IT APPEARING THAT:
1. BP Exploration (Alaska), Inc. submitted an application dated
October 26, 1994 requesting exception to 20 AAC 25.055(a)(3) to
allow drilling the BP Niakuk 9 development oil well to a producing
location in the Niakuk Oil Pool that is closer than 500 feet to
the pool rule area boundary.
2. Notice of opportunity for public hearing was published in the
Anchorage Daily News on October 29, 1994 pursuant to
20 AAC 25.540.
3. No protests to the application were received.
FINDINGS:
1. The BP Niakuk 9 well as proposed will be a deviated hole drilled
from a surface location 3998' from the north line and 1073' from
the east line of Section 36, T12N, R15E, Umiat Meridian (UM) to a
proposed bottom-hole location of 2599' from the south line and
850' from the west line of Section 23, T12N, R15E, UM.
2. Offset owners Exxon USA and ARCO Alaska, Inc. have been duly
notified.
3. An exception to 20 AAC 25.055(a)(3) and Rule 3 of Conservation
Order No. 329 is necessary to allow drilling of this well.
CONCLUSION:
Granting a spacing exception to allow drilling of the BP Niakuk 9 well
as proposed will not result in waste nor jeopardize correlative rights.

AS 3 t .05.080 provides that within 20 days after receipt of written notice of the entry• of an order, a person affected
by it may file with the Commission an application for rehearing. A request for rehearing must be received by
4:30 PM on the 23rd day following the date of the order, or nett working day if a holiday or weekend, to be timely
filed. The Conunission shall grant or refuse the application ut whole or in part within 10 days. The Commission
can refuse au application by not acting on it within the 10-day period. An affected person has 30 days from the
date the Cotntnission refuses the application or mails (or otherwise distributes) an order upon rehearing, both
being the final order of the Commission, to appeal the decision to Superior Court. Where a request for rehearing
is denied by nonaction of the Commission, the 30-day period for appeal to Superior Court runs from the date on
which the request is deemed denied (i.e., 10th day after the application for rehearing was filed).

Re: The application of BP Exploration (Alaska) Inc. for exception to 20 AAC
25.055 to allow drilling the Niakuk 9 development oil well.
BP Exploration (Alaska) Inc. by letter dated October 26, 1994 has requested
an exception to the provisions of 20 AAC 25.055(a)(3) for the drilling of an
development oil well within the Prudhoe Bay Unit on the North Slope.
The exception would allow BP to directionally drill the Niakuk 9 development
oil well to a bottom-hole location that is closer than 500 feet from a quarter section
line. The proposed surface location is 3998' from the north line and 1073' from the
east line of Section 36, T12N, R15E, Umiat Meridian (UM) and the proposed
bottom-hole location is 2599' from the south line and 850' from the west line of
Section 23, T12N, R15E, UM.
A person who may be harmed if the requested order is issued may file a
written protest prior to 4:00 PM November 14, 1994 with the Alaska Oil and Gas
Conservation Commission, 3001 Porcupine Drive, Anchorage, Alaska 99501, and
request a hearing on the matter. If the protest is timely filed and raises a substantial
and material issue crucial to the Commission's determination, a hearing on the
matter will be held at the above address at 9:00 am on December 1, 1994 in
conformance with 20 AAC 25.540. If a hearing is to be held, interested parties may
confirm this by calling the Commission's office, (907) 279-1433 after November 14,
1994. If no protest is filed, the Commission will consider the issuance of the order
without a hearing.

BP Exploration (Alaska), Inc. ("BPX") hereby applies for an exception to the
provisions of 20 AAC 25.055 for the drilling of Niakuk #9 ("Well"). Relevant
location data for the Well is as follows:
(1) Surface Location: 3998 feet FNL, 1073 feet FEL, Section 36, Township 12N, Range
15E, UM on BPX oil and gas lease ADL 34630.
(2) Target Location at top Kuparuk (9080 feet Subsea True Vertical Depth): 1654feet
FSL, 1251 feet FWL, Section 23, T12N, R15E UM on BPX oil and gas lease ADL
34625.
(3) Bottom Hole Location (BHL): 2599 feet FSL, 850 feet FWL, Section 23, T12N, R15E
UM on BPX oil and gas lease ADL 34625.
(4) Departure from Surface Location to BHL: 11877 feet North and 8646 feet West for a
total departure of 14680 feet N36W.
(5) Total Depth: 9444 feet Subsea True Vertical Depth.
BP Exploration's request, if approved, will permit the intersection of the wellbore
of the captioned well with the Kuparuk formation within 500 feet of the south
quarter section line of the governmental section 23 in BPX lease ADL 34625.
The owner and operator of the quarter sections directly North, South and East is
BPX. The quarter section to the West, for which no exception in required, is
section 22 of Arco/Exxon lease ADL 34626.
The plat required by the regulation is attached as Exhibit 1. The verification
required is attached as Exhibit 2, copies of the notifications to the owners and
operators are attached as Exhibit 3.

