IT APPEARING THAT:
ARCO Alaska, Inc. submitted an application dated February 22, 1994 requesting
exception to 20 AAC 25.055(a)(1) to allow drilling the ARCO Bergschrund No. 1
exploratory oil well closer thm~ 500 feet to a drilling unit boundary.

Notice of hearing was published in the Anchorage Daily News on February 24, 1994
pursuant to 20 AAC 25.540.
3. No protests to the application were received.
FINDINGS:

The ARCO Bergschrund No. 1 well as proposed will be a straight hole drilled to a bottom-
hole location 2200' from the north line and 1600' from the east line of Section 32, T12N,
R5E, Umiat Meridian.
Offset owners Chevron U.S.A. Production Company and Union Texas Petroleum Alaska
Corporation have been duly notified.

CONCLUSION:
Granting a spacing exception to allow drilling of the ARCO Bergschrund No. 1 well as proposed
will not result in waste nor jeopardize correlative rights.

NOW, THEREFORE, IT IS ORDERED:
ARCO Alaska, Inc.'s application for exception to 20 AAC 25.055 for the purpose of drilling the
Bergschrund No. 1 well is approved as proposed.
DONE at Anchorage, Alaska and dated March 14, 1994.
AS 31.05.080 provides that within 20 days after receipt of written notice of the entry of an order, a person affected
by it may file with the Cmmnission an application for rehearing. A request for rehearing must be received by
4:30 PM on the 23rd day following the date of the order, or next working day if a holiday or weekend, to be timely
filed. The Conunission shall grant or refuse the application in whole or in part within 10 days. The Commission
can refuse an application by not acting on it within the 1 O-day period. An affected person has 30 days from the
date the Commission refuses the application or mails (or otherwise distributes) an order upon rehearing, both
being the final order of the Commission, to appeal the decision to superior Court. Where a request for rehearing is
denied by nonaction of the Commission, the 30-day period for appeal to Superior Court runs from the date on
which the request is deemed denied (i.e., 10th day after the application for rehearing was filed).

Dear Mr. Johnston,
Thank you for the opportunity to review and comment on draft Conservation Order
No. 331. We also appreciate your consideration of our verbal comments conceming
the recent Niakuk rule governing automatic shut-in equipment. We offer the following
comments and suggestions. Suggested revisions are shown in italics.
Page 1, Finding 1:
C.O. 145, Rule 5 does not currently address surface safety valves (SSV's). We
suggest the Finding read:
"Rule 5 of Conservation Order No. 145 requires subsurface safety valves be
installed in Prudhoe Oil Pool wells."
Page 2, Conclusion 1:
We suggest the conclusion be reworded as follows:
"Requiring specific notice and approval from the Commission prior to temporary
removal of SSSV's for routine maintenance and well work would impose
significant burden on the Commission without commensurate benefit."
Page 2, Rule 5 a. ii.
After further consideration, we request the required minimum SSSV setting
depth be changed to be consistent with the required depth within the Kuparuk
River Pool. This change would allow additional flexibility for future completions.
We suggest this section be worded as follows:
"a fail-safe automatic subsurface safety valve (SSSV), unless other types of
subsurface valves are approved by the Commission, shall be installed in the
tubing string at a depth of 500feet or greater below ground level and be capable
of preventing uncontrolled flow."
Page 2, Rule 5 b.
To clarify that a water injection well does not require a SSSV, we suggest the
following:
"A well that is incapable of unassisted flow of hydrocarbons, as determined by
a "no flow" performance test witnessed by a Commission representative, is not
required to have a fail-safe automatic SSSV. Wells used for continuous water
injection are incapable of unassisted flow of hydrocarbons,"

To account for unforeseen circumstances near the 30 day limit, we suggest the
following wording:
"Written or verbal notification will be required for those wells that will have
SSSV's removed for longer than the 30 day period."
Page 3, Rule 5 c. ii.
To allow the use of our current tagging system, we suggest the following
wording:
"... shall be identified by a clearly visible sign or tag on the wellhead ..."
Page 3, Rule 5 d.
We suggest the following wording for clarification:
"The Low Pressure Sensor (LPS) system shall not be deactivated except during
repairs to the LPS or while engaged in active well work or well operations. During
times when the LPS is deactivated, the pad must be manned at all times or the
well shut-in at the wellhead and manifold building. Repairs to the LPS must be
completed within 24 hours or the well shut-in at the wellhead and at the
manifold building."

