IT APPEARING THAT:
1. Marathon Oil Company (MOC) submitted an application dated May 12, 2004
requesting exception to the well spacing provisions of Title 20 AAC 25.055(a)(4)
to allow drilling the Beaver Creek Unit (BCD) No. 14, gas development well to a
producing location that is within 3000 feet of a well producing from the same
pool;
2. Notice of opportunity for public hearing was published in the Anchorage Daily
News on May 20,2004, pursuant to 20 AAC 25.540; and
3. No protests to the application or requests for hearing were received.
FIND IN GS:
1.
The BCD No. 14 gas development well is proposed to be drilled as a deviated
hole with a surface location 1325 feet from the east line and 111 feet from the
south line of Section 33, T7N RI0W, Seward Meridian (SM) to a bottomhole
location 243 feet from the east line and 2051 feet from the south line of Section
33, T7N Rl OW, SM.
2.
The proposed productive interval of the BCU No. 14 well will be located
approximately 1650 feet from the Lower Beluga Formation producing zones in
BCD No.9.
3.
Offset landowners, owners and operators within 3,000 feet of the anticipated
productive interval of the BCU No. 14 well haveall been notified.
4.
The location of the BCD No. 14 well was selected due to reservoir pressure data
from the Beaver Creek Field that indicates the laterally discontinuous reservoirs
ofthe Beluga Formation cannot be efficiently depleted with 3,000 feet inter-well
spaCIng.

An exception to the well spacing provisions of Title 20 AAC 25.055 (a)(4) is
necessary to allow the drilling of the BCD No. 14 gas storage well.
CONCLUSION:
Granting a spacing exception to allow drilling and production of the BCD No. 14 gas
storage well will not result in waste or jeopardize the correlative rights of adjoining or
nearby owners, landowners and operators..
NOW, THEREFORE, IT IS ORDERED:

Alaska Oil and Gas Conservation Commission
AS 31.05.080 provides that within 20 days after receipt of written notice of the entry of an order, a
person affected by it may file with the Commission an application for rehearing. A request for rehearing
must be received by 4:30 PM on the 23rd day following the date of the order, or next working day if a
holiday or weekend, to be timely filed. The Commission shall grant or refuse the application in whole or
in part within 10 days. The Commission can refuse an application by not acting on it within the lO-day
period. An affected person has 30 days from the date the Commission refuses the application or mails
(or otherwise distributes) an order upon rehearing, both being the final order of the Commission, to
appeal the decision to Superior Court. Where a request for rehearing is denied by nonaction of the
Commission, the 30-day period for appeal to Superior Court runs from the date on which the request is
deemed denied (i.e., 10th day after the application for rehearing was filed).

Re:
The application of Marathon Oil Company (MaC) for a spacing exception to
allow the drilling and production of the Beaver Creek Unit No. 14 (BCU 14) gas
development well in accordance with 20 AAC 25.055.
MaC by letter dated May 12, 2004 and received by the Alaska Oil and Gas
Conservation Commission ("Commission") on May 13, 2004, has requested the
Commission to issue an order in conformance with 20 AAC 25.055 allowing regular
production of the BCU 14 gas development well, which if productive may be open to
regular production within 3,000 feet of a well drilled to and completed in the same pool.
The surface location of the proposed well is 111 feet from the south line and 1325 feet
from the east line of Section 33, T7N, RlOW, SM. The proposed bottomhole location is
2051 feet from the south line and 243 feet from the east line of Section 33, T7N, RlOW,
SM.
The Commission has tentatively set a public hearing on this application for June 29, 2004
at 9:00 am at the Alaska Oil and Gas Conservation Commission at 333 West 7th Avenue,
Suite 100, Anchorage, Alaska 99501. A person may request that the tentatively
scheduled hearing be held by filing a written request with the Commission no later than
4:30 pm on June 15,2004.
If a request for a hearing is not timely filed, the Commission may consider the issuance
of an order without a hearing. To learn if the Commission will hold the public hearing,
please call (907) 793-1221.
In addition, a person may submit written comments regarding this application to
the Alaska Oil and Gas Conservation Commission at 333 West ih Avenue, Suite 100,
Anchorage, Alaska 99501 Written protests or comments must be received no later than
June 21, 2004 except that if the Commission decides to hold a public hearing, written

Marathon Oil Company respectfully requests the following location exception for the referenced
well:
Surface Location:
Ill' FSL & 1325' FEL, Section 33, T7N, R10W, S.M.
Target:
Multiple Lower Beluga Gas Reservoirs between 6855' and 8490' TVD.
Top Lower Beluga Formation
Estimate @ 6855' TVD, 7554' MD
2051' FSL & 243' FEL, Section 33, T7N, R10W, S.M.
Bottom Hole:
Estimate @ 8490' TVD, 9194' MD
2051' FSL & 243' FEL, Section 33, T7N, R1ûW, S.M.
Down hole reservoir pressure data acquired in Well BCU # 13 demonstrates that at 160 acre well
spacing (3000' well radius) numerous Lower Beluga reservoirs show no pressure depletion. Beluga
reservoirs are highly laterally discontinuous and will require a smaller drainage area for efficient
gas recovery. The target and bottom hole location is approximately 1650' from Lower Beluga
producing zones in Well BCU #9. However, at this location it is anticipated that Well BCU #14
will encounter several undepleted reservoirs which will be perforated for completion and
production. A standard open hole logging suite (including RFT pressure measurement) will be
acquired in this well to verify reservoir quality, fluid saturation and pressure.
Attached is a plat showing the BCU surface locations, well paths and top of Lower Beluga cut
points. Also attached is a pre-drill directional survey for Well BCU #14. Furthermore, the parties
listed on Exhibit "A" are entitled to notice of this application and have been duly notified.

Comes now J. Brock Riddle, and first being duly sworn upon his oath, states and deposes as follows:

That I am a legal resident of Anchorage, Alaska over the age of 21 years and mentally
competent to make this affidavit.
2.
That I am knowledgeable and fully informed concerning the facts contained in this affidavit.
3.
That for approximately the past seven years I have worked in Alaska for Marathon Oil
Company (MOC) as Land Manager.
4.
That I have assisted in preparing a notification list for a Location Exception application for the
Beaver Creek Unit #14 well with a surface location in Section 33-7N-I0W and bottom hole
location in Section 33-7N-I0W.
5.
That on or about May 12,2004 MaC employees mailed notice of the Beaver Creek Unit 14
Well Location Exception application to all of the mineral owners within a 3000' radius of the
proposed well location by certified mail, return receipt requested. I have attached a list of these
mineral owners to this affidavit as Exhibit "A". The postal return receipts will be made
available for inspection by proper parties. I believe that we have mailed the notice letters to
good current addresses
In view of the foregoing facts, affiant herein states and deposes that Marathon Oil Company as operator
of the proposed Beaver Creek Unit #14 well has made a reasonable and diligent effort to identify, locate
and contact all parties legally due notice of the said Location Exception application.
