A copy of the notice sent by certified mail to the owners, landowners and operators described above, the date of mailing, and the addresses- to which the notice was sent. An affidavit by a person acquainted with the facts verifying that all facts are true and that the plat correctly portrays pertinent and required data. If the operator requests a variance from the notice requirements of 20AAC25.055(d), sufficient information to demonstrate that it is not feasible to comply with the notice requirements because of the complexity of ownership within the notice area. STATE OF ALASKA ALASKA OIL AND GAS CONSERVATION COMMISSION 333 West Seventh Avenue, Suite 100 Anchorage Alaska 99501 Re~ THE APPLICATION OF Marathon Oil ) Company ("Marathon") for an order granting ) an exception to the spacing requirements of ) 20 AAC 25.055(a)(2) to provide for the ) testing of the Susan Dionne # 1 well in an ) undefined gas pool. ) Conservation Order No. 476 Susan Dionne #1 Drilling and Testing July 24, 2002 IT APPEARING THAT: 1) Marathon, by letter dated March 20, 2002 and received by the Commission on March 26, 2002, has requested an order allowing a spacing exception in accordance with 20 AAC 25.055 to test the Susan Dionne #1 well within 1500 feet of a property line. 2) Marathon, by letter dated April 18, 2002 and received by the Commission on April 19, 2002, submitted a revised request for spacing exception. 3) The Commission published notice of opportunity for public hearing in the Anchorage Daily News on April 26, 2002 and the Peninsula Clarion on April 26, 2002, pursuant to 20 AAC 25.540. 4) No protests to the application were received. FINDINGS: 1) The surface location of this well is 144 feet from the South line ("FSL") and 1488 feet from the East line ("FEL") of Section 6, TlS, R13W, Seward Meridian ("S.M."). The proposed test interval is located 107 feet FSL and 1687 feet FEL, Section 6, TlS, R13W, S.M. The plugged back bottom hole location for this well is 286 feet FSL, 2555 feet FEL, Section 6, TlS, R13W, S.M. 2) An exception to the well spacing provisions of 20 AAC 25.055 (a)(2) is necessary in order to test the well for gas within 1500 feet of a property line. 3) The Division of Governmental Coordination has determined that the proposed Susan Dionne #1 project does not require a state review for consistency with the Alaska Coastal Management Program. 4) Marathon sent notice of the application for spacing exception by certified mail to all offset owners, landowners, and operators of all properties within 3000 feet of the proposed test interval in the Susan Dionne #1 well. CONCLUSIONS. 1) An exception to 20 AAC 25.055(a)(2) is necessary to allow testing of the Susan Dionne # 1 well. 2) Granting a spacing exception to allow testing of the Susan Dionne #1 well will not result in waste or jeopardize the correlative rights of adjoining or nearby owners. 3) Before regular production is permitted from the Susan Dionne #1 well, the Commission must take such action as will offset any advantage which the person securing the exception may have over other producers by reason of the drilling and testing of the well as an exception, and so that drainage to the tract with respect to which the exception is granted will be prevented or minimized. AS 31.05.100(b). NOW, THEREFORE, IT IS ORDERED: Marathon's application for exception to the 'well spacing provision of 20 AAC 25.055(a)(2) for the purpose of drilling and testing the Susan Dionne #1 well is approved. The Susan Dionne #1 well may not be placed on regular production until the Commission takes additional action, upon petition, and after notice and hearing, to offset any advantage Marathon may have over other owners by reason of drilling Susan Dionne #1 to the exception location and to allow affected owners to produce their just and equitable share of hydrocarbons. The application must include (1) the names of all owners, landowners, and operators of all properties within 1,000 feet of a well drilling for oilor within 3,000 feet of a well drilling for gas for which an exception is sought; (2) a plat drawn to a scale of one inch equaling 2,640 feet or larger, showing the location of the .well for which the exception is sought, all other 27 completed and drilling wells on the property, and all adjoining properties and wells; and (3) an affidavit by a person acquainted with the facts, verifying that all facts are tree and that the plat correctly portrays pertinent and required data. (e) Upon application by the operator, the commission will establish notice requirements different from those of (d) of this section if the operator demonstrates to the commission's satisfaction that compliance with the notice requirements in (d) of this section is not feasible because of the complexity of ownership within the notice area. This map captures the well locations and paths in addition to the requested or approved Location Exceptions for each well. For clarification purposes, the following work plan is expected in the next year. Continue the workover of the SD1 Drill the SD3 Drill the SD2, based on the results of SD3 Marathon was able to re-enter the SD1 successfully; therefore, we do not expect to be sidetracking out of the SD1 in the near future. Marathon requests that AOGCC remove the permit for the SD1RD. Any future sidetrack will most likely be to a location that would require a new permit. Please call me if you have any questions. That for approximately the past two to three years I have worked for Marathon Oil Company (MOC) as a contract field landman. Specifically, I have assisted with preparing MOC's title work in the Ninilchik area located in the Kenai Peninsula Borough, Alaska, under the direct supervision of Mr. J. Brock Riddle, MOC's Alaska Region Land Manager. . That as part of my duties in the Ninilchik area, I have assisted MOC in preparing a notification list for a Location Exception application for the Susan Dionne #1 well in Section 6-1S-13W. o That on or about March 19, 2002 MOC employees mailed notice of the Susan Dionne #1 Well Location Exception application to all of the mineral owners, working interest owners and overriding royalty interest owners within a 3000' radius of the proposed well location by certified mail, return receipt requested, (except for Carl Wayne Kinkead and James C. Sanders). These owners are listed on Exhibit "A" attached hereto. The postal return receipts will be made available for inspection by proper parties. . That I believe that we have mailed the notice letters to good current addresses, except for the notice letters addressed to Carl Wayne Kinkead and James C. Sanders. Despite diligent research I have been unable to ascertain any address for these parties. That in preparing to mail these notices I examined the records of the Bureau of Land Management, Alaska Department of Natural Resources, Kenai Peninsula Borough Assessor's Office, Kenai District Recorder's Office and Homer District Recorder's Office and the Alaska Third Judicial District probate records in Kenai, Homer and Anchorage. In addition, I also personally checked the statewide District Recorder's Office computerized index in Anchorage and the statewide UCC filing records. I checked several on-line computerized telephone directory databases to attempt to determine a telephone number or address, and I contacted co-owners and inquired as to their whereabouts.