wording:
"... shall be identified by a clearly visible sign or tag on the wellhead or safety
panel..."
Page 3, Rule 5 e.
For clarity, we suggest the following:
- Move this section to the Rule 5 b location renumber and reword as follows:
"The safety valve systems must be maintained in working condition at all times
unless the well is shut in and secured, or the well is being operated in
conformance with other sections of this rule."

The application of ARCO Alaska, Inc. for exception to 20 AAC 25.055 to
allow drilling the Bergschrund No. 1 exploration oil well.
ARCO Alaska, Inc. by letter dated February 22, 1994, has requested an
exception to the provisions of 20 AAC 25.055(a)(1) for the drilling of an
exploratory oil well due west of the Kuparuk River Unit on the North Slope.
The exception would allow ARCO to drill the Bergschrund No. 1
exploratory oil well to a bottom-hole location that is closer than 500 feet from a
quarter section line. The well will be drilled as a straight hole at the following
location: 2200' from the north line and 1600' from the east line of Section 32,
T12N, R5E, Umiat Meridian (UM).
A person who may be harmed if the requested order is issued may file a
written protest prior to 4:00 PM March 11, 1994 with the Alaska Oil and Gas
Conservation Commission, 3001 Porcupine Drive, Anchorage, Alaska 99501,
and request a hearing on the matter. If the protest is timely filed and raises a
substantial and material issue crucial to the Commission's determination, a
hearing on the matter will be held at the above address at 9:00 am on March 28,
1994 in conformance with 20 AAC 25.540. If a hearing is to be held, interested
parties may confirm this by calling the Commission's office, (907) 279-1433 after
March 11, 1994. If no protest is filed, the Commission will consider the issuance
of the order without a hearing.

Dear Chairman Johnston:
ARCO Alaska, Inc. ("ARCO") hereby applies for an exception to the
provisions of 20 AAC 25.055 for the drilling of the Bergschrund No. 1 Well.
The well will be drilled as a undirected straight hole from a surface location
of 1600' FEL and 2200' FNL of Section 32, T12N-R5E, UM. The surface
and bottomhole of the well is on ADL-25558 which is owned by ARCO and
Union Texas Petroleum Alaska Corporation.
The attached Exhibit 1 shows the location of the Bergschrund No. 1 well
and all other adjoining governmental quarter sections and wells. There
are no other completed or drilling wells on the property. The names and
addresses of all owners and operators of the governmental quarter
sections directly, and diagonally offsetting Sections 32 are set forth in the
attached Exhibit 2. All owners in the well are also owners in the
governmental quarter sections directly and diagonally, offsetting Section
32. Included in the attached Exhibit 3 is the verification required by the
referenced provisions, a copy of the notice sent to the other owners listed
in Exhibit 2, and the date such notice was mailed.

knowledge of the matters set forth herein.
2. I am a Senior Landman for the well operator, ARCO Alaska, Inc.
3. I am acquainted with the facts associated with the drilling of
Bergschrund No. 1 Well.
4. I have reviewed the application submitted for the exception to 20
AAC 25.055. To the best of my knowledge and belief all facts therein are true
and accurate.
5. I have reviewed the plat attached as Exhibit I and it correctly
portrays pertinent and required data.
6. Pursuant to 20 AAC 25.055 (b), ARCO Alaska, Inc. ("ARCO"), the well
operator, prepared a Notice of Request for Exception to the Provision of 20 AAC
25.055. A copy of this notice is attached hereto.
7. On February 22, 1994, pursuant to 20 AAC 25.055 (b), ARCO sent a
copy of said notice by certified mail to the last known address of all owners
and operators of governmental quarter sections directly and diagonally
offsetting the governmental quarter section of the proposed location of ARCO's
