Marathon Oil Company ("MOC") by letter dated November 17, 2004, requested an order allowing a spacing exception under 20 AAC 25.055 to allow the drill and operation of the Susan Dionne 4 well. The Commission published notice of opportunity for public hearing in the Anchorage Daily News on December 1,2004, pursuant to 20 AAC 25.540. No protests to the application or requests for hearing were received. FINDINGS: 1. 2. 3. 4. The surface location of this well is 104 feet from the south line ("FSL") and 1331 feet from the east line ("FEL") of Section 6, TIS, R13W, Seward Meridian ("S.M."). The projected bottom hole location for this well is 4870 feet FSL, 3095 feet FEL, Section 12, TIS, R14W, S.M. An exception to the well spacing provisions of20 AAC 25.055 (a)(2) is necessary for the production of this well. The anticipated productive interval in the Beluga and Tyonek Formations of the Susan Dionne No.4 gas development well, if successful, will be within 1,500 feet of a property line between two landowners. An exception to the well spacing provisions of20 AAC 25.055 (a)(4) is necessary for the drilling and production of this well. The anticipated productive interval in the Beluga and Tyonek Formations of the Susan Dionne No.4 gas development well, if successful, will be within 3,000 feet and in the same pool as the productive interval in the Susan Dionne No.3 gas development well. MOC sent notice of the application for spacing exception by certified mail to all offset owners, landowners, and operators of all properties within 3,000 feet of the proposed Susan Dionne No.4 well. The location of the Susan Dionne No.4 well was selected on the basis of a favorable structural position for recovery of gas reserves from the Beluga and Tyonek Formations that are not believed to recoverable from the Susan Dionne No.3 well or from a location greater than 1500 feet from a property line between two landowners. 6. Wells Susan Dionne No.3 and 4 are located within the Susan Dionne Participating Area in the Ninilchik Unit. 7. The anticipated productive interval of the Susan Dionne No.4 well is more than 1500 feet from the external boundary of the Ninilchik Unit. CONCLUSIONS: 1. An exception to 20 AAC 25.055(a)(2) and (4) is necessary to allow drilling and production of the Susan Dionne No.4 gas development well. Granting a spacing exception to allow drilling and production of the Susan Dionne No.4 well will not result in waste or jeopardize the correlative rights of adjoining or nearby owners. 2. NOW, THEREFORE, IT IS ORDERED: AS 31.05.080 provides that within 20 days after receipt of written notice of the entry of an order, a person affected by it may file with the Commission an application for rehearing. A request for rehearing must be received by 4:30 PM on the 23M day following the date of the order, or next working day if a holiday or weekend, to be timely filed. The Commission shall grant or refuse the application in whole or in part within 10 days. The Commission can refuse an application by not acting on it within the 10-day period. An affected person has 30 days from the date the Commission refuses the application or mails (or otherwise distributes) an order upon rehearing, both being the final order of the Commission, to appeal the decision to Superior Court. Where a request for rehearing is denied by nonaction of the Commission, the 30-day period for appeal to Superior Court runs from the date on which the request is deemed denied (Le., lOth day after the application for rehearing was filed). The expanded Participating Area, containing 2123.13 acres, brings in an additional 120 acres under ADL 389180 and an additional 202.56 acres under ADL 384372. ADL 359242, the Cook Inlet Region, Inc. lease and the fee leases remain unchanged as to net acreage. As a result of the Susan Dionne Participating Area expansion, royalties will need to be reallocated to the appropriate owners. Marathon proposes that this reallocation of royalties be done as a redistribution back to the date of first production, which occurred in December 2003. Marathon will perform this reallocation to coincide with the distribution of October 2004 production revenue. This will occur on November 30, 2004 for the State of Alaska and Cook Inlet Region Inc. and on December 27, 2004 for the remaining royalty and overriding royalty owners. Based on the current levels of production, it is anticipated that any overpayments to the remaining royalty and overriding royalty owners will be recovered within two months.
