GRI, Inc. submitted an application dated March 5, 1998 requesting exception to the well spacing provisions of 20 AAC 25.055(a)(4) to allow drilling the GRI, Inc. Houston No. 4 delineation gas well to a location within 1500 feet of a section line near Houston, Alaska. 2. The Commission published notice of opportunity for public hearing in the Anchorage Daily News on March 7, 1998 pursuant to 20 AAC 25.540. 3. No protests to the application were received. FINDINGS: 1. The Houston No. 4 delineation gas well will be drilled as a straight hole from a surface location 100' from the east line and 2500' from the south line of Section 10, T18N, R2W, Seward Meridian. 2. Offset owners Unocal and the U.S. Bureau of Land Management have been duly notified. 3. An exception to the well spacing provisions of 20 AAC 25.055(a)(4) is necessary to allow the drilling of this well. CONCLUSION: Granting a spacing exception to allow drilling of the GRI, Inc. Houston No. 4 well will not result in waste nor jeopardize correlative rights. Conservation Order ~4 March 23, 1998 NOW, THEREFORE, IT IS ORDERED: ~~ GRI, Inc.'s application for exception to the well spacing provisions of 20 AAC 25.055(a)(4) for the purpose of drilling the Houston No. 4 delineation gas well is approved. A request for rehearing must be received by 4:30 PM on the 23`d day following the date of the order, or neat. working day if a holiday or weekend, to be timely filed. The Commission shall grant or refuse the application in whole or in part within 10 days. The Commission can refuse an application by not acting on it within the 10-day period. An affected person has 30 days from the date the Commission refuses the application or mails (or otherwise distributes) an order upon rehearing, both being the final order of the Commission, to appeal the decision to Superior Court. Where a request for rehearing is denied by nonaction of the Commission, the 30-day period for appeal to Superior Court runs from the date on which the request is deemed denied i.e., 10'h day after the application for rehearing was filed). ~~ r• Notice of Public Hearing ~• STATE OF ALASKA Alaska Oil and Gas Conservation Commission Re: GRI, Inc. Houston No. 4 development gas well. GRI, Inc. by letter dated March 5, 1998 has requested an exception to the provisions of 20 AAC 25.055(a)(4) for the drilling of a development gas well on State Oil and Gas Lease ADL 374129. The exception would allow GRI, Inc. to drill the Houston No. 4 development gas well to a bottom-hole location that is closer than 500 feet from a quarter section line. The well will be drilled as a straight-hole from a surface location of 100' from the east line (FEL), 2500' from the south line (FSL), Sec. 10, T18N, R2W, Seward Meridian (SM). A person who may be harmed if the requested order is issued may file a written protest prior to 4:00 PM, March 23, 1998, with the Alaska Oil and Gas Conservation Commission, 3001 Porcupine Drive, Anchorage, Alaska 99501, and request a hearing on the matter. If the protest is timely filed and raises a substantial and material issue crucial to the Commission's determination, a hearing on the matter will be held at the above address at 9:00 AM on April 6, 1998, in conformance with 20 AAC 25.540. If a hearing is to be held, interested parties may confirm this by calling the Commission's office, (907) 279-1433 after March 23, 1998. If no protest is filed, the Commission will consider the issuance of the order without a hearing. Our new proposed location for Houston 4 is on our portion of the State oil and gas lease ADL 374129 at T18N R2W S 10, approximately 100 feet west of the east section line, and approximately 2500 feet north of the south section line, as shown on the attached map. "Notice of Change of Ownership" and "Designation of Operator" forms for Section 10 were lodged with the AOGCC recently. Our deadline to spud this well is March 31, 1998 when the lease expires, although we would like to spud the well about March 20, 1998. This new location alleviates the need to gain access to the drill site through 1500 feet of forested state land, resulting in less environmental degradation and lower drilling and operations costs. Since this well is not within the boundaries of the Houston Gasfield, a DEC Financial Responsibility Instrument of $1,000,000 will be in place before spudding the well. The terms and conditions related to the environmental and drilling permits remain applicable. Please issue the Houston 4 drill permit as soon as possible. The affected landowners are Unocal and the Federal Government (BLM), I have notified each by registered mail, in addition to contacting each by phone to discuss the spacing exception. Each has indicated that they will not object to the well being drilled closer than 1500 feet to, or adjacent to their lands. I have also discussed the project with the surface owners in the affected area, and have received no adverse comments regarding the project. In fact, residents are generally supportive of any effort to connect the Brea to a source of gas. Sincerely, c David W.