knowledge of the matters set forth herein.
2. I am a Senior Geologist for the well operator, BP Exploration (Alaska) Inc.
3. Pursuant to 20 AAC 25.055 (b), BP Exploration (Alaska) Inc. (BPX), the well
operator, prepared a Notice of Request for an Exception to the Provision of 20 AAC
25.055. A copy of this notice is attached hereto as Exhibit 3.
4. On October 26, 1994, pursuant to 20 AAC 25.055 (b) BPX sent a copy of said notice
by registered mail to the last known address of each owner and operator of
governmental quarter sections directly and diagonally offsetting the quarter section
of the proposed location of the oil well. Attached hereto as Exhibit 3B are the
Affidavits of Mailing of Notice.

BP Exploration (Alaska) Inc. by letter dated October 7, 1994 has
requested an exception to the provisions of 20 AAC 25.055(a}(3) for the drilling
of a development oil well within the Prudhoe Bay Unit on the North Slope.
The exception would allow BP to directionally drill the Niakuk 9
development oil well to a bottom-hole location that is closer than 500 feet from a
quarter section line. The proposed surface location is 3998' from the north line
and 1073' from the east line of Section 36, T12N, R15E, Umiat Meridian (UM);
and the proposed bottom-hole location is 2206' from the south line and 1054'
from the west line of Section 23, T12N, R15E, UM.
A person who may be harmed if the requested order is issued may file a
written protest prior to 4:00 PM October 26, 1994 with the Alaska Oil and Gas
Conservation Commission, 3001 Porcupine Drive, Anchorage, Alaska 99501,
and request a hearing on the matter. If the protest is timely filed and raises a
substantial and material issue crucial to the Commission's determination, a
hearing on the matter will be held at the above address at 9:00 AM on

The Alaska Oil and Gas Conserva-
tion Commission, acting upon its own
motion in accordance with AS
31.05.060, is considering a public
hearing to consolidate conservation
orders governing development of the
Prudhoe Oil Pool, Prudhoe Bay Field.
A consolidated conservation or-
derfor the Prudhoe Oil Pool has been
prepared to bring together and orga-
nize in one document the existing

Prudhoe Oil Pool. The consolidated
conservation order also updates the
Prudhoe Oil Pool affected area to
make it contorts with the Initial Partici-
pation Area revisions approved by
Department of Natural Resources.
The Commission's objective is to

Request for Exception to the, Provisions of
20 AAC 25.055 Niakuk #9
Dear Commissioner Johnston:
BP Exploration (Alaska), Inc. ("BPX") hereby applies for an exception to the
pro~~isions of 20 AAC 25.055 for the drilling of Niakuk #9 ("Well"). Relevant
location data for the Well is as follows:
(1) Surface Location: 3998 feet FNL, 1073 feet FEL, Section 36, Township 12N, Range
15E, UM on BPX oil and gas lease ADL 34630.
(2) Target Location at top Kuparuk (9080 feet Subsea True Vertical Depth): 1881 feet
FSL, 1172 feet FWL, Section 23, T12N, R15E UM on BPX oil and gas lease ADL
34625.
(3) Bottom Hole Location (BHL): 2206 feet FSL, 1054 feet FWL, Section 23, T12N, R15E
UM on BPX oil and gas lease ADL 34625.
(4) Departure from Surface Location to BHL: 11485 feet North and 8441 feet West for a
total departure of 14253 feet N2W.
(5) Total Depth: 9241 feet Subsea True Vertical Depth.
BP Exploration's request, if approved, will permit the intersection of the wellbore
of tt~e captioned well with the Kuparuk formation within 500 feet of the south
quarter section line of the governmental section 23 in BPX lease ADL 34625.
The owner and operator of the quarter sections directly North, South and East is
BPX. The quarter section to the West, for which no exception in required, is
section 22 of AIE lease ADL 34626.
The plat required by the regulation is attached as Exhibit 1. The verification
required is attached as Exhibit 2, copies of the notifications to the owners and
operators are attached as Exhibit 3.

Pursuant to the requirements of 20 AAC 25.055 (b), BP Exploration (Alaska) Inc.
hereby. gives notice of a request to the Alaska Oil and Gas Conservation
Commission for an exception to the spacing requirements of 20 AAC 25.055 (a}
(3}.
