meridian (UM) to a proposed bottom-hole location of 295' from the
south line and 790' FEL of Section 23, T12N, R15E, UM.

BP Exploration (Alaska) Inc. is the owner and operator of all
governmental quarter sections directly and diagonally offsetting
the proposed bottom-hole location of the well.

An exception to 20 AAC 25.055(a)(3) is necessary to allow drilling
of this well.

CONCLUSION:
Granting a spacing exception to allow drilling of the BP Niakuk No.
well as proposed will not result in waste nor jeopardize correlative
rights.
NOW, THEREFORE, IT IS ORDERED:
BP Exploration (Alaska), Inc.'s application for exception to
20 AAC 25.055 for the purpose of drilling the Niakuk No. 12A
well is approved as proposed.

Alaska Oil and Gas Conservation Commission
AS 31.05.080 provides that within 20 days after receipt of written notice of the entry of an order, a person affected
by it may file with the Commission an application for rehearing. A request for rehearing must be received by
4:30 PM on the 23rd day following the date of the order, or next working day if a holiday or weekend, to be timely
filed. The Conmfission shall grant or refuse the application in whole or in part within 10 days. The Commission
can refuse an application by not acting on it within the 10-day period. An affected person has 30 days from the
date the Colmnission refuses the application or mails (or otherwise distributes) an order upon rehearing, both
being the final order of the Conunission, to appeal the decision to Superior Court. Where a request for rehearing
is denied by nonaction of the Conunission, the 30-day period for appeal to Superior Court runs from the date on
which the recluest is deemed denied (i.e., 10th day after the application for rehearing was filed).

Dear Commissioner Johnston:
BP Exploration (Alaska), Inc. ("BPX") hereby applies for an exception to the
provisions of 20 AAC 25.055 for the drilling of Niakuk #12A ("Well"). This
change in location from the previous exception request will facilitate the
running of wireline tools in the well.
Relevant location data for the Well are as follows:
(1) Surface Location: 1327 feet FSL,996 feet FEL, Section 36, T12N,
R15E, UM on BPX oil and gas lease ADL 34630.
(2)
Target Location at top Kuparuk (9105 feet Subsea True Vertical
Depth): 285 feet FNL, 352 feet FEL, Section 26, T12N, R15E UM
on BPX oil and gas lease ADL 34630.
(3) Bottom Hole Location (BHL)' 295 feet FSL, 790 feet FEL, Section
23, T12N, R15E UM on BPX oil and gas lease ADL 34625.
(4) Departure from Surface Location to BHL' 9538 feet North and
5138 feet West for a total departure of 10833 feet N28W.
(5) Total Depth' 9525 feet Subsea True Vertical Depth.
The owners and operators of all governmental quarter sections directly and
diagonally offsetting the proposed location of the Well are BPX. The plat
required by the regulation is attached as Exhibit 1. The verification required
by the regulation is attached as Exhibit 2. Copies of the notifications to the
owners and operators, as well as the required information with respect to
mailing are attached in the package .designated as Exhibit 3.

3. Pursuant to 20 AAC 25.055 (b), BP Exploration(Alaska) Inc. (BPX), the well
operator, prepared a Notice of Request for an Exception to the Provision of
20 AAC 25.055. A copy of this notice is attached hereto as Exhibit 3A.
4. On December 23, 1993, pursuant to 20 AAC 25.055 (b) BPX sent a copy of
said notice by registered mail to the last known address of each owner and
operator of governmental quarter sections directly and diagonally offsetting
the quarter section of the proposed location of the oil well. Attached hereto
as Exhibit 3B is an affidavit of mailing of Notice.

hereby gives notice of a request to the Alaska Oil and Gas Conservation
Commission for an exception to the spacing requirements of 20 AAC 25.055 (a)
(3).
BP Exploration.'s request, if approved will permit (1) the intersection of the
wellbore of the captioned well with the top of the Kuparuk formation within 500
feet of the north line and of the east line of one governmental section and within
500 feet of the south line in the governmental section in which the well will be
bottomed, (2) the drilling of the captioned well in the same governmental
quarter section as Niakuk-10, both wells being capable of production. This
change in location from the previous exception request will facilitate the running
of wireline tools in the well.
Specifically, the well location applied for are as follows:
(1) Surface Location: 1327 feet FSL, 996 feet FEL, Section 36, T12N,
R15E, UM on BPX oil and gas lease ADL 34630.

BP Exploration (Alaska) Inc. by letter dated December23, 1993 has
requested, an exception to the provisions of 20 AAC 25.055(a)(3) for the drilling
of a development oil well to an undefined oil pool in the Prudhoe Bay Unit.
The exception would allow BP to drill the Niakuk 12A development oil well
to a location that is 1) closer than 500 feet from a quarter section line; and 2) is
the second well drilled to the pool within a governmental quarter section. The
well will be drilled as a deviated hole from a surface location 1327' from the
south line and '996' from the east line (FEL) of Section 36, T12N, R15E, Umiat
Meridian (UM) to a bottom-hole location 295' from the south line and 790' FEL of
Section 23, T12N, R15E, UM.
A perso, n who may be harmed if the requested order is issued may file a
written protest prior to 4:00 PM January 10, 1994 with the Alaska Oil and Gas
Conservation Commission, 3001 Porcupine Drive, Anchorage, Alaska 99501,
and request a hearing on the matter. If the protest is timely filed and raises a
substantial and material issue crucial to the Commission's determination, a
hearing on the matter will be held at the above address at 9:00 AM on
January 24, 1994 in conformance with 20 AAC 25.540. If a hearing is to be held,
interested parties may confirm this by calling the Commission office, (907)

20 AAC 25.055 to allow drilling the Niakuk 12A development oil well.
BP Exploration (Alaska) Inc. by letter dated December20, 1993 has
requested an exception to the provisions of 20 AAC 25.055(a)(3) for the drilling
of a development oil well to an undefined oil pool in the Prudhoe Bay Unit.
The exception would allow BP to drill the Niakuk 12A development oil well
to a location that is 1) closer than 500 feet from a quarter section line; and 2) is
the second well drilled to the pool within a governmental quarter section. The
well will be drilled as a deviated hole from a surface location 1327' from the
south line and 996' from the east line (FEL) of Section 36, T12N, R15E, Umiat
Meridian (UM) to a bottom-hole location 79' from the north line and 505' FEL of
Section 26, T12N, R15E, UM.
A person who may be harmed if the requested order is issued may file a
written protest prior to 4:00 PM January 4, 1994 with the Alaska Oil and Gas
Conservation Commission, 3001 Porcupine Drive, Anchorage, Alaska 99501,
and request a hearing on the matter. If the protest is timely filed and raises a
substantial and material issue crucial to the Commission's determination, a
hearing on the matter will be held at the above address at 9:00 AM on
January 20, 1994 in conformance with 20 AAC 25.540. If a hearing is to be held,
interested parties may confirm this by calling the Commission office, (907)
279-1433, after January 4, 1994. If no protest is filed, the Commission will
consider the issuance of the order without a hearing.

operator, prepared a Notice of Request for an Exception to the Provision of 20
AAC 25.055. A copy of this notice is attached hereto as Exhibit 3A.
4. On December 17, 1993, pursuant to 20 AAC 25.055 (b) BPX sent a copy of said
notice by registered mail to the last known address of each owner and operator
of governmental quarter sections directly and diagonally offsetting the quarter
section of the proposed tocation of the oil well. Attached hereto as Exhibit 3B is
