Borough, Alaska Marathon Oil COmpany by letter, dated March 19,' 2003 and received by the Alaska

Oil and Gas Conservation Commission (Commission) on March .20, 2003, has requested the
Commission to issue an order in conformance with 20 AAC 25.055 allowing regular production of
the Beaver Creek Unit 3.DPN Gas Development Well from a location within 1500 feet of the external
boundary of tt~e Beaver Creek Unit. The surface location of the proposed well is 1400' from the north
line and 1500' from the west' line of Section 34, TTN, RIOW Seward Meridian (SM). The top of the
productive interval is estimated to be encountered 1952' from the. south line (FSL) and 634' from the
east line (FEL) of Section 27, T?N, R10W, S.M. The proposed bottomhole location is 2172' FSL and
413! FEL of Section 27, T?N, R10W S.M. The Commission has tentatively seta public hearing on
this application for April 29, 2003 at 9:00 am at the Alaska Oil and Gas Conservation Commission at
333 West ?th Avenue, Suite 100, Anchorage, Alaska 99501. A person may request' that the tenta-
tively scheduled hearing be held by filing a written request with the Commission no later than 4:30
pm on April 10, 2008. If a request for a hearing is not timely filed, the Commission will. consider the
issuance of an order without a hearing. To learn if the Commission will hold the public hearing, please
call 793-1230. In addition, a person may submit written comments regarding this application to the
Alaska Oil and Gas Conservation Commission at 333'West 7th Avenue,' Suite 100, Anchorage,
Alaska 99501. Written comments must be received no later than 4:30 pm on April 28, 2003. If you
are a person with a disability who may need a special modification in order to comment or to attend

IT APPEARING THAT:
1. Marathon Oil Company submitted an application dated March 19, 2003
requesting exception to the well spacing provisions of Title 20 AAC
25.055(a)(2) to allow drilling the Beaver Creek Unit No. 3 Deepen, gas
delineation well to a location which is within 1500 feet of a property
boundary with ownership changes.
2. Notice of opportunity for public hearing was published in the Anchorage
Daily News on March 28, 2003 pursuant to 20 AAC 25.540.
3. No protests to the application were received.
FINDINGS:

The Beaver Creek Unit No. 3 deepen (BCU 3 DPN) gas delineation well
will be drilled as a deviated hole with a surface location 1400 feet from
the north line and 1500 feet from the west line of Section 34, T7N
R10W, Seward Meridian (SM) to a bottomhole location 2172 feet from
the south line and 413 feet from the east line of Section 27 T7N R10W,
SM.
2. Offset owners Cook Inlet Region Inc. and the Bureau of Land
Management have been notified.
3. No protests to the spacing exception application were received.

The objective of the BCU 3 DPN well is to delineate Beluga Formation
gas reserves in a mid structure position on the Beaver Creek anticline.
An exception to the well spacing provisions of Title 20 AAC 25.055
(a)(2) is necessary to allOw the drilling of the BCU 3 DPN.

Drilling to the proposed productive interval for BCU 3 DPN is
inconsistent with the spacing requirements for the Beaver Creek Unit
Beluga Formation Gas Pool as defined in Conservation Order No. 237
Rule 3 (A).
CONCLUSIONS:
1. The requested spacing exception for the BCU 3 DPN well should be
granted, except that the Commission must take such action as will offset
any advantage which Marathon Oil Company may have over adjoining
owners by reason of the drilling the BCU 3 DPN well as an exception,
and so that drainage to the tract with respect to which the exception is
granted will be prevented or minimized.
.
Evaluation of the lateral extent of the Beluga Formation gas reserves in
the BCU 3 DPN w/Il be required to insure protection of the correlative
rights of adjoining owners.
NOW, THEREFORE, IT IS ORDERED:
1. Marathon Oil Company's application for exception to the well spacing
provision of 20 AAC 25.055(a)(2) for the purpose of drilling and producing
the BCU 3 DPN gas delineatiOn well is conditionally approved.
2. The BCU 3 DPN well may not be placed on regular production until
Marathon Oil Company has evaluated the lateral extent of the Beluga
Formation gas reserves in the BCU 3 DPN and the Commission has been
provided that evaluation and has had the opportunity to take additional
action to offset any advantage Marathon may have over other owners by
reason of drilling BCU 3 DPN to the exception location.

