Alpine CD 1-22 January 29, 1998 ARCO Alaska, Inc. (ARCO) submitted an application dated December 29, 1997, requesting exception to the well spacing provisions of Title 20 AAC 25.055(a)(3) to allow drilling the ARCO Alpine CD 1-22 delineation oil well to a location which is within 500 feet of a quarter section line in the Colville Delta vicinity of the North Slope. 2. Notice of opportunity for public hearing was published in the Anchorage Daily News on January 6, 1998, pursuant to 20 AAC 25.540. 3. No protests to the application were received. FINDINGS: 1. The Alpine CDI-22 delineation oil well well as proposed will be a deviated hole drilled with a surface location 372' from the north line (FNL) and 2427' from the west line (FWL) of Section 5, T11N, ROSE, Umiat Meridian (UM) to a proposed bottomhole location 1009' FNL and 2584' FWL of Section 32, T12N, ROSE, UM. 2. Offset owners Anadarko Petroleum Corporation, Union Texas Petroleum Alaska Corporation, Chevron USA Inc., and the State of Alaska have been duly notified. 3. An exception to 20 AAC 25.05(a)(3) is necessary to allow drilling of this well. Conservation Order No.~ January 29, 1998 Page 2 CONCLUSION: Granting a spacing exception to allow drilling of the ARCO Alpine CD 1-22 well will not result in waste nor jeopardize correlative rights. NOW, THEREFORE, IT IS ORDERED: ARCO Alaska, Inc.'s application for exception to 20 AAC 25.055(a)(3) for the purpose of drilling the ARCO Alpine CD 1-22 well is approved. A request for rehearing must be received by 4:30 PM on the 23rd day following the date of the order, or next working day if a holiday or weekend, to be timely filed. The Commission shall grant or refuse the application in whole or in part within 10 days. The Commission can refuse an application by not acting on it within the 10-day period. An affected person has 30 days from the date the Commission refuses the application or mails (or otherwise distributes) an order upon rehearing, both being the final order of the Commission, to appeal the decision to Superior Court. Where a request for rehearing is denied by nonaction of the Commission, the 30-day period for appeal to Superior Court runs from the date on which the request is deemed denied (i.e., 10th day after the application for rehearing was filed). ~~ ~~ Notice of Public Hearing r STATE OF ALASKA Alaska Oil and Gas Conservation Commission Re: The application of ARCO Alaska, Inc. for exception to 20 AAC 25.055 to allow drilling the Apline CDI-22 delineation oil well. ARCO Alaska, Inc. by letter dated December 29, 1998 has requested an exception to the provisions of 20 AAC 25.055(a)(3) for the drilling of a delineation oil well due west of the Kuparuk River Unit and adjacent to the eastern boundary of the National Petroleum Reserve, Alaska (NPR-A) on the North Slope. The exception would allow ARCO to drill the Alpine CD1-22 delineation oil well to a bottom-hole location that is closer than 500 feet from a quarter section line. The well will be drilled as a directional hole from a surface location 372' from the north line (FNL) and 2427' from the west line (FWL) of Section 5, Tl 1N RSE, Umiat Meridian (UM) to a bottomhole location 1009' FNL and 2584' FWL of Section 32~T12N~RSE, UM. A person who may be harmed if the requested order is issued may file a written protest prior to 4:00 PM January 20, 1998 with the Alaska Oil and Gas Conservation Commission, 3001 Porcupine Drive, Anchorage, Alaska 99501, and request a hearing on the matter. If the protest is timely filed and raises a substantial and material issue crucial to the Commission's determination, a hearing on the matter will be held at the above address at 9:00 am on February 11, 1998 in conformance with 20 AAC 25.540. If a hearing is to be held, interested parties may confirm this by calling the Commission's office, (907) 279-1433 after January 20, 1998. If no protest is filed, the Commission will consider the issuance of the order without a hearing. The attached Exhibit 1 shows the location of the Well and all other adjoining governmental quarter sections and wells. There are no other completed or drilling wells on the property. The names and addresses of all owners and operators of the governmental quarter sections directly and diagonally offsetting the Well are set forth in the attached Exhibit 2. Included in the attached Exhibit 3 is the verification required by the referenced provisions, a copy of the notice sent to the other owners listed in Exhibit 2, and the date such notice was mailed. Pursuant to 20 AAC 25.055 (b), ARCO, the well operator, prepared a Notice of Request for Exception to the Provision of 20 AAC 25.055. A copy of this notice is attached hereto. 7. On December 29, 1997 pursuant to 20 AAC 25.055 (b), ARCO sent a copy of said notice by certified mail to the last known address of all owners and operators of governmental quarter sections directly and diagonally offsetting the governmental quarter section of the proposed location of ARCO's Alpine CD1-22.
