IT APPEARING THAT:
1. BP Exploration (Alaska), Inc. submitted an application dated February 16, 1996
requesting exception to the well spacing provisions of Conservation Order 173 to
allow drilling the BP MPK-38 development oil well to a producing location within
500 feet of a property boundary in Section 03 T12N R11E Umiat Meridian (UM).

Notice of opportunity for public hearing was published in the Anchorage Daily
News on February 21, 1996 pursuant to 20 AAC 25.540.
3. No protests to the application were received.
FINDINGS:
The BP MPK-18 well as proposed will be a deviated hole drilled from a surface
location 3688' from the south line (FSL) and 1998' from the east line (FEL) of
Section 3, T12N, R11E, UM to a proposed producing location 4995' FSL and 167'
FEL of Section 3 T12N, R11E, UM.
2. Offset owners Oxy USA, Inc. and ARCO Alaska, Inc. have been duly notified.

An exception to the well spacing provisions of Conservation Order 173 is required
for the BP MPK-18 development oil well.

CONCLUSION:
Granting a spacing exception to allow drilling of the BP MPK-18 well as proposed will
not result in waste nor jeopardize correlative rights.
NOW, THEREFORE, IT IS ORDERED:
BP Exploration (Alaska), Inc.'s application for exception to the well spacing provisions of
Conservation Order 173 for the purpose of drilling the MPK- 18 well is approved.
DONE at Anchorage, Alaska and dated March 7, 1996.

AS 31.05.080 provides that within 20 days after receipt of written notice of the entry of an order, a person affected
by it may file with the Commission an application for rehearing. A request for rehearing must be received by
4:30 PM on the 23rd day following the date of the order, or next working day if a holiday or weekend, to be timely
filed. The Commission shall grant or refuse the application in whole or in part within 10 days. The Commission
can refuse an application by not acting on it within the 10-day period. An affected person has 30 days from the
date the Commission refuses the application or mails (or otherwise distributes) an order upon rehearing, both
being the final order of the Commission, to appeal the decision to Superior Court. Where a request for rehearing
is denied by nonaction of the Commission, the 30-day period for appeal to Superior Court hms from the date on
which the request is deemed denied (i.e., 10th day after the application for rehearing was filed).

The application of B.P. Exploration (Alaska) Inc. for exception to Rule 3 of
Conservation Order No. 173 to allow drilling the Milne Point K-18
development oil well.
B. P. Exploration (Alaska) by letter dated February 16, 1996 has
requested an exception to the provisions of Rule 3 of Conservation Order No.
173 for the drilling of a development oil well in the Milne Point area.
The exception would allow B. P Exploration (Alaska) to directionally drill
the Milne Point K-18 development oil well to a producing location that is closer
than 500 feet from a property line. The proposed surface location is 3688' from
the south line (FSL), 1998' from the east line (FEL) of Section 3, T12N, R11E,
Umiat Meridian (UM) and the propoSed bottom-hole location is 5144' FSL and
5238' FEL of Section 2, T12N, R11E, UM.
A person who may be harmed if the requested order is issued may file a
written protest prior to 4:00 PM March 6, 1996 with the Alaska Oil and Gas
Conservation Commission', 3001 Porcupine Drive, Anchorage, Alaska 99501,
and request a hearing on the matter. If the protest is timely filed and raises a
substantial and material issue crucial to the Commission's determination, a
hearing on the matter will be held at the above address at 9:00 am on March 21,
1996 in conformance with 20 AAC 25.540. If a hearing is to be held, interested
parties may confirm this by calling the Commission's office, (907) 279-1433 after
March 6, 1996. If no protest is filed, the Commission will consider the issuance
of the order without a hearing.

The owners and operator of all governmental quarter sections directly and diagonally offsetting
the proposed location of the well are BP Exploration (Alaska) Inc. and Occidental Petroleum, and
ARCO Alaska. The plat required by the regulation is attached as Exhibit 1. The verification
required by the regulation is attached as Exhibit 2. Copies of the notification to the owners and
operators, as well as the required information with the respect to the mailing are attached in the
package designated as Exhibit 3.

Application for Spacing Exception for the Milne Point Well K-18
(20 AAC 25.050 and 20 AAC 25.055) and Conservation Order 173 Rule #3.
The MPK-18 well is planned to drill into the Kuparuk River formation is the northeast quarter of
section 3 T12N R11E. This section is located within ADL lease 375133
The MPK-18 well is planned as a high angle producer to be completed with an electric
submersible pump. The ownership of both these leases is identical. The location of key points
for this wellpath are:

This proposed location is within the NE/4 of section 3 T12N, R11E and in close proximity to the
eastern boundary of that 1/4 section. The Spacing requirements of 20 AAC 25.055 and
Conservation Order 173 Rule #3 do not allow without exception the drilling of a well closer than
500 feet to a property line. This spacing exception is being sought to allow optimum placement of
well MPK-18 within a fault block for the Kuparuk River Formation within the NE/4 of section 3.
Based upon this information, we verify these facts to be true and that the plat portrays the
pertinent and required data. We also feel this addresses the requirements both ACC 25.050 and
ACC 25.055.
