Niakuk 14 April 15, 1996 IT APPEARING THAT: BP Exploration (Alaska), Inc. submitted an application dated March 22, 1996 requesting exception to 20 AAC 25.055(a)(3) to allow drilling the BP Niahtk 14 development oil well to a producing location in an undefined Pool within the Kupamk River Formation that is closer than 500 feet to a quarter section line. . Notice of opportunity for public hearing was published in the Anchorage Daily News on March 28, 1996 pursuant to 20 AAC 25.540. 3. No protests to the application were received. FINDINGS: The BP Niakak 14 well as proposed will be a deviated hole drilled from a surface location 3921' from the north line (FNL) and 944' from the east line (FEL) of Section 36, T12N, R15E, Umiat Meridian (UM) to a proposed producing location 1388' FNL and 2397' FEL of Section 23, T12N, R15E, UM. 2. BP Exploration. (Alaska) is the sole owner of all offset spacing units. 3. An exception to 20 AAC 25.055(a)(3) is necessary to allow drilling of this well. CONCLUSION: Granting a spacing exception to allow drilling of the BP Nialmk 14 well as proposed will not result in waste nor jeopardize coa~elative fights. Conservation Order April 15, 1996 Page 2 NOW, THEREFORE, IT IS ORDERED: BP Exploration (Alaska), Inc.'s application for exception to 20 AAC 25.055 for the purpose of drilling the Niakuk 14 well is approved as proposed. DONE at Anchorage, Alaska and dated April 15, 1996. Alaska Oil ~rvation Commission J. David Norton, P.E., Commissioner Alaska Oil and Gas Conservation Commission Alaska Oil and Gas Conservation Commission AS 31.05.080 provides that within 20 days after receipt of written notice of the entry of an order, a person affected by it may file with the Commission an application for rehearing. A request for rehearing must be received by 4:30 PM on the 23rd day following the date of the order, or next working day if a holiday or weekend, to be timely filed. The Commission shall grant or refuse the application in whole or in part within 10 days. The Commission can refuse an application by not acting on it within the 10-day period. An affected person has 30 days from the date the Commission refuses the application or mails (or otherwise distributes) an order upon rehearing, both being the final order of the Commission, to appeal the decision to Superior Court. Where a request for rehearing is denied by nonaction of the Commission, the 30-day period for appeal to Superior Court runs from the date on which the request is deemed denied (i.e., 10th day after the application for rehearing was filed). ("BPX") hereby applies for a permit to drill Niakuk #14 ("Well"). In addition to the drilling permit enclosed are plats and information required by the provisions of 20 AAC 25.050(b) for the drilling of a deviated 'well. ^ spacing exception for the Well was submitted to you on March 22, 1996. BP Exploration's request, if approved, will permit the drilling of a deviated well from within the Prudhoe Bay Unit to a target outside of the Prudhoe Bay Unit on section 23 in BPX lease ADL 34625. All wells within 200' of the wellbore are owned by BPX as shown in Exhibit 1 and lA. The only affected owner of all adjacent quarter sections is BPX as shown in Exhibit 2. Pursuant to 20 AAC 25.050 (d)(2) enclosed is a letter of non-objection from BPX as the only affected owner so you can issue the drilling permit without having to wait the 15-day period.