AS 31.05.080 provides that within 20 days after receipt of written notice of the entry of an order, a person
affected by it may file with the Commission an application for rehearing. A request for rehearing must be
receiVed by 4:30 PM on the 23rd day following the date of the order, or next working day if a holiday or
weekend, to be timely fled. The Commission shall grant or refuse the application in whole or in part within
10 days. The Commission can refuse an application by not acting on it within the 10-day period. An
affected person has 30 days from the date the Commission refuses the application or mails (or otherwise
distributes) an order upon rehearing, both being the final order of the Commission, to appeal the decision to
Superior Court. Where a request for rehearing is denied by nonaction of the Commission, the 30-day period
for appeal to Superior Court runs from the date on which the request is deemed denied (i.e., 10th day after
the application for rehearing was filed).

Dear Mr. Riddle:
I understand that Marathon Oil Company has expressed some
uncertainty as to what activities are allowed under Conservation Order
No. 490. That Order allows Marathon to evaluate the drainage area of the
Beluga Formation completion in the Beaver Creek Unit 3-Dpn well by
testing the interval through Beaver Creek Unit facilities. Regular
production from the interval will not be allowed, however, until the
drainage area for the well has been agreed upon by the affected parties.

Marathon Oil Company by letter dated March 19, 2003 and received by the Alaska Oil
and Gas Conservation Commission (Commission) on March 20, 2003, has requested the
Commission to issue an order in conformance with 20 AAC 25.055 allowing regular production
of the Beaver Creek Unit 3-DPN Gas Development Well from a location within 1500 feet of the
external boundary of the Beaver Creek Unit. The surface location of the proposed well is 1400'
from the north line and 1500' from the west line of Section 34, T7N, R10W Seward Meridian
(SM). The top of the productive interval is estimated to be encountered 1952' from the south
line (FSL) and 634' from the east line (FEL) of Section 27, T7N, R10W, S.M. The proposed
bottomhole location is 2172' FSL and 413' FEL of Section 27, T7N, R10W S.M.
The Commission has tentatively set a public heating on this application for April 29,
2003 at 9:00 am at the Alaska Oil and Gas Conservation Commission at 333 West 7th Avenue,
Suite 100, Anchorage, Alaska 99501. A person may request that the tentatively scheduled
hearing be held by filing a written request with the Commission no later than 4:30 pm on April
10, 2003.
If a request for a hearing is not timely filed, the Commission will consider the issuance
of an order without a hearing. To learn if the Commission will hold the public hearing, please
call 793-1230.

Marathon Oil Company respectfully requests the following location exception for the referenced
well:
Surface Location Estimate: 1400' FNL and 1500' FWL, Section 34-T7N, R10W, S.M.
Targets: Top Lower Beluga Pay
Estimate ~ 7133' TVD (8628' MD)
1780' FSL and 550' FEL, Section 27-T7N, R10W, S.M.

Estimate ~ 8702' TVD (10,247' MD)
A plat showing the surface location, well paths and top of pay cuts for each operation, and
projected total depths is attached, as well as a directional survey for the wellbore. Furthermore,
the parties listed on the attached Exhibit "A" are entitled to notice of this application (those
owners and landowners with a 3,000 foot radius of operations) and they have been duly notified.
This location is selected with the objective of delineating Lower Beluga gas in a mid-structure
position on the Beaver Creek anticline. Well #3 is a previous shallower Sterling Formation gas
producer (now depleted) that can easily be drilled deeper to the Lower Beluga objective.

Comes now J. Brock Riddle, and first being duly sworn upon his oath, states and deposes as follows:
That I am a legal resident of Anchorage, Alaska over the age of 21 years and mentally
competent to make this affidavit.
2. That I am knowledgeable and fully informed concerning the facts contained in this affidavit.
That for approximately the past seven years I have worked in Alaska for Marathon Oil
Company (MOC) as Land Manager.
That I have assisted in preparing a notification list for a Location Exception application for
the Beaver Creek Unit #3-DPN well with a surface location in Section 34-7N-10W and
bottom hole location in Section 27-7N-1 OW.
That on or about March [qik, 2003 MOC employees mailed notice of the Beaver Creek Unit
3-DPN Well Location Exception application to all of the mineral owners within a 3000'
radius of the proposed well location by certified mail, return receipt requested. I have
attached a list of these mineral owners to this affidavit as Exhibit "A". The postal return
receipts will be made available for inspection by proper parties. I believe that we have mailed
the notice letters to good current addresses
In view of the foregoing facts, affiant herein states and deposes that Marathon Oil Company as
operator of the proposed Beaver Creek Unit #3-DPN Unit well has made a reasonable and diligent
