Niakuk 13 April 7, 1995 Amended August 9, 1996 IT APPEARING THAT: . BP Exploration (Alaska), Inc. submitted an application dated March 21, 1995 requesting exception to 20 AAC 25.055(a)(3) to allow drilling the BP Niakuk 13 development oil well to a producing location that is closer than 500 feet to a quarter section line in an undefined pool. . Notice of opportunity for public hearing was published in the Anchorage Daily News on March 23, 1995 pursuant to 20 AAC 25.540. 3. No protests to the application were received. . Conservation Order No. 356 granting the requested spacing exception was issued April 7, 1995. . BP Exploration (Alaska), Inc. submitted a revised bottom-hole location for the Niakuk 13 well on July 22, 1996. The revised bottom-hole location also requires an exception to 20 AAC 25.055 because it is closer than 500 feet to a quarter section line. . Notice of opportunity for public hearing for the revised bottom-hole location was published in the Anchorage Daily News on July 25, 1996 pursuant to 20 AAC 25.540. 7. No protests to the application were received. FINDINGS: The BP Niakuk 13 well as proposed will be a deviated hole drilled from a surface location 1342' from the south line (FSL) and 970' from the east line (FEL) of Section 36, T12N, R15E, Umiat Meridian (UM) to a proposed producing location 4835' FSL and 944' FWL of Section 23, T12N, R15E, UM and a bottom hole location 258' FSL and 506' FWL of Section 14, TI2N, R15E UM. Conservation Order No. 35~. April 7, 1995 Amended August 9, 1996 Page 2 . . Offset owners ARCO Alaska, Inc. and Exxon Company U.S.A. have been duly notified. An exception to 20 AAC 25.055(a)(3) is necessary to allow drilling of this well. CONCLUSION: Granting a spacing exception to allow drilling of the BP Niakuk 13 well as proposed will not result in waste nor jeopardize correlative rights. NOW, THEREFORE, IT IS ORDERED: BP Exploration (Alaska), Inc.'s application for exception to 20 AAC 25.055 for the purpose of drilling the Niakuk 13 well is approved as proposed. Alaska,.~ Oi~tion Commission Tuckerman Babcock, Commissioner Alaska Oil and Gas Conservation Commission AS 31.05.080 provides that within 20 days after receipt of written notice of the entry of an order, a person affected by it may file with the Commission an application for rehearing. A request for rehearing must be received by 4:30 PM on the 23rd day following the date of the order, or next working day ifa holiday or weekend, to be timely filed. The Commission shall grant or refuse the application in whole or in part within 10 days. The Commission can refuse an application by not acting on it within the 10-day period. An affected person has 30 days from the date the Commission refuses the application or mails (or otherwise distributes) an order upon rehearing, both being the final order of the Commission, to appeal the decision to Superior Com. Where a request for rehearing is denied by nonaction of the Commission, the 30-day period for appeal to Superior Court runs from the date on which the request is deemed denied (i.e., 10th day after the application for rehearing was filed). BP Exploration (Alaska) Inc. ("BPXA") by letter dated July 22, 1996 has requested an exception to the provisions of 20 AAC 25.055(a)(3). The exception would allow BPXA to directionally drill the Niakuk No. 13 development oil well to a producing location that is closer than 500 feet from a quarter section line. The proposed surface location is 1342' from the south line (FSL) and 970' from the east line (FEL) of Section 36, T12N, R15E, Umiat Meridian (UM), the top of the proposed producing interval is 445' from the north line and 944' from the west line (FWL) of Section 23, T12N, R15E UM and the proposed bottom hole location is 258 FSL and 506 FWL of Section 14, T12N, R15E UM. The proposed action would amend Conservation Order 356 which previously granted BPXA a spacing exception to drill the well to a different location.
