IT APPEARING THAT:

Marathon Oil Company submitted an application dated August 20, 2003 requesting
exception to the well spacing provisions of Title 20 AAC 25.055(a)(4) to allow drilling
the Beaver Creek Unit No. 13, gas development well to a location which is within the
same governmental section and within 3000 feet of another well capable of producing
from the same pool.
Notice of opportunity for public hearing was published in the Anchorage Daily News on
August 28, 2003 pursuant to 20 AAC 25.540.
3. No protests to the application were received.
FINDINGS:
The Beaver Creek Unit No. 1.3 (BCU 13) gas development well will be drilled as a
deviated hole with a surface location 1479 feet from the west line (FWL) and 1310 feet
from the North line (FNL) of Section 34, T7N R10W, Seward Meridian (SM) to a
bottomhole location 2680 FWL and 2411 FNL of Section 34, T7N R10W, SM.

Offset landowners, owners and operators within 3,000 feet of the anticipated
productive interval of the BCU 13 well have been notified.
3. No protests to the spacing exception application were received.

The location of the BCU 13 well was selected as a favorable structural position for
Tyonek Formation gas reserves on the Beaver Creek Unit structure, if successful the
well will access reserves that are not producible from any existing wells.
5. An exception to the well spacing provisions of Title 20 AAC 25.055 (a)(4) is necessary
to allow the drilling of the BCU 13.
CONCLUSIONS:
1. The requested spacing exception for the BCU 13 well should be granted, except that the
Commission must take such action as will offset any advantage which Marathon Oil

Company may have over adjoining owners by reason of the drilling the BCU 13 well as
an exception, and so that drainage to the tract with respect to which the exception is
granted will be prevented or minimized.
2. Evaluation of the lateral extent of the Tyonek Formation gas reserves in the BCU 13 will
be required to insure protection of the correlative rights of adjoining owners.
NOW, THEREFORE, IT IS ORDERED:

Marathon Oil Company's application for exception to the well spacing provision of 20 AAC
25.055(a)(4) is conditionally approved.
The BCU 13 well may not be placed on regular production until Marathon Oil Company has
evaluated the lateral extent of the Tyonek Formation gas reserves in the BCU 13 and the
Commission has been provided that evaluation and has had the opportunity to take additional
action to offset any advantage Marathon may have over other owners by reason of drilling
BCU 13 to the exception location.

AS 31.05.080 provides that within 20 days after receipt of written notice of the entry of an order, a person affected by it may file
with the Commission an application fbr rehearing. A request fbr rehearing must be received by 4:30 PM on the 23rd day fbllowing
the date of the order, or next working day if a holiday or weekend, to be timely filed. The Commission shall grant or refuse the
application in whole or in part within 10 days. The Commission can refuse an application by not acting on it within the 10-day
period. An affected person has 30 days fi'om the date the Commission refuses the application or mails (or otherwise distributes)
an order upon rehearing, both being the final order of the Commission, to appeal the decision to Superior Court. Where a request
for rehearing is denied by nonaction of the Commission, the 30-day period fbr appeal to Superior Court runs fi'om the date on
which the request is deemed denied (i.e., l0th day after the application fbr rehearing was filed).

Re:
The application of Marathon Oil Company (MOC) for a spacing exception to
allow the drilling and production of the Beaver Creek No. 13 Gas Development
Well.
MOC by letter dated August 20, 2003, has requested the Commission to issue an
order in conformance with 20 AAC 25.055 allowing the drilling and regular production
of the Beaver Creek No. 13 Gas Development Well from a location within the same
governmental section and within 3000 feet of another well capable of producing from the
same pool. The surface location of the proposed well is 1479 feet from the west line and
1310 feet from the north line of Section 34, T7N, R10W Seward Meridian (SM). The
proposed bottomhole location is 2411 feet from the north line and 2680 feet from the
west line of Section 34, T7N, R10W, S.M.
The Commission has tentatively set a public hearing on this.application for September 30,
2003 at 9:00 am at the Alaska Oil and Gas Conservation Commission at 333 West 7th
Avenue, Suite 100, Anchorage, Alaska 99501. A person may request that the tentatively
scheduled hearing be held by filing a written request with the Commission no later than
4:30 pm on September 15, 2003.
If a request for a hearing is not timely filed, the Commission will consider the issuance of
an order without a hearing. To learn if the Commission will hold the public hearing,
please call 793-1230.
In addition, a person may submit written comments regarding this application to the
Alaska Oil and Gas Conservation Commission at 333 West 7th Avenue, Suite 100,
Anchorage, Alaska 99501. Written comments must be received no later than 4:30 pm on
September 29, 2003.

A plat showing the surface location, well paths and top of pay cuts for each target, and projected total
depths is attached, as well as a directional survey for the well bore, and a cross-section of the Upper
Tyonek Formation. Furthermore, the parties listed on the attached Exhibit "A" are entitled to notice of this
application (those owners and landowners within a 3,000 foot radius of operations) and they have been duly
notified.
Based on a 3-D seismic interpretation, the proposed location for well BCU #13 is approximately 70 feet
structurally higher than BCU #6 and 100 feet higher than BCU #2 at the completed Tyonek gas sand
intervals, mad in a position which could encounter gas sands at the crest of the structure which are wet or
not present in those wells. A standard open hole logging suite (including RFT measurements if wan'anted)
will be acquired in the well bore to verify structure, reservoir properties, fluid saturation, and original
pressure and permeability estimates. Lastly, inasmuch as we have existing infrastructure at Beaver Creek
field, the BeaVer Creek #13 well will be tested into the sales meter and pipeline to evaluate its potential.
Marathon will, however, consult AOGCC prior to placing the well on regular production.
