Notice of opportunity for public hearing was published in the Anchorage Daily News on December 15, 1995 pursuant to 20 AAC 25.540. 3. No protests to the appliCations were received. FINDINGS: , The Neve No. 1 delineation oil well as proposed will be drilled as a straight hole at a location 465' from the north line and 2440' from the west line of Section 14, T11N, R4E, Umiat Meridian (UM). , The Neve No. lA delineation oil well as proposed will be drilled as a deviated hole with a surface location 465' from the north line and 2440' from the west line of Section 14, T11N, R4E, UM and bottomhole location 2960' from the north line and 530' from the west line of Section 14, T11N, R4E, UM. . The Neve No. lB delineation oil well as proposed will be drilled as a deviated hole with a surface location 465' from the north line and 2440' from the west line of Section 14, T11N, R4E, UM and bottomhole location 640' from the south line and 3290' from the west line of Section 11, T11N, R4E, UM. . The Nanuk No. 1 delineation oil well as proposed will be drilled as a straight hole at a location 2290' from the north line and 1140' from the west line of Section 30, T11N, R5E, UM. , The Temptation No. 1 delineation oil well as proposed will be drilled as a straight hole at a location 1890' from the south line and 540' from the west line of Section 16, T12N, R4E, UM. . The Alpine No. 3 delineation oil well as proposed will be drilled as a straight hole at a location 2145' from the north line and 2115' from the west line of Section 25, T12N, R4E, UM. The Bergschrund No. 4 delineation oil well as proposed will be drilled as a deviated hole with a surface location 960' from the north line and 1 620' from the west line of Section 9, T11N, R5E, UM and bottomhole location 535' from the south line and 20' from the west line of Section 4, T11N, R5E, UM. o All owners and operators of governmental quarter sections directly and diagonally offsetting the quarter section proposed for each of the subject wells has been duly notified. 9. An exception to the well spacing provisions of Title 20 AAC 25.055 (3) is necessary to allow the drilling of each of the above listed wells. CONCLUSION: Granting a spacing exception to allow drilling of the ARCO Neve No. 1, Neve No. lA, Neve No. lB, Nanuk No. 1, Temptation No. 1, Alpine No. 3 and Bergschrund No. 4 wells will not result in waste nor jeopardize correlative rights. NOW, THEREFORE, IT IS ORDERED: ARCO Alaska, Inc.'s applications for exception to the well spacing provisions of Title 20 AAC 25.055 (3) for the purpose of drilling the seven wells described above are approved. David Norton, P.E., Commissioner Alaska Oil and Gas Conservation Commission AS 31.05.080 provides that within 20 days after receipt of written notice of the entry of an order, a person affected by it may file with the Commission an application for rehearing. A request for rehearing must be received by 4:30 PM on the 23rd day following the date of the order, or next working day if a holiday or weekend, to be timely filed. The Commission shall grant or refuse the application in whole or in part within 10 days. The Commission can refuse an application by not acting on it within the lO-day period. An affected person has 30 days from the date the Commission refuses the application or mails (or otherwise distributes) an order upon rehearing, both being the final order of the Commission, to appeal the decision to Superior Court. Where a request for rehearing is denied by nonaction of the Commission, the 30-day period for appeal to Superior Court runs from the date on which the request is deemed denied (i.e., 10th day after the application for rehearing was filed). ARCO Alaska, Inc. by letter dated December 7, 1995 has requested an exception to the provisions of 20 AAC 25.055(a)(3) for the drilling of seven delineation oil wells due west of the Kuparuk River Unit and adjacent to the eastern boundary of the National Petroleum Reserve, Alaska (NPR-A) on the North Slope. The exception would allow ARCO to drill the Alpine No. 3 delineation oil well to a bottom-hole location that is closer than 500 feet from a quarter section line. The well will be drilled as a straight hole at a location 2145' from the north line and 2115' from the west line of Section 25, T12N, R4E, Umiat Meridian (UM). The exception would allow ARCO to drill the Bergschrund No 4 delineation oil well to a bottom-hole location that is closer than 500 feet from a quarter section line. The well will be drilled as a deviated hole with a surface location: 960' from the north line and 1620' from the west line of Section 9, T11N, R5E, UM and bottomhole location 535' from the south line and 20' from the west line of Section 4, T11 N, R5E, UM. The exception would allow ARCO to drill the Nanuk No. 1 delineation oil well to a bottom-hole location that is closer than 500 feet from a quarter section line. The well will be drilled as a straight hole at a location 2290' from the north line and 1140' from the west line of Section 30, T11 N, R5E, UM. The exception would allow ARCO to drill the Neve No. 1 delineation oil well to a bottom-hole location that is closer than 500 feet from a quarter section line.
