ConocoPhillips Alaska, Inc. ("ConocoPhillips"), by letter dated June 25, 2003 and received by the Alaska Oil and Gas Conservation Commission ("Commission") on June 30, 2003, requests exception to the well spacing provisions of Rule 3, Conservation Order 432B to allow drilling and regular production of the Kuparuk River Unit ("KRU") 1B-20 oil development well to a location which is within the same governmental quarter section as an existing oil production well. 2. Notice of opportunity for public hearing was published in the Anchorage Daily News on July 7, 2003 pursuant to 20 MC 25.540. 3. No protests to the application were received. FINDINGS: 1. The KRU 1B-20 oil development well will be drilled as a deviated hole with a surface location 497 feet from the north line ("FNL") and 820 feet from the east line ("FEL") of Section 9, T 11 N, R 1 OE, Umiat Meridian ("UM") to a bottomhole location 2639 feet FNL and 12 feet from the FEL of Section 8, T11N, R10E, UM. 2. The location of the KRU 1B-20 well was selected as the most favorable structural position to recover fault-isolated oil reserves in Conservation Ordei Page 2 of 3 September 10, 2003 497 the Kuparuk River Formation that are not recoverable with the current well pattern. 3. The KRU lB-20 well bore will open the Kuparuk River Oil Pool to production in the NW 1/4 of Section 9 and the NE 1/4 of Section 8, T1 iN, R10E, UM. 4. The anticipated productive portion of the KRU lB-20 well bore that lies in Section 9, Ti IN, R10E, UM is within the same governmental quarter section as the KRU lB-13 oil production well. Drilling of, and production from, this portion of the KRU lB-20 well bore requires an exception to the spacing provisions of Rule 3, Conservation Order 432B. 5. The anticipated productive portion of the KRU lB-20 well bore that lies in Section 8, T1 iN, R10E, UM does not require an exception because, per Rule 3 of Conservation Order 432B, an unrestricted number of wells may be drilled in that section. 6. Offset landowners, owners and operators within 3,000 feet of the anticipated productive interval of the KRU lB-20 well have been notified. 7. No protests to the spacing exception application were received. CONCLUSIONS: 1. An exception to the well spacing provisions of Rule 3, Conservation Order 432B is necessary to allow the drilling and production of the KRU lB-20 oil development well. 2. Granting the requested spacing exception for the KRU lB-20 well will promote more efficient recovery of oil reserves and will not result in waste or jeopardize the correlative rights of adjoining or nearby owners. NOW, THEREFORE, IT IS ORDERED: 1. ConocoPhillips' application for exception to the well spacing provision of Rule 3, Conservation Order 432B to allow the drilling and production of the KRU lB-20 oil development well is approved. Seamount, ,Jr., Commissioner Alaska Oil and Gas Conservation Commission AS 31.05.080 provides that within 20 days after receipt of written notice of the entry of an order, a person affected by it may file with the Commission an application for rehearing. A request for rehearing must be received by 4:30 PM on the 23rd day following the date of the order, or next working day if a holiday or weekend, to be timely filed. The Commission shall grant or refuse the application in whole or in part within 10 days. The Commission can refuse an application by not acting on it within the 10-day period. An affected person has 30 days from the date the Commission refuses the application or mails (or otherwise distributes) an order upon rehearing, both being the final order of the Commission, to appeal the decision to Superior Court. Where a request for rehearing is denied by nonaction of the Commission, the 30-day period for appeal to Superior Court runs from the date on which the request is deemed denied (i.e., l0th day after the application for rehearing was filed). ("CPAI") for a spacing exception to allow the drilling and production of the Kupamk River Unit ("KRU") lB-20 Oil Development Well. CPAI, by letter dated June 25, 2003 and received by the Alaska Oil and Gas Conservation Commission ("Commission") on June 30, 2003, has requested the Commission to issue an order in conformance with 20 AAC 25.055 allowing the drilling and regular production of the KRU lB-20 development well from a location within the same governmental quarter section as another well capable of producing from the same oil pool. The surface location of the proposed well is 497 feet from the north line ("FNL") and 820 feet from the east line ("FEL") of Section 9, Tl lN, R10E, Umiat Meridian ("UM"). The proposed bottom hole location is 2639 feet FNL and 12 feet from the FEL of Section 8, T11N, R10E, UM. The Commission has tentatively set a public hearing on this application for August 12, 2003 9:00 am at the Alaska Oil and Gas Conservation Commission at 333 West 7th Avenue, Suite 100, Anchorage, Alaska 99501. A person may request that the tentatively scheduled hearing be held by filing a written request with the Commission no later than 4:30 pm on July 23, 2003. The proposed 1B-20 is designed as an infill Kuparuk A and C sand producer. This new well will recover A and C Sand waterflood and enhanced oil recovery (EOR) reserves that are located in a fault isolated area. Risked A and C Sand incremental reserves are 1.08 and 0.56 MMSTBO, respectively. These reserves are not recoverable with the current well pattern configuration. In addition, well 1B-20 will provide additional implementation of the Kuparuk EOR project and will add a total of 363 MSTB of EOR reserves. The requested exception refers to the well spacing requirements specified in Rule 3 of Conservation Order 432B, which states: "Not more than one well may be drilled on any governmental quarter section...", because a portion of the prospective pay interval in 1B-20 will lie within the NW 1/4 of Section 9, T 11N, R10E, U.M., and that portion of 1B-20 will be the second well drilled within that particular quarter section (the other well being the existing 1B-13 production well). Property line considerations do not apply, as the 1B-20 well bore will be in the main portion of the Kuparuk River Unit, and therefore will be more than 500 feet from a property line where ownership or landownership changes. Offset well distance requirements do no apply because the 1B-20 well bore will lie more than 1000 feet from other wells completed within the pool. The portion of the 1B-20 well bore that lies in Section 8, T11N, R10E, U.M. does not require an exception because, per Rule 3 of CO 432B, an unrestricted number of wells may be drilled in that section. Adjusting the directional profile to move the productive interval completely into Section 8, T11N, R10E is undesirable because there is a distinct possibility of the C4 target being completely faulted out of the well bore. The fault has an estimated throw of -20 feet at the top Kuparuk, and the C4 is estimated at ~20 feet thick. If the C4 sand was completely faulted out, it would result in a loss of 34% of the projects reserves. The A4 target will likely be pushed to the West of the fault, which seems discontinuous and to be intermittently baffling in the lower Kuparuk in this area. This would likely impact recovery, if the well is on the West of the lower K faulting. Even though the well design requires us to perforate the Kuparuk C sand prior to running the single selective completion, we do not intend to produce or test the well until we receive a spacing exception.
