IT APPEARING THAT: Conservation Order No. 409 Phillips Petroleum Company North Cook Inlet Unit B No. 1 ST January 29, 1998 Phillips submitted an application dated January 6, 1998, requesting exception to 20 AAC 25.055(a)(3) to allow drilling the North Cook Inlet Unit B No. 1 ST delineation oil well to a location in an undefined pool that is closer than 500 feet to a quarter section line. 2. Notice of opportunity for public hearing was published in the Anchorage Daily News on January 13, 1998, pursuant to 20 AAC 25.540. 3. No protests to the application were received. FINDINGS: The North Cook Inlet Unit B No. 1 well as proposed will be a deviated hole drilled from a surface location 1249' from the north line (FNL) and 980' from the west line (FWL) of Section 6, T11N, R09W, Seward Meridian (SM) to a proposed producing location 2830' from the south line (FSL) and 5044' from the east line (FEL) of Section 7, T11N, R09W, SM. 2. Affected owner ARCO Alaska, Inc. has been duly notified. 3. An exception to 20 AAC 25.055(a)(3) is necessary to allow drilling of this well. CONCLUSION: Granting a spacing exception to allow drilling of the Phillips North Cook Inlet Unit B No. 1 ST well as proposed will not result in waste nor jeopardize correlative rights. Johnston, Alaska Oil and Gas Conservation Commission a Cammy Oechs ,Commissioner Alaska Oil and as Conservation Commission AS 31.05.080 provides that within 20 days after receipt of written notice of the entry of an order, a person affected by it may file with the Commission an application for rehearing. A request for rehearing must be received by 4:30 PM on the 23rd day following the date of the order, or next working day if a holiday or weekend, to be timely filed. The Commission shall grant or refuse the application in whole or in part within 10 days. The Commission can refuse an application by not acting on it within the 10-day period. An affected person has 30 days from the date the Commission refuses the application or mails (or otherwise distributes) an order upon rehearing, both being the final order of the Commission, to appeal the decision to Superior Court. Where a request for rehearing is denied by nonaction of the Commission, the 30-day period for appeal to Superior Court runs from the date on which the request is deemed denied (i.e., 10th day after the application for rehearing was filed). ~~ M Notice of Public Hearing • STATE OF ALASKA Alaska Oil and Gas Conservation Commission Re: North Cook Inlet Unit Phillips Petroleum Company (Phillips) by letter dated January 6, 1998 has requested an exception to the provisions of 20 AAC 25.055(a)(3) for the drilling of a delineation oil well to an undefined oil pool within the North Cook Inlet Unit, located offshore in the Cook Inlet due east of Tyonek. The exception would allow Phillips to drill the North Cook Inlet Unit B No. 1 ST delineation oil well to a producing location that is closer than 500 feet from a quarter section line. The well will be drilled as a deviated hole from a surface location 1249' from the north line and 980' from the west line of Section b, T11N, R9W, Seward Meridian (SM), to a producing location 2830' from the south line and 5044' from the east line of Section 12, T11N, R10W, SM. A person who may be harmed if the requested order is issued may file a written protest prior to 4:00 PM January 28, 1998 with the Alaska Oil and Gas Conservation Commission, 3001 Porcupine Drive, Anchorage, Alaska 99501, and request a hearing on the matter. If the protest is timely filed and raises a substantial and material issue crucial to the Commission's determination, a hearing on the matter will be held at the above address at 9:00 am on February 12, 1998 in conformance with ZO AAC 25.540. If a hearing is to be held, interested parties may confirm this by calling the Commission's office, (907) 279-1433 after January 28, 1998. If no protest is filed, the Commission will consider the issuance of the order without a hearing. Phillips has requested a Spacing Exception pursuant to 20AAC 25.055 regarding this operation, since the Sunfish Sand and the North Forelands reservoirs will be penetrated within 500' of a section line and a governmental quarter section line respectively. Additionally, the bottomhole location is projected to be within 500' of a governmental quarter section line. Phillips NCIU-B Well No. 1 ST will be drilled from a surface location of 1,250' FNL and 980' FWL of Sec. 6-T11 N-R9W, on the Phillips Tyonek A Platform. The proposed bottomhole location is 2513' FSL & 1520' FEL of Sec. 12-T11 N-R10W North Cook Inlet, Kenai Borough, Alaska. A plat showing the surface and bottomhole locations in addition to the proposed well path is attached hereto. Phillips Petroleum Company requests that you acknowledge your receipt of this notification, and that you state your non-objection to the pending application by signing and returning one (1) original copy of this letter to the undersigned.
