ARCO Alaska, Inc. submitted an application dated May 4, 1998 requesting exception to the well spacing provisions of 20 AAC 25.055(a)(3). The exception would allow drilling the 1H-Ugnu-O1 oil well to a bottom-hole location that is closer than 500 feet from aquarter- section line. 2. The Commission published notice of opportunity for public hearing in the Anchorage Daily News on May 6, 1998 pursuant to 20 AAC 25.540. 3. No protests to the application were received. FINDINGS: 1. The 1H-Ugnu-O1 well will be drilled as a directional hole from a surface location 469' from the north line (FNL), 805' from the east line (FEL), Section 33, T12N, R10E, Umiat Meridian (UM) to a target location of 280' from the south line, 1170' FEL, Section 28, T12N, R10E, UM, and abottom-hole location of 874' FNL, 2153' FEL, Section 33, T12N, R10E, UM. 2. Offset owners BP Exploration (Alaska) Inc., Chevron U.S.A. Inc., Mobil Oil Corporation, UNOCAL Alaska Resources and the State of Alaska have been duly notified. 3. An exception to the well spacing provisions of 20 AAC 25.055 (a)(3) is necessary to allow the drilling of the well. CONCLUSION: Granting a spacing exception to allow drilling of the 1H-Ugnu-O1 oil well will not result in waste nor jeopardize correlative rights. C rlstenson, Commissioner Alaska Oil and Gas Conservation Commission ~~~~-- Camille Oechsli, Commissioner Alaska Oil and Gas Conservation Commission AS 31.05.080 provides that within 20 days after receipt of written notice of the entry of an order, a person affected by it may file with the Commission an application for reheazing. A request for rehearing must be received by 4:30 PM on the 23rd day following the date of the order, or next working day if a holiday or weekend, to be timely filed. The Commission shall grant or refuse the application in whole or in part within 10 days. The Commission can refuse an application by not acting on it within the 10-day period. An affected person has 30 days from the date the Commission refuses the application or mails (or otherwise distributes) an order upon rehearing, both being the final order of the Commission, to appeal the decision to Superior Court. Where a request for reheazing is denied by nonaction of the Commission, the 30-day period for appeal to Superior Court runs from the date on which the request is deemed denied (i.e., l Od' day after the application for rehearing was filed). ~2 N Notice of Public Hearing STATE OF ALASKA Alaska Oil and Gas Conservation Commission Re: Kuparuk River Unit, Ugnu 1H-O1 ARCO Alaska, Inc. by letter dated May 4, 1998 has requested an exception to the provisions of 20 AAC 25.055(a)(3) for the drilling of a deviated oil well to an undefined pool in the Kuparuk River Unit. The exception would allow ARCO Alaska, Inc. to drill the Ugnu 1H-O1 oil well to a bottom-hole location that is closer than 500 feet from a quarter section line. The well will be drilled as a directional hole from a surface location 469' from the north line (FNL), 805' from the east line (FEL), Section 33, T12N, R10E, Umiat Meridian (UM) to a target location of 280' from the south line, 1170' FEL, Section 28, T12N, R10E, UM, and a bottomhole location of 874' FNL, 2153' FEL, Section 33, T12N, R10E, UM. A person who may be harmed if the requested order is issued may file a written protest prior to 4:00 PM, May 21, 1998, with the Alaska Oil and Gas Conservation Commission, 3001 Porcupine Drive, Anchorage, Alaska 99501, and request a hearing on the matter. If the protest is timely filed and raises a substantial and material issue crucial to the Commission's determination, a hearing on the matter will be held at the above address at 9:00 AM on June 4, 1998, in conformance with 20 AAC 25.540. The attached Exhibit 1 shows the location of the Well and all other adjoining governmental quarter sections. There are a number of Kuparuk development wells drilled from Kuparuk River Unit H Pad on the property. Page two (2) of Exhibit 1 shows all development wells drilled from H Pad. The names and addresses of all owners and operators of the governmental quarter sections directly and diagonally offsetting the Well are set forth in the attached Exhibit 2. Included in the attached Exhibit 3 is the verification required by the referenced provisions, a copy of the notice sent to the other owners listed in Exhibit 2, and the date such notice was mailed.
