Conservation Order No. 353 BP Exploration (Alaska), Inc. Milne Point Unit E-13A January 18, 1995 IT APPEARING THAT: 1. BP Exploration (Alaska), Inc. submitted an application dated December 23, 1994 requesting exception to 20 AAC 25.055(a)(1) to allow drilling the BP Milne Point Unit E-13A exploratory oil well to a producing location in an undefined oil Pool that is closer than 500 feet to a statewide drilling unit boundary. 2. Notice of opportunity for public hearing was published in the Chugiak-Eagle River Alaska Star on December 31, 1994 pursuant to 20 AAC 25.540, 3. No protest to the application was received. FINDINGS: The BP Milne Point Unit E-13A well as proposed will be a deviated hole drilled from a surface location 3778' from the south line (FSL} and 2067' from the east line (FEL) of Section Z5, T13N, R10E, Umiat Meridian (LTM) to a proposed bottom-hole location 484' FSL and 90' FEL of Section 15, T13N, R10E, UM. 2. Offset owner Oxy USA, Inc. has been duly notified. An exception to 20 AAC 25.055(a)(1) is necessary to allow drilling of this well. CONCLUSION: Granting a spacing exception to allow drilling of the BP Milne Point Unit E-13A well as proposed will not result in waste nor jeopardize correlative rights. ~• Conservation Order 1\~ January 18, 1995 Page 2 NOW, THEREFORE, IT IS ORDERED: BP Exploration (Alaska), Inc.'s application for exception to 20 AAC 25.055 for the purpose of drilling the Milne Point Unit E-13A well is approved as proposed. Alaska Oil and Gas Conservation Commission AS 31,05.080 provides that within 20 days after receipt of written notice of the entry of an order, a person affected by it may file with the Commission an application for rehearing. A request for rehearing must be received by 4:30 PM on the 23rd day following the date of the order, or next working day if a holiday or weekend, to be timely filed. The Commission shall grant or refuse the application in whole or in part within 10 days. The Commission can refuse an application by not acting on it within the 10-day period. An affected person has 30 days from the date the Commission refuses the application or mails (or otherwise distributes) an order upon rehearing, both being the fmal order of the Commission, to appeal the decision to Superior Court. Where a request for rehearing is denied by nonaction of the Commission, the 30-day period for appeal to Superior Court runs from the date on which the request is deemed denied (i.e., 10th day after the application for rehearing was filed). BP Exploration (Alaska) Inc. by letter dated December 23, 1994 has requested an exception to the provisions of 20 AAC 25.055(a)(1) for the drilling of an exploratory oil well to an undefined oil pool in the Milne Point Unit, on the North Slope. The exception would allow BP to directionally drill the Milne Point E-13A exploratory oil well to both producing and bottom-hole locations that are closer than 500 feet from a quarter section line. The proposed surface location is 3778' from the south line (FSL) 2067' from the east line (FEL) of Section 25, T13N, R10E, Umiat Meridian (UM), the top of the proposed producing horizon is 2719' FSL and 3090' FEL of Section 23, T13N, R10E UM and the bottom-hole location is proposed as 489' FSL and 90' FEL of Section 15, T13N R10E UM, A person who may be harmed if the requested order is issued may file a written protest prior to 4:00 pm January 16, 1995 with the Alaska Oil and Gas Conservation Commission, 3001 Porcupine Drive, Anchorage, Alaska 99501, and request a hearing on the matter. If the protest is timely filed and raises a substantial and material issue crucial to the Commission's determination, a hearing on the matter will be held at the above address at 9:00 am on February 1, 1995 in conformance with 20 AAC 25.540. If a hearing is to be held, interested parties may confirm this by calling the Commission's office, (907) 279- 1433 after January 16, 1995. If no protest is filed, the Commission will consider the issuance of the order without a hearing.
