Conservation Order No. 380 ARCO Alaska, Inc. Temptation No. lA April 23, 1996 IT APPEARING THAT: ARCO Alaska, Inc. submitted an application dated April 4, 1996 requesting exception to the well spacing provisions of Title 20 AAC 25.055 (3) to allow drilling the ARCO Temptation No. lA, delineation oil well to a location which is within 500 feet of a quarter section line in the Colville Delta vicinity of the North Slope. 2. Notice of opportunity for public hearing was published in the Anchorage Daily News on April 6, 1996 pursuant to 20 AAC 25.540. 3. No protests to the application were received. FINDINGS: The Temptation No. lA delineation oil well will be drilled as a deviated hole with a surface location 1891' from the south line and 539' from the west line of Section 16, T12N, R4E, Umiat Meridian (UM) and a proposed bottomhole location 110' from the north line and 2871' from the west line of Section 16, T 12N, R4E, UM. 2. Offset owners Anadarko Petroleum Corporation, Union Texas Petroleum Alaska Corporation, Artic Slope Regional Corporation, Kuukpik Corporation and the State of Alaska have been duly notified. 3. An exception to the well spacing provisions of Title 20 AAC 25.055 (3) is necessary to allow the drilling of this well. CONCLUSION: Granting a spacing exception to allow drilling of the ARCO Temptation No. IA well will not result in waste nor jeopardize correlative rights. ARCO Alaska, Inc.'s application for exception to the well spacing provisions of Title 20 AAC 25.055 (3) for the purpose of drilling the ARCO Temptation No. lA is approved. E., Commissioner Alaska Oil and Gas Conservation Commission AS 31.05.080 provides that within 20 days after receipt of written notice of the entry of an order, a person affected by it may file with the Commission an application for rehearing. A request for rehearing must be received by 4:30 ?M on the 23rd day following the date of the order, or next working day if a holiday or weekend, to be timely filed. The Commission shall grant or refuse the application in whole or in part within 10 days. The Commission can refuse an application by not acting on it within the 10-day period. An affected person has 30 days from the date the Commission refuses the application or mails (or otherwise distributes) an order upon rehearing, both being the final order of the Commission, to appeal the decision to Superior Court. Where a request for rehearing is denied by nonaction of the Commission, the 30-day period for appeal to Superior Court runs from the date on which the request is deemed denied . ARCO Alaska, Inc. by letter dated April 4, 1996 has requested an exception to the provisions of 20 AAC 25.055(a)(3) for the drilling of a delineation oil well due west of the Kuparuk River Unit and adjacent to the eastern boundary of the National Petroleum Reserve, Alaska (NPR-A) on the North Slope. The exception would allow ARCO to drill the Temptation No. lA delineation oil well to a bottom-hole location that is closer than 500 feet from a quarter section line. The well will be drilled as a deviated hole with a surface location of 1891' from the south line and 539' from the west line of Section 16, T12N, R4E, Umiat Meridian (UM) and a proposed bottom hole location of 110' from the north line and 2871' from the west line of Section 1 6, T12N, R4E UM. A person who may be harmed if the requested order is issued may file a written protest prior to 4:00 PM April 22, 1996 with the Alaska Oil and Gas Conservation Commission, 3001 Porcupine Drive, Anchorage, Alaska 99501, and request a hearing on the matter. If the protest is timely filed and raises a substantial and material issue crucial to the Commission's determination, a hearing on the matter will be held at the above address at 9:00 am on May 8, 1996 in conformance with 20 AAC 25.540. ("ARCO") hereby applies for an exception to the provisions of 20 AAC 25.055 for the drilling of the Temptation #lA well. The well will be drilled as a deviated hole to a bottomhole location of 157' FNL and 2446' FEL of Section 16, T12N, R4E, U.M. The bottomhole location of the well is on ADL-380095 which is owned by ARCO, Anadarko Petroleum Corporation and Union Texas Petroleum Alaska Corporation. The attached Exhibit 1 shows the location of the Temptation #lA well and all other adjoining governmental quarter sections and wells. There are no other completed or drilling wells on the property. The names and addresses of all owners and operators of the governmental quarter sections directly and diagonally offsetting the NE/4 of Section 16 are set forth in the attached Exhibit 2.
